GIG HARBOR CANOE/KAYAK RACING TEAM PARTICIPANT RELEASE OF LIABILITY & ASSUMPTION OF RISK AGREEMENT

READ BEFORE SIGNING

In consideration of being allowed to participate in any way in paddle sports, related events and activities, I the undersigned, acknowledge, appreciate, and agree that:

1. The risk of injury from the activities involved in this watersport program is significant, including but not limited to (1) changing water flow, tides, currents and wave action, (2) collision with other participants or watercraft and manmade or natural objects, including capsizing, (3) varying wind and temperatures, including inclement weather and lighting, (4) any limitations in my ability to swim, follow directions, maintain my balance, and operate the equipment, (5) exposure to the elements, which may result in hypothermia, sunburn, sunstroke, dehydration, fatigue, chill and/or dizziness, (6) equipment failure, (7) the presence of insects and marine life and (8) the potential for permanent paralysis and death.

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation.

3. I willingly agree to comply with terms and conditions for participation, and hereby confirm I have a current and valid American Canoe Association membership that has not expired. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Gig Harbor Canoe/Kayak Racing Team, Team Highlander Athletics, LLC, the American Canoe Association, Inc., and their officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any injury, disability or death I may suffer, or loss or damage to person or property, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

 

AMERICAN CANOE ASSOCIATION WAIVER & RELEASE OF LIABILITY

READ BEFORE SIGNING

IN CONSIDERATION of being permitted to participate in any way in the American Canoe Association, Inc. sports and recreation program and related activities (“Activities”) I, for myself, my personal representatives, assigns, heirs, and next of kin:

1. ACKNOWLEDGE, agree, and represent that I understand the nature of Paddlesports and related Activities and that I am qualified, in good health, in proper physical condition to participate in such Activity and willingly agree to comply with the stated and customary terms and conditions of participation. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity. If I decide to leave early and not complete the trip as planned, I assume all risks inherent in my decision to leave.

2. FULLY UNDERSTAND that: (a) Paddlesports and related ACTIVITIES INVOLVE RISKS AND DANGERS OF DAMAGE TO PERSONAL PROPERTY AND SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE American Canoe Association, Inc., its Paddle America Clubs, affiliated clubs and organizational affiliates, their respective ACA certified instructors, certified instructor trainers, and certified instructor trainer educators, administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, INJURIES, DAMAGE TO PROPERTY, OR OTHER DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

MINOR PARTICIPANT (if applicable): I, THE MINOR PARTICIPANT, HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

 

COACH CODE OF CONDUCT

As a GHCKRT Coach, I am expected to:

1) place the emotional and physical well being of the GHCKRT athletes ahead of a personal desire towin.

2) be aware that I have a tremendous influence, for either good or ill, on the education ofthe athlete and, thus, shall never place the value of winning above the value of instilling the highest ideals ofcharacter.

3) uphold the honor and dignity of the profession as well as the privilege to coach the youngpeople of our community. In all personal contact with athletes, officials, parents, GHCKRT staff, volunteers themedia and the public, I shall strive to set an example of the highest ethical and moral conduct.

4) strive to become a technical expert of Canoe/Kayak and use positive coaching methods to makethe experience enjoyable for athletes, increase their self-esteem and foster in them a true sense of love andenjoyment of Canoe/Kayak.

5) treat each player as an individual, remembering the large range of emotional and physicaldevelopment for the same age group. I shall observe all athletes and strive to make each participantfeel as if he/she is a valuable member of the team regardless of any physical or developmental limitations he/shemay have.

6) do my best to organize practices that are safe, fun and challenging for all athletes.

7) work/collaborate with the entire coaching staff to promote the values of the GHCKRT and direct all programs in harmony with its goals.

8) model the principles of fair play and sportsmanship at all times.

9) respect and support regatta officials and volunteers. I shall not indulge in conduct which would incite players or spectators against the officials.

10) model grace, dignity and composure regardless of the outcome of any competition or event.

11) avoid personal abuse and harassment of others, whether verbal, physical, emotional or sexual.

12) take an active role in the prevention of drug, alcohol and tobacco abuse.

If Code of Conduct not upheld and/or circumstances warrant, determination of continuation on GHCKRT decided by Board of Directors.

GHCKRT Waiver of Liability Relating to Coronavirus/COVID-19

READ BEFORE SIGNING

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

GIG HARBOR CANOE AND KAYAK RACING TEAM cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading COVID-19 while utilizing GIG HARBOR CANOE AND KAYAK RACING TEAM’s services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize GIG HARBOR CANOE AND KAYAK RACING TEAM’s services and/or enter onto GIG HARBOR CANOE AND KAYAK RACING TEAM’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize GIG HARBOR CANOE AND KAYAK RACING TEAM's services and enter GIG HARBOR CANOE AND KAYAK RACING TEAM’s premises. These services are of such value to me and/or to my children, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize GIG HARBOR CANOE AND KAYAK RACING TEAM's services and premises in person.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against GIG HARBOR CANOE AND KAYAK RACING TEAM and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing GIG HARBOR CANOE AND KAYAK RACING TEAM’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

CHOICE OF LAW: I understand and agree that the law of the State of Washington will apply to this contract.

I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE:
