  ASI Dynamics Waiver and Release of Liability

In consideration of being permitted to attend and participate in a firearms instruction course, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, including the Student’s agreement to be bound by ASI Dynamics’ Terms & Conditions (which are incorporated herein by reference), the Student agrees as follows:

1. Instructor and Released Parties

  • Instructor refers to ASI Dynamics LLC and all of its owners, employees, agents, and/or assistants.
  • Released Parties means Instructor, and each of its past, present, and future owners, members, managers, officers, directors, employees, agents, contractors, assistants, volunteers, insurers, successors, and assigns.

2. Indemnification

Student agrees to indemnify, hold harmless, and defend Instructor from any and all fault, liabilities, costs, expenses, claims, demands, or lawsuits.

This obligation includes, without limitation, claims arising out of or related to:

  • Student’s presence at or participation in the course of instruction;
  • The future use or application of such instruction;
  • The discharge of firearms by Student;
  • Student’s presence on or use of the range, building, land, and premises (“Premises”); and
  • Any act or omission of Student.

3. Waiver and Release

Student hereby waives, for themselves and for their executors, personal representatives, administrators, assignees, heirs, and next of kin, any and all rights and claims for damages, losses, demands, or causes of action of any kind that Student now has or may hereafter have against Released Parties.

This waiver includes, without limitation, claims arising from:

  • The death of Student;
  • Any injury, damage, illness, or loss suffered by Student or Student’s property;
  • The course of instruction;
  • The Premises, including any latent condition or defect;
  • Student’s presence on or use of the Premises; and
  • The use of ammunition and the handling or discharge of firearms.

Student expressly releases Released Parties from any and all such claims and liabilities.

This release includes claims arising from the ordinary negligence of the Released Parties, but does not apply to gross negligence or willful misconduct to the extent prohibited by law.

To the fullest extent permitted by law, Released Parties shall not be liable for any injury, death, illness, property damage, or loss arising out of or related to Student’s participation in training or presence on the Premises.

4. Acknowledgment of Terms and Rules

Student acknowledges that they have:

  • Read this waiver and understand its terms;
  • Had the opportunity to ask questions; and
  • Agreed to at all times abide by all range rules, procedures, and any other rules stated by the Instructor.

Student acknowledges that scheduling, cancellation, postponement, and nonperformance due to events beyond the reasonable control of ASI Dynamics are governed by the ASI Dynamics Terms & Conditions, including force majeure provisions, which are incorporated herein by reference. Student further agrees that violations of applicable rules, policies, or instructions may result in immediate removal from the Premises without refund.

5. Broad Scope and Severability

This waiver is intended to be as broad and inclusive as permitted by law. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force.

No remedy conferred by any provision is exclusive; all remedies are cumulative. Election of one remedy does not waive any other remedy. This waiver binds Student and their executors, personal representatives, administrators, assignees, heirs, and next of kin.

6. Assumption of Risk

Student acknowledges that handling, use, and presence of firearms, ammunition, and related equipment involve inherent and significant risks, including serious bodily injury, death, and property damage.

Student knowingly, voluntarily, and expressly assumes all such risks, whether known or unknown, foreseeable or unforeseeable. This applies to all participation in the course and activities on the Premises, including firearms instruction, handling and discharge of firearms, and firing of live ammunition.

7. Firearm Safety Rules

Student agrees to strictly comply with all firearm safety rules, including but not limited to:

  1. Treat all firearms as loaded at all times.
  2. Never point a firearm at any person, object, or direction not intended to shoot, harm, or destroy.
  3. Keep your finger outside the trigger guard until prepared to discharge.
  4. Positively identify the intended target, backstop, and all areas beyond the target before firing.

Failure to comply constitutes a material breach and may result in immediate removal without refund. Compliance with all verbal and written instructions provided by instructors is mandatory.

8. Release and Indemnity for Rule Violations

To the fullest extent permitted by law, Student agrees to release, defend, indemnify, and hold harmless Released Parties from any claims, demands, causes of action, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from failure to comply with firearm safety rules, negligent or reckless conduct, or misuse of firearms.

9. Legal Eligibility Certification

Student represents, warrants, and certifies that they are not prohibited under any federal, state, or local law, regulation, or court order from possessing, handling, receiving, or using firearms or ammunition.

Without limitation, Student is not prohibited due to conviction, pending charge, restraining/protective order, mental health adjudication, immigration status, or other legal disability. Student agrees to immediately notify Instructor if prohibited at any time before or during participation.

Any false statement, misrepresentation, or omission constitutes a material breach and may result in removal and referral to authorities.

10. Governing Law and Venue

This Waiver shall be governed by and construed in accordance with the laws of the state in which ASI Dynamics LLC is organized, without regard to conflict-of-law principles. Venue for any dispute arising under or related to this Waiver shall lie exclusively in the appropriate courts of that jurisdiction.

11. Enrollment Certification

By enrolling, paying, and attending training, Student declares that no legal or physical restriction exists that would prevent safe participation in firearms or personal protection training. Student further certifies they are not prohibited under federal or state law from possessing or handling firearms. 

By signing below, Student acknowledges this is a legally binding release.
