Total Baseball Training Centre – Batting Cage Rental Liability Waiver

Effective for all batting cage rentals starting April 1, 2025, until replaced or updated.

In consideration for being permitted to rent and use the batting cages at Total Baseball Training Centre, I, the undersigned, acknowledge and agree to the following terms and conditions:


1. Assumption of Risks:

I understand that using the batting cages involves inherent risks, including but not limited to being struck by baseballs or softballs, equipment malfunction, slipping, tripping, or other potential injuries. I voluntarily accept full responsibility for any risk of injury, property damage, or loss arising from the use of the batting cages.

2. Equipment Requirements

I acknowledge that it is my responsibility to ensure all participants wear appropriate protective equipment, including a batting helmet. Only bats suitable for use with regulation baseballs or softballs may be used. I understand that using a bat not rated for real balls may result in damage or breakage, and I assume all responsibility for any resulting issues or injuries.

3. Use of Pitching Machines

I understand that the pitching machines are self-feeding but must be manually loaded with balls. It is the responsibility of the renter or a designated person to safely load the machine. Total Baseball Training Centre staff will not be responsible for loading or operating the machines during rental periods.

4. Release and Waiver of Claims

I, on behalf of myself, my heirs, executors, administrators, and assigns, release and discharge Total Baseball Training Centre, its owners, employees, coaches, and volunteers from any and all claims, demands, or causes of action that may arise from injury, loss, or damage while using the batting cages, including those arising from the negligence of the aforementioned parties.

5. Agreement Not to Sue

I agree not to make any claims or bring any lawsuits against Total Baseball Training Centre or its staff in connection with my use of the batting cages.

6. Indemnification

I agree to indemnify and hold harmless Total Baseball Training Centre from any claims, liability, damages, or costs (including legal fees) that may result from my actions, misuse of the equipment, or failure to comply with facility rules during the rental.

7. Governing Law and Jurisdiction

This waiver shall be governed by and interpreted in accordance with the laws of the Province of Ontario. Any legal action arising from this waiver shall be brought exclusively in Ontario courts.

8. Acknowledgment of Understanding

I confirm that I have read this waiver in full, understand its contents, and sign it voluntarily. I understand that by signing, I am giving up legal rights, including the right to sue.
