Release, Waiver, Indemnification, Hold Harmless, and Assumption of Risk

STUDENT AGREEMENT

Whereas, in consideration of being permitted to attend a course for instruction in firearms and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Student agrees to the following: 

It is expressly agreed that the use of the shooting range shall be undertaken at my, the student's, own risk and that I am eighteen(18) years of age or older. Or it is my responsibility as a parent or guardian of a registered minor Student (listed below) under the age of eighteen(18) shooting, observing, or using the range under my supervision. It is also my (student/parent/guardian) full responsibility to pay all expenses for the usage of the range and training expenses for the registered student listed below.

Student agrees to indemnify, hold harmless and defend Defense Training Solutions, LLC its affiliates including but not limited to FREEDOM FIREARM LLC, FREEDOM FIREARMS II LLC, FREEDOM FIREARMS III and each of their subsidiaries as well as the owners of any facility or property upon which any of the foregoing are operating and each of their respective officers, directors, owners (members), managers, employees, contractors, agents, successors and assigns (herein after referred to collectively or individually as “Instructor”), from any and all fault, liabilities, costs, expenses, claims, demands, or lawsuits arising out of, related to or connected with Student’s presence at and/or participation in the course of instruction; the use of instruction in the future; the discharge of firearms by the Student, Students’s presence on or use of the range, building, land, and premises (“Premises”); and, any and all acts or omissions of Student. 

Student hereby acknowledges he/she shall be liable for any claims, demands, injuries, actions or cause of actions whatsoever to any person, customer or property arising out of or connected with the use of any of the services and/or facilities. Further, Student hereby agrees to release instructor, and families from any injuries, damages or claims which any third party may have who is present or not on said premises at Instructor request or invitation or under my control. Student also agrees that in the event that Student becomes responsible for damage to property or injury to any person, Student will compensate for the damage/injury resulting from Students actions. Student declares that they are competent and/or authorized to make the determination to sign this agreement and it is my intention to use the range facilities safely and legally.

Student furthermore waives for himself/herself and for his/her executors, personal representatives, administrators, assignees, heirs and next of kin, any and all rights and claims for damages, losses, demands and any other actions or claims whatsoever, which he/she may have or which may arise against Instructor (including but not limited to the death of Student and/or any and all injuries, damages or illnesses suffered by Student or Student’s property), which may, in any way whatsoever, arise out of, be related to or be connected with: the course of instruction; the Premises, including any latent defect in the Premises; Student’s presence on or use of said Premises; Student’s property (whether or not entrusted to Instructor); and the use of ammunition and discharge of firearms. Instructor shall not be liable for, and Student, on behalf of himself/herself and on behalf of his/her executors, personal representatives, administrators, assignees, heirs, and next of kin, hereby expressly release the Instructor from any and all such claims and liabilities. 

Student hereby expressly assumes the risk of taking part in the course for instruction in firearms and taking part in the activities on the Premises, which include, but are not limited to, instruction in the use of firearms, the discharge of firearms and the firing of live ammunition. 

Student hereby acknowledges and agrees that Student has read this instrument and understands it terms and is executing this instrument voluntarily. Student furthermore hereby acknowledges and agrees that he/she has read, understands and will at all times abide by all range rules and procedures and any other rules and procedures stated by the Instructor. 

Student expressly agrees that this instrument is intended to be as broad and inclusive as permitted by law and that if any provision of this instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. No remedy conferred by any of the specific provisions of this instrument is intended to be exclusive of any other remedy, and each and every remedy shall be cumulative and shall be in addition to every other remedy now or hereafter existing at law or in equity or by statue or otherwise. The election of any one or more remedy hereunder by the Instructor shall not constitute any waiver of Instructor’s right to pursue other available remedies. This instrument binds Student and his/her executors, personal representatives, administrators, assignees, heirs and next of kin.

I also understand that making any false written statement, or misrepresented identification is reason for legal action, criminal charges and criminal convictions. Defense Training Solutions LLC and the shooting facility is not obligated or responsible for my manner present or future.  I hereby release and hold Defense Training Solutions LLC and the shooting facility harmless, I alone take full responsibility for my actions.

COMMITMENT TO PROTECT NON-PUBLIC INFORMATION AND STUDENT RIGHTS

STUDENT AGREEMENT

on April 27, 2024 Between Defense Training Solutions LLC (“DTS”) and the student listed below.

As a participant in this training, I understand I will be receiving non-public information of which DTS holds the copyright, patent or patent pending that may include but not limited to; textbooks, course outlines, lesson plans, content, exercises, qualifications, student profiles.

I agree that I shall not release, publish or disclose such information to unauthorized persons. I shall protect such information and will employ all reasonable efforts to maintain the confidentiality of such information.  

Duplication and/or distribution, in whole or part, of course materials, audio, video or photographs are strictly prohibited. Additionally, for the protection of the rights and privacy of our students; photographs, audio and video are prohibited without permission.

I shall use best efforts to protect and maintain the confidentiality of the information and materials, whether oral, written or in any form whatsoever and avoid unnecessary disclosure to anyone else.

I agree that I shall immediately notify Defense Training Solutions LLC of any suspected or confirmed unauthorized disclosure and/or misuse of sensitive information.

I understand that there are laws and regulations which provide for criminal and/or civil penalties for improper disclosure, including but not limited to:

 a) 18 U.S.C. 641 (Public Money, Property or Records)

 b) 18 U.S.C. 1832 (Trade Secrets)

 c) 18 U.S.C. 1905 (Disclosure of Confidential Information)

 d) 5 U.S.C. 552a (Privacy Act)

I have read and understand the requirements stated above and agree to adhere to them. I understand that violation of the agreement may subject me to criminal and civil penalties.

This Agreement is to be governed by and construed in accordance with the laws of the United States of America and the State of Pennsylvania. Neither Party shall be deemed to waive any of its rights, powers or remedies hereunder unless such waiver is in writing and signed.
