TERMS AND CONDITIONS OF CROSSFIT BATTERAOF VOF 1. APPLICABILITY - These terms apply to any agreement between CrossFit Batteraof and participants.
- They cover memberships, open gym access, drop-ins, and personal training.
- By signing up or participating, members accept these terms.
- CrossFit Batteraof may update these terms, with the most recent version always available online.
2. AGREEMENT / MEMBERSHIP - A membership begins upon mutual agreement and payment.
- Changes to memberships require written approval and may involve costs.
- Memberships are personal and non-transferable.
- Members can attend regular classes, specialty sessions, and open gym.
- Classes per month vary by membership type, and unused classes do not carry over automatically.
3. DURATION AND TERMINATION - Members commit to a minimum period of 6 months, after which memberships renew monthly.
- Termination requires written notice via email with one month's notice.
- Upgrades and downgrades must be requested a month before the membership’s end.
4. PAUSING / SUSPENSION AND FORCE MAJEURE - Memberships can be paused for up to 2 months with written notice. Extensions to contracts apply.
- Members relocating to a new city can terminate membership with official proof.
- CrossFit Batteraof reserves the right to suspend or terminate contracts due to force majeure events like natural disasters, pandemics, etc.
5. PRICES, PRICE CHANGES, AND PAYMENTS - Membership fees are agreed upon at sign-up, and CrossFit Batteraof may raise prices, with notice to members.
- Payments are auto-debited monthly, with a reminder if the payment fails.
- Unpaid fees will incur an administration charge.
6. CROSSFIT BATTERAOF OBLIGATIONS - CrossFit Batteraof ensures facility maintenance and adequate instruction from qualified trainers.
- First aid is always available.
- The facility is secured to prevent loss or damage to participants' property.
7. PARTICIPANT OBLIGATIONS - Participants must follow instructions from CrossFit Batteraof and trainers.
- Health conditions should be disclosed to CrossFit Batteraof.
- Participants cannot train under the influence of drugs or alcohol.
- Changes to personal details must be communicated to CrossFit Batteraof.
8. INTERIM CHANGES - CrossFit Batteraof may adjust facilities, schedules, and programs. These changes will be announced beforehand.
9. LIABILITY - Participation is at the participant’s own risk.
- CrossFit Batteraof is not liable for personal injury or damage during classes.
- Participants are responsible for assessing their ability to partake in classes.
10. IMAGES AND SOCIAL MEDIA - Photos and videos may be taken for marketing purposes during classes.
- By agreeing to these terms, members consent to their use unless otherwise requested.
11. COMPLAINTS AND DISPUTES - Complaints must be submitted in writing within 14 days of occurrence.
- CrossFit Batteraof will respond within 4 weeks.
12. APPLICABLE LAW - Dutch law governs these terms.
- Disputes will be resolved in Maastricht court.
13. REGISTRATION SYSTEM AND POLICY - Members must use the booking system to register for classes.
- Classes can be booked 4 weeks in advance.
- Cancellations must be made at least 2 hours prior to avoid forfeiting the class credit.
