I understand and agree as follows: All of the equipment and services related to mounting, repairing, renting or demoing (the "Products and Services") by The Bent Gate, Inc. ("BGM") or their agents, officers, employees or representatives (collectively, the "Personnel"), are provided on an "As Is" basis and BGM makes no representations and extends no warranties, guarantees or conditions of any kind, whether express or implied, with respect to the Products and Services.

Assumption of Risk: I am aware that using or receiving the Products and Services involves risks, dangers and hazards in addition to those normally associated with the backcountry, telemark, and alpine activities for which they are intended. These may include, but are not limited to: the failure of skis, bindings, avy gear or other equipment to perform in accordance with their specications or my expectations; increased risks arising from the design, construction or maintenance of the equipment provided by BGM or its Personnel; bindings that release, or do not release, in a manner that fails to prevent injury or death; failure by the Personnel to configure equipment in accordance with my intended or actual use or specific circumstances; my failure to use or receive the Products and Services safely, within my ability,or in a manner that fails to prevent injury or death due to lack of familiarity with the Products and Services, exposure to unfamiliar activities or circumstances, or otherwise; the negligence of other skiers or participants in such activities; and NEGLIGENCE ON THE PART OF BENT GATE MOUNTAINEERING OR ITS PERSONNEL, INCLUDING THE FAILURE OF BENT GATE MOUNTAINEERING OR ITS PERSONNEL TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE PRODUCTS AND SERVICES. I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE PRODUCTS AND SERVICES AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

Release of Liability, Waiver of Claims and Indemnity: I hereby agree 1: to waive any and all claims that I have or may have in the future against BGM, it's Personnel and their successors and assigns (the "Releasees") and to release the Releasees from any and all liability for any loss, damage, expense or property damage or personal injury including death that I may suffer or that my next of kin may suffer arising from using or receiving the Products and Services, DUE TO ANY CAUSE WHATSOEVER, including negligence, breach of contract, or breach of any statutory or other duty of care, on the part of the Releasees, and including the failure on the part of the Releasees to safeguard or protect me from the risks, dangers and hazards of using or receiving the products and services referred to above; 2: To Hold Harmless and Indemnify the Releasees from any and all liability for any loss, damage, expense or property damage or personal injury including death to any third party arising from using or receiving the Products and Services; 3: To not provide the Products and Services to any other person and indemnify the Releasees for all liability for any loss, damage, or expenses or injury including death arising in connection with a contravention by me of the foregoing; 4: To inspect all equipment before use, familiarize myself with its limitations and capabilities, and to not use and return immediately any equipment I believe to be damaged or defective; and 5: To accept full responsibility for the care of the equipment and be responsible for the replacement at full retail value of such equipment damaged or not returned.

Binding Effect: This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.

Exclusive Jurisdiction: This Agreement shall be governed by the laws of the state of Colorado and any litigation involving the parties to this Agreement shall be brought in the state of Colorado.

No Reliance: In entering into this Agreement, I am not relying on any oral or written reprensentations or statements made by the Releasees other than what is set forth in this Agreement.

Good Idea to Wear a Helmet: I acknowledge that BGM recommends that I wear a helmet when participating in snow sports activities. I also affirm that the decision as to whether to wear a helmet is mine and that I accept and assume all risk of not wearing a helmet.

I understand that my photo is being taken as part of my signature of this waiver and agree to have my photo stored with my signature.

I will only take out demo gear for 60 minutes (per setup)
