*BEACHING OF BIG ROCK RESORT BOATS IS STRICTLY PROHIBITED. I accept financial responsibility for the use of the boat/kayak/paddle board/watercraft and/or equipment provided and accept full responsibility for its care. I have made no misrepresentation to PETRABELLA, INC. /BIG ROCK RESORT regarding the age of the boat operator/driver or the intended use of the watercraft and equipment. I agree that no one under 18 shall operate/drive any motorized boat rented/used from PETRABELLA, INC. /BIG ROCK RESORT. I agree that no one under 21 shall operate/drive any Pontoon Boat rented/used from PETRABELLA, INC. /BIG ROCK RESORT. I agree that no child under the age of 14 shall operate a non-motorized watercraft rented/used from PETRABELLA, INC. /BIG ROCK RESORT without the physical supervision of an adult 18 years or older for any length of time.WATERCRAFT RENTAL DAMAGE WAIVER No one plans to have an accident. This program is intended to save our customers money in the event their rented watercraft is damaged or equipment goes missing.
$10 - All non motorized watercraft including kayaks and stand up paddle boards
$35 - All aluminum fishing boats
$50 - Pontoon Boats Will my auto or home owners policy cover me in the event of an accident or damage?
Most personal insurance companies exclude coverage for a “rental” boat. This includes most homeowners policies, personal auto policies, etc.
Do I really need a damage waiver?
This program buys our customers a bit of leniency with those little scuffs and scratches and also reduces the liability exposure for a majority of other issues our customers face. Most of our customers return our rental equipment in great shape, but accidents sometimes occur. Because of this, we have introduced this program at the request of our customers to offer peace of mind while on the water. Although you may take care of the equipment, in some instances the damage is not always your fault. Another example would be hitting a submerged rock, log or stump; which, can be a very costly repair.

Ripped canopy covers $500 The Damage Waiver Fee is a nonrefundable Fee that relieves Guests of the cost for unintentional and accidental damage to the Rental Property and its contents, not to exceed the amount of coverage (up to $500.00 of unintentional damage). Repairs or replacements over $500 will be charged to the card on file. What the Waiver Covers: - Property damage to the renter’s contracted boat only, caused by accidental collision while under power.
- Property damage to the renter’s contracted boat only, caused by accidental collision with another boat while under power.
What the Waiver Does Not Cover: - Boating under the influence of alcohol or drugs.
- Dents, scratches or other damage caused by tying boats together or towing other boats.
- Damage caused by usage/allowance of prohibited items such as grills, lanterns, or other combustible items.
- Damage caused by negligence or failure to operate the boat in careful or prudent manner.
- Beaching of motorized boats.
- Does not cover any type of liability coverage, only property damage to rented craft during designated rental period.
- Does not cover damage caused by towing and/or launching a watercraft.
- The waiver applies to the renter’s contracted boat only and does not offer coverage of any other boat or property.
- This waiver covers damage sustained only during the contracted rental times.
- The waiver does not provide any coverage other than that which is specifically stated above.
This damage waiver is optional and can be accepted or declined by the renter. If accepted the cost of this damage waiver starts at $10 and must be paid before the rental begins. I have made the best decsion for myself and my family by either declining or accepting the insurance waiver offered by Big Rock Resort. If I declined the rental damage waiver offered at checkout then I agree to pay Big Rock Resort for all damages incurred to my rental watercraft through duration of my rental. if I accepted and paid for the insurance waiver offered by Big Rock Resort, I understand that damages are limited to $500. I authorize Big Rock Resort to charge my credit card on file for all damages not covered by the insurance waiver and/or overages and/or charge for all damages if I elected not to purchase a damage waiver that incurred during my rental.Please email info@bigrockresort.net if you would like to add a damage waiver to your reservation. I will not allow more guests onto the watercraft that I have rented than the maximum listed below. I understand that children do count towards the maximum guest count allowed. 1 Man Kayak - 1 Guest Release of Liability Agreement and Legal Waiver (Please read carefully before signing -- this is a release of liability and waiver of certain legal rights) In consideration for me being permitted to participate in the activities of boating/fishing at Big Rock Resort, I represent that I have read, understand, and agree to the following Waiver and Release: I acknowledge/understand that fishing/boating has inherent risks, hazards, and dangers that cannot be eliminated, particularly in a wilderness environment. I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION: - Water hazards in boating/wading/swimming in a lake can result in drowning;
- Trip hazards in Hiking/Walking/Running in rugged terrain;
- Walking/Running hazards on Dock System including but not limited to trip and fall, injury and drowning;
- Injuries from fishing equipment and other participants;
- Encounters and/or injury with wildlife, animals, and insects;
- Inclement weather conditions including temperature extremes including freezing temperatures and extreme sunburn due to high altitude sun exposure;
- Unavailability of immediate medical attention in a remote location in the case of injury.
I understand the risks, hazards, and dangers of fishing/boating and I have had the opportunity to discuss the risks/hazards/dangers with PETRABELLA, INC. /BIG ROCK RESORT. I understand that these activities may require good physical conditioning and a degree of skill and knowledge. I believe I have good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely. I understand that I have personal responsibilities. My participation in this activity is purely voluntary. No one is forcing me to participate and I elect to participate in spite of the risks. I AM VOLUNTARLLY USING THE SERVICES OF PETRABELLA, INC. / BIG ROCK RESORT with FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS AND DANGERS INVOLVED AND HERBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, DROWNING, PARALYSIS OR DEATH. In addition, I, for myself, my heirs, successors, executors and subrogees hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., their directors, officers, agents, employees, contractors and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, NEGLIGENCE of any kind or nature, including BOTH ACTIVE AND PASSIVE NEGLIGENCE OF PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, drowning or death to me or my property as a result of my engaging in these activities or the use of these services or equipment, or from some other cause. Further, I, for myself, my heirs, successors, executors and subrogees, hereby KNOWINGLY AND EXPRESSLY AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., their directors, officers, agents, employees, contractors and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, NEGLIGENCE of any kind or nature, including BOTH ACTIVE AND PASSIVE NEGLIGENCE OF PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, drowning or death to me or my property as a result of my engaging in these activities or the use of these services or equipment, or from some other cause. I HAVE CARFULLY READ, CLEARLY UNDERTAND, AND VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGREEMENT.
