GENERAL RELEASE AND WAIVER FOR PRODUCTS AND SERVICES PROVIDED BY BOOSTKING TUNING, LLC

DISCLAIMER OF WARRANTIES FOR PRODUCTS & SERVICES and EMISSIONS STATEMENT Vehicles modified by competition parts and calibrations may not meet legal requirements for use on public roads. It is your responsibility to comply with Federal, state and local laws prior to and after the installation. The use or installation of competition products may affect your vehicle warranty coverage. It is the sole responsibility of the Purchaser or End User to comply with laws pertaining to use of competition products or services on public roads.

BoostKing Tuning, LLC (hereafter referred to collectively and individually as “BoostKing Tuning”) assumes no legal responsibilities and/or liabilities, whether to your vehicle and its components, any person(s), and/or property(s), that may result from the use or servicing of a motor vehicle on which our products or services have been installed; or to any other vehicle(s), person(s) or property regardless of whether or not this/these products has any involvement directly or indirectly and/or liability as to whether or not this product has been properly installed. This legal disclaimer is acknowledged by the Purchaser or End User, person(s), user(s), and/or driver(s) who installs, drives and/or uses this product. This Release applies not only to the original Purchaser or End user but to all products or services that are subsequently re-purchased, given and/or any other means conveyed to another user. It is the responsibility of the Purchaser or End User to communicate the terms and conditions of this Release and Disclaimer to any future End User.

Installation of this product will serve as acknowledgement and agreement to the terms of this Release by the Purchaser or End User and their agreement to the terms of the product and services disclaimers stated herein.

Accidents and failures can occur at any time. Be aware that use of these parts and services and participation in motorsports activities carry significant risks and the Purchaser or End User assumes all risks. Do not violate any traffic laws in the process of testing any parts or services provided by “BoostKing Tuning”.

All “BoostKing Tuning” services, parts or any other items sold through the boostkingtuning.com website or via any other means of purchase are sold "AS IS" without any warranty whatsoever except those explicitly stated by the manufacturer and its own product warranties. No claim is made as to the merchantability or fitness for a specific purpose. The entire risk as to the quality and performance of such parts is with the Purchaser or End User. Examine your parts carefully upon receipt. If there is a manufacturing defect, it will be addressed directly with the manufacturer and not “BoostKing Tuning”. Such parts shall be returned unused and uninstalled. Should such parts prove defective following their installation, the Purchaser or End User and not the manufacturer, distributor or retailer, assumes the entire cost of all necessary servicing or repair. Any opened box items returned to BoostKing Tuning for any reason are subject to a 25% restocking fee. Direct or indirect fees charged for custom tuning services are not refundable for any reason.

Federal laws and regulations may prohibit removal or modification of components installed at the time of manufacture that are designed to meet emissions requirements or to comply with motor vehicle safety regulations applicable to vehicles manufactured for use on public roads. “BoostKing Tuning” recommends that vehicles modified using aftermarket parts or services not be operated on public roads and offers such parts only for track, off-highway competitive or performance use on vehicles that have never been eligible for registration on a public road or highway. “BoostKing Tuning” hereby states that its aftermarket parts offered, installations, as well as custom tuning services are intended for off-highway applications only. Installation on a vehicle intended for use on public roads may violate Federal, state or municipal laws and regulations including those relating to emission requirements and motor vehicle safety standards. Other local, state, provincial, territorial, or international laws may apply to the use of these parts. Please check your local laws before purchasing or using these parts. BoostKing Tuning, LLC will not remove, bypass nor render inoperable any Federally mandated emissions controls, monitors or sensors for any reason.

Purchaser or End User acknowledges that all products and services supplied by “BoostKing Tuning” may increase the performance of vehicle beyond the intended design limits. Purchaser or End User accepts full responsibility for any damage or injury to themselves or others or their respective properties through the use of these products or services.

Purchaser or End User agrees to forever hold harmless “BoostKing Tuning”, and its owners, partners, agents, employees, assigns, dealers and distributors and indemnify them against any and all claims, demands, losses, damages, suits, actions, judgements, penalties or liabilities of any kind or nature arising from the direct or indirect purchase or use of any services or products offered by “BoostKing Tuning”.

By the signature, below, the Purchaser or End User attests and affirms that they understand that no products nor services from “BoostKing Tuning” are certified for use in the State of California or other states that may adopt or adhere to the laws and regulations of the State of California and its CARB certification program. In addition, you certify that your vehicle is in excellent operating condition and is acceptable for the use of any products or services provided by “BoostKing Tuning”.
