Cabin Rental Agreement

Cabin #1-Maximum 8 Guests, Cabin #3- Maximum 4 Guests, Cabin #4- #9 Maximum 6 Guests

Due to the outbreak of the novel Coronavirus (COVID-19), PETRABELLA, INC. /BIG ROCK RESORT is doing everything we can to protect you, our guests, our community and our staff.  To this extent, PETRABELLA, INC. /BIG ROCK RESORT will be following the Center of Disease-Control (CDC), the California Department of Health and Mono County Health Department for guidance with regard to social distancing practices and sanitation.

Symptoms of COVID-19 include:

  • Fever
  • Fatigue
  • Dry Cough
  • Difficulty Breathing

 


 I attest and agree to the following conditions:

  1. I, and/or members of my household have NOT experienced the symptoms above in the past 14 days;
  2. I, and/or members of my household have NOT travelled internationally in the past 30 days;
  3. I, and/or members of my household have NOT traveled to a highly COVID-19 impacted area within the USA in the past 30 days;
  4. I, and/or members of my household do NOT believe that we have been exposed to someone with a confirmed or suspected case of COVID-19; AND
  5. I, and/or members of my household have NOT been diagnosed with COVID-19 in the past 45 days

PETRABELLA, INC. /BIG ROCK RESORT will not be liable from any exposure to the Coronavirus (COVID-19) caused by misinformation on this form or the health history provided by each guest.

PETRABELLA, INC. /BIG ROCK RESORT POLICIES

  1. We DO NOT allow a 1 day gap between reservations.  We reserve the right to contact you to make an adjustment to your dates to accommodate this policy.
  2. CANCELLATION POLICY – Thirty (30) days for One (1) Cabin/ Sixty (60) days for Two (2) or more Cabins.  Please be advised that a reservation for Two (2) or more Cabins is considered a “group reservation” and requires a Sixty (60) day cancellation notice.
  3. 50% deposit is due upon booking reservation for each cabin reserved.
  4. A $12 per night Resort Fee will be added to each room night.
  5. 12% Mono County Bed Tax will be added to all reservations.
  6. Payment IN FULL is due Thirty (30) days for One (1) Cabin and Sixty (60) days for Two (2) or more Cabin or Group Reservations as outlined above.  Please be advised that your Credit Card on file will be charged automatically before your arrival based on the details of your reservation.  Specifically, your Credit Card will be charged Thirty (30) days before arrival for a One (1) Cabin reservation and Sixty (60) days before arrival for a Two (2) or more Cabin or Group Reservation as outlined above.
  7. A Fifty Dollar ($50.00) Cancellation Fee applies if you cancel your reservation outside of the Thirty (30) days for a One (1) Cabin reservation, or the Sixty (60) days for a Two (2) or more Cabin or Group Reservation as outlined above.
  8. Your deposit is NON REFUNDABLE if the cancellation happens Twenty-Nine (29) days or less before arrival for a One (1) Cabin reservation, or Fifty-Nine (59) days or less before arrival for a Two (2) or more Cabin or Group Reservation as outlined above.
  9. PET POLICY -- Dogs are only allowed in CABINS 6 & 7 – ONLY ONE DOG IS ALLOWED PER CABIN.  The Dog Fee is Twenty-Seven Dollars ($27.00) per night plus applicable taxes.  We apologize but cats are NOT permitted.  If you are in cabins 1, 3, 4, 5, 8 or 9 and you arrive with a dog you will be required to find boarding for your dog or give up your reservation and any and all deposits and payments WILL BE FORFEITED.  NO pets may be kept in vehicles or tied up on the porch -- NO EXCEPTIONS.
  10. ALL CABINS ARE NON SMOKING.
  11. Management reserves the right to refuse service to anyone.

    I will not allow more guests to sleep/stay/use the cabin that I have rented than the maximum listed here. Cabin #1-Maximum 8 Guests, Cabin #3- Maximum 4 Guests, Cabin #4- #9 Maximum 6 Guests. I understand that children (even babies) do count towards the maximum guest count allowed. I agree to pay $60 per day plus applicable taxes for guests over the maximum listed.

Release of Liability Agreement and Legal Waiver
(Please read carefully before signing -- this is a release of liability and waiver of certain legal rights)

In consideration for me being permitted to participate in activities at Big Rock Resort, including lodging, I represent that I have read, understand, and agree to the following Waiver and Release.  I expressly acknowledge/understand that recreating in a mountain town at high altitude has inherent risks, hazards, and dangers that cannot be eliminated, particularly in a wilderness environment.  I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION:

  1. Water hazards in boating/wading/swimming in a lake can result in drowning
  2. Trip hazards in Hiking/Walking/Running in rugged terrain
  3. Walking/Running hazards on Dock System including but not limited to trip and fall, injury and drowning
  4. Injuries from fishing equipment and other participants
  5. Encounters and/or injury with wildlife, animals, and insects
  6. Inclement weather conditions including temperature extremes including freezing temperatures and extreme sunburn due to high altitude sun exposure.
  7. Unavailability of immediate medical attention in a remote location in the case of injury.

I understand the risks, hazards, and dangers of using the property and amenities available at PETRABELLA, INC. /BIG ROCK RESORT and I have had the opportunity to discuss the risks/hazards/dangers with PETRABELLA, INC. /BIG ROCK RESORT.  I understand that these activities may require good physical conditioning and a degree of skill and knowledge.  I believe I have good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely.  I understand that I have personal responsibilities.  My participation in staying at PETRABELLA, INC. /BIG ROCK RESORT is purely voluntary; no one is forcing me to participate or stay at PETRABELLA, INC. /BIG ROCK RESORT and I elect to participate and stay in spite of the risks.  I AM VOLUNTARLLY USING THE SERVICES OF PETRABELLA, INC. / BIG ROCK RESORT with FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS AND DANGERS INVOLVED AND HERBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, DROWNING, PARALYSIS OR DEATH.

In addition, I, for myself, my heirs, successors, executors and subrogees hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., their directors, officers, agents, employees, contractors and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) which are related to, arise out of, or are in any way connected with my stay at BIG ROCK RESORT PROPERTY, including, but not limited to, NEGLIGENCE of any kind or nature, including BOTH ACTIVE AND PASSIVE NEGLIGENCE OF PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, drowning or death to me or my property as a result of my engaging in BOATING/FISHING/SWIMMING/USING BIG ROCK RESORT PROPERTY, if any, and the facilities of PETRABELLA , INC. / BIG ROCK RESORT, or from some other cause.

Further, I, for myself, my heirs, successors, executors and subrogees, hereby KNOWINGLY AND EXPRESSLY AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., their directors, officers, agents, employees, contractors and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) which are related to, arise out of, or are in any way connected with my stay at BIG ROCK RESORT PROPERTY, including, but not limited to, NEGLIGENCE of any kind or nature, including BOTH ACTIVE AND PASSIVE NEGLIGENCE OF PETRABELLA, INC / BIG ROCK RESORT and the USDA-FS., whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, drowning or death to me or my property as a result of my engaging in BOATING/FISHING/SWIMMING/USING BIG ROCK RESORT PROPERTY, if any, and the facilities of PETRABELLA , INC. / BIG ROCK RESORT, or from some other cause.

Lastly, I, for myself, my heirs, my successors, executors, and subrogees, expressly agree not to sue PETRABELLA, INC. / BIG ROCK RESORT and USDA-FS as a result of any loss, injury, paralysis, drowning or death suffered in connection with my use and participation in the activities of BOATING/FISHING/SWIMMING/USING BIG ROCK RESORT PROPERTY.

I HAVE CARFULLY READ, CLEARLY UNDERTAND, AND VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGREEMENT.

Lastly, the undersigned parent, guardian, or custodian of the above minor(s), for himself/herself and on behalf of said minor(s), hereby JOINS IN THE FOREGOING RELEASE OF LIABILITY AGREEMENT AND LEGAL WAIVER and herby stipulates and agrees to not sue PETRABELLA, INC. / BIG ROCK RESORT and USDA-FS as a result of any loss, injury, paralysis, drowning or death suffered in connection with my use and participation in the activities of BOATING/FISHING/SWIMMING/USING BIG ROCK RESORT PROPERTY. I CAREFULLY READ, CLEARLY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGGREEMENT.
