California Gold Basketbal Club - Release of Liability Waiver

Release of Liability and Permissions:  As lawful consideration for the participant / player identified and being permitted to participate in the California Gold Basketball Club program, I agree that neither the player, nor I, will make a claim against, sue, attach the property of or prosecute the California Gold Basketball Club including its owners, agents and employees, for damages for death, personal injury or property damage which the player may sustain as a result of participation in the California Gold Basketball Club program.  This release is intended to discharge in advance, the California Gold Basketball Club, owners, agents and employees from and against any and all liability, including for its negligent actions, arising out of or connected in any way with the players participation in the California Gold Basketball Club program. I release California Gold Basketball Club, its officers, employees and agents from any liability resulting from any lack of supervision of my children / player at the close of any activity.

Health Certifications and Medical Treatment:  As the participant, parent(s) or legal guardians(s) of the player identified, I certify that the player is in good health, has no phsyical or other impairment which would endanger named player when participating in ANY activities to include practices, open-runs or tournaments with California Gold Basketball Club.  I certify that named player has not had any direct contact with anyone diagnosed with the Corona Virus/Covid-19. If named player comes into contact with anyone I will immediately notify anyone I have come in contact with, including California Gold Basketball Club staff.  I understand it is the parents/players responsibility to ensure we do not attend any activities for California Gold Basketball Club if experiencing any cold, flu or covid like symptoms.  I give permission for staff to seek any necessary emergency medical treatment. I further understand and acknowledge that basketball involves physical contact between players, that serious accidents occasionally occur, and that participants occasionally sustain serious personal injuries as a consequence thereof. Understanding the risks of participation, nevertheless, I hereby agree that the player and I assume those risks and I release and hold harmless California Gold Basketball Club, including its owners, agents, and employees, who (through negligence or carelessness) might otherwise be liable to me, the player (or our heirs or assigns) for damages.

Photo and Social Media:  ~~California Gold Basketball Club utilizes web and print items to promote the club and recognize accomplishments. As the participant, parent(s) or legal guardians(s) of the player identified, I give permission for photos and video to be utilized.  I authorize California Gold Basketball Club, the AAU, Jump Beyond and all tournament organizers to retain the right to use the publicity and advertising of all photographs and video taken of the player.

Code of Conduct:  All particpants / players in any activity related to California Gold Basketball Club are expected to conduct themselves in a manner befitting the club.  Players and parents / guardians MUST be respectful to all coaches, players staff, officials, opponets, etc.  Participants / players are expected to treat all facilities with care and follow all faciility rules.  Our club reserves the right to ask any individual to leave any event, if deemed necessary.  In addition, all parents, guardians or family representatvies must wait 24 HOURS from the end of a tournament or shootout to approach the coach about concerns.

COVID 19 Participation Waiver: The novel coronavirus, Covid-19, has been declared a worldwide pandemic by the World Health Organization. Covid-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. California Gold Basketball Club (AKA, The Club) has put in place preventive measures to reduce the spread of Covid-19; however, The Club cannot guarantee that you or your son will not become infected with Covid-19. Further, attending The Club programming could increase your risk and your son's risk of contracting Covid-19. By signing this agreement, I (We) acknowledge the contagious nature of Covid-19 and voluntarily assume the risk that my son and I (We) may be exposed to or infected by Covid-19 by attending any Club programming and that such exposure or infection may result in personal illness, permanent disability, and death. I (We) understand that the risk of becoming exposed to or infected by Covid-19 at The Club provided facilities may result from the actions, omissions, or negligence of myself and others, including, but not limited to, club employees, volunteers, and program participants and their families. I (We) voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any illness to my son or myself (OURSELVES), including, but not limited to (disability and death), damage, loss, claim, liability, or expense, of any kind, that I (We) or my son may experience or incur in connection with my (Our) son's attendance at The Club provided facilities or participation in Club programming ("Claims"). On my (Our) behalf, and on behalf of my son, I (We) hereby release, covenant not to sue, discharge, and hold harmless The Club, its employees, governing board, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I (We) understand and agree that this release includes any claims based on actions, omissions, or negligence of The Club, its employees, agents, and representatives, whether a Covid-19 infection occurs before, during, or after participation in any Club program at a Club provided facility.
