The undersigned, does hereby agree that I am, or my child/ward is, an equine activity participant. An equine activity participant is subject to the inherent risks of equine activity as defined in Ohio Revised Code 2305.321 including, but not limited to, any or all of the following: (a) The propensity of an equine to behave in ways that may result in injury, death or loss to persons or property including the unpredictability of an equine's reaction to sounds, movements, objects, persons or other animals, which proximately causes harm to the equine activity participant. (b) An equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person who provides faulty or defective equipment or tack and knows or should know that the equipment or tack is faulty or defective, and the fault or defect in the equipment or tack proximately causes harm to the equine activity participant. (c) An equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person provides an equine to an equine activity participant, and fails to make reasonable and prudent efforts to determine his or her ability to safely engage in the equine activity or to safely manage the equine based on the participant's ability; the equine activity participant fails to safely engage in the equine activity or to safely manage the equine; and that failure proximately causes harm to the equine activity participant. (d) Harm is proximately caused to the equine activity participant by a dangerous latent condition of the land on which, or the premises at which, the harm occurs, and an equine activity sponsor, other equine activity participant, equine professional, veterinarian, farrier, or other person owns, leases, rents, or otherwise lawfully possesses and controls the land or premises and knows or should know of the dangerous latent condition, but does not post conspicuously prior to the time of the harm involved one or more signs that warn of the dangerous latent condition. (e) An act or omission of an equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person which constitutes a willful or wanton disregard for the safety of the equine activity participant, and proximately causes harm to the equine activity participant. (f) An equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person intentionally causes harm to the equine activity participant. By signing this Waiver, I acknowledge that the equine activity participant who is subject of this Waiver, as well as his or her parents, guardian, custodian or other legal representatives, does not have a claim or cause of action on which a recovery of damages may be based against, and may not recover damages in court or other civil action against, any equine activity sponsors, other equine activity participants, equine professionals, veterinarians, farriers, or other persons associated with this equine activity, including, but not limited to, Cape Cod Equestrian Center, LLC, its members, representatives, officers, directors, volunteers, successors and assigns. I voluntary agree to assume the full risk of any and all injuries, damages, or loss, regardless of severity, that I or my minor child/ward may sustain as a result of participating in this equine activity. I waive and relinquish all claims I and my minor child/ward may have, or which may accrue, as a result of participating in any equine activity, against Cape Cod Equestrian Center, LLC, its members, representatives, officers, directors, volunteers, successors and assigns. I hereby fully release and agree to hold harmless, indemnify and defend Cape Cod Equestrian Center, LLC, its members, representatives, officers, directors, volunteers, successors and assigns from any and all claims or liabilities of any kind whatsoever arising out of my participation, or my child/ward's participation, in this equine activity. I am fully authorized to execute this Waiver on behalf of myself and my child/ward, my, his or her estate and all other persons who may be entitled to claim damages as a result of any harm, loss, injury or death. This document shall be governed by the laws of the State of Ohio. CCEC Policies - Please Read Carefully CCEC's Programs utilize light breed horses for riding. The maximum weight capacity for our horses is 200 pounds. I understand this policy is in place for the safety of the participant, as well as the safety of the animals involved and is in no way discriminatory. I certify that the participant is within these guidelines and has no known medical conditions that would interfere with their ability to safely mount, ride, and dismount independently. I Agree Required Attire: Long pants (Jodhpurs, Leggings, Jeans) and flat, hard-soled, closed-toed shoes with a 1 inch or less heel are required while riding, grooming, or handling the horses. Paddock Boots are recommended. Sneakers, athletic shoes, crocs, rain boots, Ugg's, cowboy boots, sandals, et cetera are not acceptable for English riding or handling of horses and will not be permitted. Properly fitted ASTM/SEI certified riding helmets are required while mounted. It is required that each participant provide their own properly fitted ASTM/SEI certified riding helmet. Required items are available for purchase on site, as well as linked on our website for online purchase at www.capecodfarm.com/helpful-links. Participants who do not follow attire requirements will not be permitted to ride. I Agree Lunch: Please provide a Lunch (Except during Training Days/Girl Scout Troop programs) and refillable water bottle daily for your child. When packing lunch, please avoid products that contain Tree Nuts. I Agree Cancellations/Payments: A $50 non-refundable deposit is required to secure your spot in each of our programs (Except Training Days/Girl Scout Troop programs/One Day Programs) and is deducted from the total price of the session. For Multi-Day programs, the cancellation of a single day is not subject to refund or transfer of funds to another service. For One Day Experiences and Barn Days, the balance paid (excluding the required $50 deposit) can be transferred to another service if notice of cancellation is given at least 24 hours in advance. Payment in full is required on the first day at the beginning of the session. Training Days/One Day Programs do not require deposit and can be paid in full on or before the date of the event. A 3% fee is applied to all payments made by credit card. No Refunds. I Agree Rescheduling: In the event of Illness or Injury prior to your scheduled session, registration can be transferred to another session of equal or lesser value. Registrations cannot be transferred once the program is in session. Transfer of registration is dependent upon availability.I Agree Additional Information: - Please apply Sun Protection to your child prior to their arrival at CCEC for all Summer programs. Please pack additional Sun Protection in your child's bag for re-application by the child.

- Multi Day Horsemanship Programs: Fridays are Family and Friend Showcase and Water Day! A Counselor will inform you with an estimated Friday ride-time for your child to the provided email on Thursday, and family members and friends are welcome to join us for Friday rides to see what we have been learning. Friday will also include water activities (Weather permitting). Please send your child with water clothes, shoes, and a towel.

- Please pack your child with extra socks,and be sure your child is wearing tall socks with boots to help prevent blisters.
- All programs are drop off/pick up ONLY unless otherwise specified. an email will be sent prior to your session with additional drop off and pick up information, so please be sure to provide us with a valid email address.
- CCEC is home to many animals - Please do NOT approach or pet any animals.
- Bullying or disrespectful behavior will not be tolerated. Disruptive behavior towards counselors, junior staff, or other participants could result in removal from certain activities or dismissal from the remainder of the session. We understand that each child is an individual, and our Counselors and staff are always happy to work with our participants in any way that we can. If your child responds best to specific conversational or disciplinary actions, or is triggered by certain actions or words, please be sure to discuss this with our staff prior to your session, or note in this form. We want everyone to have positive experiences!

PHOTO RELEASE I hereby grant and authorize Cape Cod Equestrian Center, LLC to the right to use photographs and/or video of me and/or my minor child taken to be used in and/or for promotional materials without payment or consideration.
