The undersigned, does hereby agree that I am, or my child/ward is, an equine activity participant. An equine activity participant is subject to the inherent risks of equine activity as defined in Ohio Revised Code 2305.321 including, but not limited to, any or all of the following:

(a) The propensity of an equine to behave in ways that may result in injury, death or loss to persons or property including the unpredictability of an equine's reaction to sounds, movements, objects, persons or other animals, which proximately causes harm to the equine activity participant.

(b) An equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person who provides faulty or defective equipment or tack and knows or should know that the equipment or tack is faulty or defective, and the fault or defect in the equipment or tack proximately causes harm to the equine activity participant.

(c) An equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person provides an equine to an equine activity participant, and fails to make reasonable and prudent efforts to determine his or her ability to safely engage in the equine activity or to safely manage the equine based on the participant's ability; the equine activity participant fails to safely engage in the equine activity or to safely manage the equine; and that failure proximately causes harm to the equine activity participant.

(d) Harm is proximately caused to the equine activity participant by a dangerous latent condition of the land on which, or the premises at which, the harm occurs, and an equine activity sponsor, other equine activity participant, equine professional, veterinarian, farrier, or other person owns, leases, rents, or otherwise lawfully possesses and controls the land or premises and knows or should know of the dangerous latent condition, but does not post conspicuously prior to the time of the harm involved one or more signs that warn of the dangerous latent condition.

(e) An act or omission of an equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person which constitutes a willful or wanton disregard for the safety of the equine activity participant, and proximately causes harm to the equine activity participant.

(f) An equine activity sponsor, equine activity participant, equine professional, veterinarian, farrier, or other person intentionally causes harm to the equine activity participant.

By signing this Waiver, I acknowledge that the equine activity participant who is subject of this Waiver, as well as his or her parents, guardian, custodian or other legal representatives, does not have a claim or cause of action on which a recovery of damages may be based against, and may not recover damages in court or other civil action against, any equine activity sponsors, other equine activity participants, equine professionals, veterinarians, farriers, or other persons associated with this equine activity, including, but not limited to, Cape Cod Equestrian Center, LLC, its members, representatives, officers, directors, volunteers, successors and assigns.

I voluntary agree to assume the full risk of any and all injuries, damages, or loss, regardless of severity, that I or my minor child/ward may sustain as a result of participating in this equine activity. I waive and relinquish all claims I and my minor child/ward may have, or which may accrue, as a result of participating in any equine activity, against Cape Cod Equestrian Center, LLC, its members, representatives, officers, directors, volunteers, successors and assigns. I hereby fully release and agree to hold harmless, indemnify and defend Cape Cod Equestrian Center, LLC, its members, representatives, officers, directors, volunteers, successors and assigns from any and all claims or liabilities of any kind whatsoever arising out of my participation, or my child/ward's participation, in this equine activity.

I am fully authorized to execute this Waiver on behalf of myself and my child/ward, my, his or her estate and all other persons who may be entitled to claim damages as a result of any harm, loss, injury or death.  This document shall be governed by the laws of the State of Ohio.

CCEC Policies

I Understand that all lessons and tours are scheduled by appointment ONLY. Walk-Ins are not accepted. Completion of this form does not secure an appointment time. Appointments must be scheduled directly with CCEC staff via phone, text, or E-mail.

I Agree

CCEC's Riding Academy utilizes light breed horses for riding. The maximum weight capacity for our horses is 200 pounds. I understand this policy is in place for the safety of the participant, as well as the safety of the animals involved and is in no way discriminatory. I certify that I am within these guidelines and have no known medical conditions that would interfere with my ability to safely mount, ride, and dismount independently.

Attire: Long pants and hard, flat soled, closed toed shoes with a 1 inch or less heel is required for riding or handling horses year-round. Rain boots, western style boots, crocks, Uggs, athletic shoes, sandals etc. are not acceptable for horseback riding. Students enrolled on a reoccurring basis are to provide their own ASTM/SEI Certified Riding Helmet, Paddock Boots, and Riding Gloves. All necessary equipment is available for purchase on site, as well as linked on our website for online purchase at www.capecodfarm.com/helpful-links.

Cancellations: All scheduled riding lessons must be cancelled prior to 24 hours to the scheduled appointment. Lessons not cancelled prior to 24 hours before the scheduled appointment will be subject to charge.  We understand that unforeseen circumstances such as illness, mechanical issues, and family emergencies do occur, and will be taken into consideration if lessons must be cancelled within 24 hours, but please let us know as soon as possible. If you fail to attend your scheduled lesson without any notice to CCEC staff, you will be charged for the lesson.

Rescheduling: Lessons that are cancelled within our Cancellation Policy guidelines (24 hours) may be rescheduled dependent upon availability with our riding instructors.

Tardiness:  All lessons begin at the scheduled time. If you are late to your lesson, the time will be deducted from the total time of the lesson. Keep in mind when working with horses, lessons may not always run exactly as scheduled. Please plan for 15 minute leeway at the beginning and end of the lesson. If CCEC is running more than 20 minutes behind schedule, we will attempt to contact you by phone or text as quickly as possible to inform you, and the total time if your lesson will not be affected. If CCEC is running more than 20 minutes behind schedule and you are unable to attend your lesson because of this, you may reschedule without penalty.

Weather: CCEC retains the right to cancel lessons at any time due to weather if we feel it is unsafe for our horses and riders or may be unsafe to travel. If there is inclement weather, we will contact you at least 1 hour prior to your scheduled lesson to inform you of cancellation. 

General Guidelines for Weather Cancellations

Summer: Above 95° and/or extreme humidity or Thunder and Lightening audible/visible from the stables

Winter: Below 20° and/or snow/ice on roads create unsafe travel

Wind: Strong winds that create an unsafe environment for riding

Payment: All Lessons must be pre-paid. If payment has not been received by the time of your scheduled lesson, a 5% late fee per lesson will be charged. All past due balances must be paid prior to your next scheduled lesson, or your time may be forfeited. Lesson package discounts are only available for pre-paid lessons scheduled on a weekly basis. Lesson packages cannot be applied to past-due lessons. Lesson packages must be used within 30 days of purchase, unless lessons are cancelled within our policy guidelines. Single lessons, Every Other Week lessons, and Tiny Tot lessons are not subject to discount.

Methods of payment: Cash, check made payable to Cape Cod Equestrian Center, and ACH payment. Individual lessons and lesson packages maybe be purchased by credit card through our online store at www.capecodfarm.com. A 3% fee is included in all payments made by credit card.

I understand that all payments are final. CCEC will not issue refunds. 

PHOTO RELEASE 

I hereby grant and authorize Cape Cod Equestrian Center, LLC to the right to use photographs and/or video of me and/or my minor child taken to be used in and/or for promotional materials without payment or consideration. This grant of use includes but is not limited to publishing on Internet and e-mails, magazines, phamplets, advertisement fliers, and in whatever other manner Cape Cod Equestrian Center, LLC finds useful or for any other lawful purpose.

CCEC Safety Rules

• Do not approach or pet any animals residing at CCEC.

• Please use caution while entering/exiting CCEC and drive slowly (5 MPH). No cars are permitted beyond the barn and arena. 

• No running.

• No yelling or screaming.

• Do not open any horse’s stall door or enter any stall unless accompanied by CCEC representative.

• Look both ways before entering the arena - horses have the right-of-way.

• Do not approach horses from behind.

• Do not feed the horses or any other animals residing at CCEC without permission from a CCEC representative. All treats must be approved by CCEC. No hand feeding.

• Do not approach/mount/ride the horses unless accompanied by a CCEC representative.

• Proper attire (Boots and Long Pants) required for riding and handling horses.

• ASTM/SEI Certified Riding Helmets are required while mounted if under 18 years of age, or a signed protective headgear refusal agreement is on file.

• Children must be accompanied at all times outside of the duration of your scheduled lesson time/grooming time by a parent or responsible adult who can control the child. Parents/guardians/responsible adults are responsible for the child/children in their care and should ensure that all children in their care observe and follow CCEC’s safety rules.  

• No spooking/scaring the horses.

• Do not put your hands, or allow children to put hands, inside the stalls with the horses.

• No Alcohol.

• No Smoking inside of the barn.

• Parents/Guardians/Siblings and any other observers must remain in the designated viewing areas. 

• Please observe and respect all posted signage 

• A signed waiver of Equine Activity Liability must be signed filed for all in attendance at CCEC prior to your arrival.

• Cape Cod Equestrian Center is not responsible for accidents/injury.

• CCEC reserves the right to refuse service.
