Release of Liability, Waiver, and Assumption of Risk

WARNING: BY SIGNING THIS WAIVER, YOU ARE WAIVING CERTAIN LEGAL RIGHTS. PLEASE READ THE BELOW CAREFULLY.

I, the undersigned, desire to participate in the attractions at CHOPPIN CO., including recreational ax-throwing (the "Activity").

In consideration for being allowed to participate in the Activity on the date as set out below, which consideration is hereby expressly accepted and acknowledged, I RELEASE AND FULLY DISCHARGE AMMO INC., D/B/A CHOPPIN CO., its subsidiaries, affiliates, members, owners, officers, shareholders, employees, volunteers, agents, representatives, and assigns (hereinafter "CHOPPIN CO.") from any and all actions, claims or demands, of any kind or nature, which I may now and/or in the future have against CHOPPIN CO., and from any and all liability, whether in law or equity, for any personal injury, death and/or property damage, expense and/or loss sustained by me as a result of my participation or observance of the Activity or which is caused by any NEGLIGENT ACT OR OMISSION or otherwise of CHOPPIN CO. This release expressly includes, but is not limited to, the following:

• the design, location, construction, inspection, and maintenance of the fencing, the cages or throwing lanes, the floors, including any rails, boxes, fencing, barriers, wall designs, targets, including the selection of the construction materials or the failure to construct fences or other barriers;
• the posting or failure to post warnings, signs, or any the classification and labeling of the axes or fencing or cages or throwing lanes;
• the design, construction, or maintenance of the axes, including the blades or handles, or the attachment of the blade head to the handle.

I will not make a claim of any kind against CHOPPIN CO. for loss or damages on account of injury, property damage, death, negligence or breach of contract, including any continued or derivative damages, compensatory, punitive, or equitable damages, that arise or may arise in connection with the Activity.

I ACKNOWLEDGE AND ACCEPT THIS ACTIVITY IS INHERENTLY DANGEROUS. There are inherent known and unanticipated risks and dangers and/or hazards of participating in the Activity. I understand that I could suffer property damage, as well as minor injuries or serious injuries, including bruises, scrapes, cuts, broken bones, psychological or emotional injury, paralysis, or even death, and/or economic and non-economic loss resulting from any o these injuries. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH THE KNOWLEDGE OF THE DANGERS INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISK OF INJURY, PROPERTY DAMAGE, OR DEATH, WHETHER CAUSED BY THE NEGLIGENCE OF CHOPPIN CO. OR OTHERWISE. I understand, accept, and assume all risks of my participation. I also acknowledge that the risks of ax throwing can be greatly reduced by following the rules of CHOPPIN CO. and by using common sense.

I have, and I am solely responsible for maintaining, adequate medical insurance to cover any medical costs or treatment related to any injury suffered while participating in the Activity, or, if I am uninsured, I agree that I am solely responsible for any medical expenses related to any medical procedure or treatment related to any such injury. I am not aware of any medical condition which could interfere with my safe participation in the Activity.

I ACCEPT full and complete responsibility for any personal injury or damages which may result from my participation in the Activity, and I hereby HOLD HARMLESS CHOPPIN CO. for any personal injury or damages sustained by me, including death, caused by the negligence of CHOPPIN CO. while participating or observing the Activity. I agree not to bring any action lawsuit against CHOPPIN CO. for any personal injury or damages caused by the NEGLIGENCE of CHOPPIN CO.

I UNDERSTAND that by executing this agreement, I am representing that I am at least eighteen (18) years old and that I have read, and understand, the agreement. if I am not 18 years old, I understand that I may only participate in the Activity if a duly authorized parent or legal guardian executes this release on my behalf.

I UNDERSTAND that if I am executing this agreement on behalf of a minor child, I am representing and warranting that I am the duly authorized parent or legal guardian of said Minor and that I have all necessary right and legal authority to enter into this Release (the "Release") on the terms set forth herein. In the event this Release is held invalid due to a finding that I am not the duly authorized parent or legal guardian of the Minor, I will indemnify and hold harmless CHOPPIN CO. with respect to any claim brought by or on behalf of the Minor, any other parent or guardian or any other party.

I AGREE that this Release of Liability, Waiver, and Assumption of Risk will be governed by the Laws of the State of Michigan and that any dispute arising from participation in the activity or related to this Release of Liability, Waiver, and Assumption of CHOPPIN CO. for any reasonable attorney's fees, costs, and expenses incurred in the defense of any action based upon my participation in the Activity. If I commence any action, or if any heir, agent, assign, or representative on my behalf does so, and CHOPPIN CO. is added to the action in any manner whatsoever, whether justified or not, then I will be jointly and severally liable to CHOPPIN CO. for all attorney's fees, costs, and expenses incurred in any such action, and agree to completely indemnify CHOPPIN CO.

PHOTOGRAPHS, VIDEOS, AND RECORDINGS. I hereby grant the right to take any pictures or video during my participation or observance of any other's participation in the Activity, and that CHOPPIN CO. may use any pictures, videos, or recording for promotion in print or digital media. CHOPPIN CO. will own any such images and I further grant CHOPPIN CO. permission to copyright, publish, distribute, use, modify, print, and reprint such images in any manner whatsoever as solely determined by CHOPPIN CO., including without limitation publications, advertisements, brochures, website images, or other electronic displays and transmissions. I forever release and hold CHOPPIN CO. harmless from any and all liability arising out of the use of the images in any manner or media whatsoever and waive any and all claims or causes of action related to the use of the images.
