I acknowledge that my participation in Circus Arts and/or any other program/class that PCC offers, entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, dismemberment, and/or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks may include but are not limited to: slips, trips and falls; falling from equipment; collision with other participants/spectators/objects; rope burns; silk burns; tape irritation; allergic reactions; pinches, scrapes, bruises, contusions, lacerations, open cuts/blisters, skin irritation, twists, strains, sprains, jolts, fractures, concussions, minor and major joint/tendon/bone/cranial/spinal- cord /nerves/muscle/skin/mucosa/ eye/ear/nose/oral/genital injuries, miscarriage, exposure/infection of illness/disease/fungal/bacterial/viral and other severe life threatening hazards and dismemberment; the negligence of other participants, faulty equipment of any and all kind, building structure/stairs/plumbing/ electricity/heat/gas/flooring/ceiling/walls/paint etc., visitors, or any other person who may be past or present; psychological injuries or physical damage associated with this activity. In any event, if you, your child, your spouse or any other person/animal /thing accompanying you is injured/broken/damaged/stolen, any and all medical/psychological assistance, replacement value will be at your own expense. Furthermore, PCC’s instructors/volunteers are fully trained to verbally and physically teach Circus Arts. Instructors seek safety, but they are not infallible. Participants must be able and willing to fully follow the instructors directions. Participants must not "do their own thing" ever without instructor knowledge/approval/direct supervision. PCC and it's instructors will not be held responsible if a participants fitness level/abilities are not compatible with circus arts. PCC instructor has the right to dismiss the student, without a refund, from class if there is an obvious safety concern. In the case that a participant has a current injury, even if its not an obvious injury, participant is choosing to enroll and partake at their own risk. Participants suffering from an acute or chronic injury/pain/limitation/disease/syndrome, need to fully communicate this with the instructor. Instructor will decide, to the best of their ability and knowledge, if circus arts is a good fit. Instructors can not be held responsible if they aren't aware of special needs or fully understand the limitations of particular special needs. It is the responsibility of the participant, participants parent/legal guardian, POA, representative or agent etc., to fully disclose any information that is pertinent. The instructor has the authority to prohibit said participant from class due to a safety concern. Pregnancy ~ There is no concrete evidence to state that circus arts is anymore of a risk to a pregnant person than an unpregnant person. In the best interest of participant, unborn, and instructor, PCC will allow, in most cases, participation in some activities only up to the 12th week of pregnancy, IF a participant has at least 1 year experience in circus arts and is approved by the instructor. PCC will alter this policy if the pregnant participant's stomach is too round/protruding to the point of interfering with circus arts skills and puts them and unborn at more risk. In the event of injuries to pregnant participant and/or unborn, PCC will not be held responsible in any way for injuries, trauma etc. Instructor's may elect to personally continue to teach further than 12 weeks into a pregnancy. Their ability to teach in later stages of pregnancy, should not be compared to the policy set forth for the student. The inherent risk of partaking in activities at PCC includes possible injuries outside the building i.e. slips, trips and falls in parking area, on the stairs. To the best of their knowledge and ability, PCC/other tenants/workers/building owner/instructors etc. follow protocol to prevent injuries outside. PCC/building owner/tenants/workers/instructors etc. will not be held responsible for accidents of any kind that happen, on the way to and from the PCC, outside the PCC building and or on any structure that is attached to the building i.e. windows, siding, paint, wood, posts, stairs, steps, threshold, landing, railing, door, uneven ground etc., PCC will not be held responsible for weather related risk outside the building i.e. rain, snow, sleet/hail, ice, leaves, lightening, tornado, hurricane, act of God etc. By signing this waiver, you are acknowledging and agreeing to accept and assume all of the risks existing in the activities offered by PCC. Student's participations in PCC activities is purely voluntarily, and you elect to participate in spite of the risks mentioned and unmentioned in this waiver. You hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless PCC from any and all claims, demands, or causes of action, which are in any way connected with your participation in the activities or use of PCC’s equipment/facilities, including any such claims which allege negligent acts or omissions of PCC. Should PCC or anyone acting on their behalf, be required to incur attorney’s fee and costs to enforce this agreement, You agree to indemnify and hold them harmless for all such fees and costs. You agree to pay upfront or repay with 25% interest and fees, any legal costs that PCC or its agents would incur relating to your presence at their activity.
You certify that you have adequate insurance or ability to pay for, any injury or damage you may cause or suffer from for participating in PCC activities. You agree to bear the costs of such injury or damage. You are agreeing to waiver all rights of bringing lawsuit/magistrate/police/bill collectors/private investigator/GPS tracking/eaves dropping/defaming/ slandering/cyber bullying/cyber squatting/legal mailings/legal paperwork of any kind to and or against PCC and ANY of the their agents/instructors/friends/family members/customers/spectators/visitors/building owners/vendors/ contractors/cleaning crew/ and or any other persons affiliated in any capacity to PCC in any state or country, or counter action will be necessary by PCC. By signing this document, you acknowledge that if anyone is hurt or property is damaged/stolen during participation in PCC’s activities, you will be found by a court of law to have waived your right to bring a lawsuit or any legal action against PCC on the basis of any claim from which you have released them herein. You also agree that this document is valid for all visits to PCC both indoors and out. You agree that you have had sufficient opportunity to read this entire document. You are agreeing to be bound by this waivers terms. This waiver is valid for an indefinite amount of time or until PCC asks that I sign a new waiver. General PCC rules: Language ~ PCC prohibits disruptive talking, back talking, vulgar language, abusive language, threatening language from spectator/guest/participant to the instructor/agent of PCC or to another spectator/guest/participant. Spectator ~ All spectators and persons that are not actively in a class, may not ever enter the circus floor unless there is prior approval from an instructor. Exception is the use of the restrooms, which can be done before, after, in between classes. You do not need permission to use our restrooms if you are doing so in the said times. In the event a spectator has entered the circus floor and is not approved to do so, the instructor or person in charge will demand that they exit the floor. In the event of continued noncompliance to this policy, the spectator will be asked to leave/wait outside. PCC has the right to call 911 or seek police intervention, defend themselves/ other present, if a spectator poses to be a threat. Sanitation ~ PCC expects clothing, hair, skin, hands, feet etc. to be clean and free of odor. PCC has the right to turn away any individual that doesn't fit this criteria. PCC may request sanitizer be placed on hands and soles of feet before entering the main circus floor. You may opt for washing at the sink. Proper attire ~ PCC has a very strict attire/uniform policy. You are agreeing to adhere to the following attire rules: Clothing - PCC requires form fitting athletic clothing. Tops must fully cover armpits with obvious hair, midriff, lower back and back of the knees. Students in youth program may not wear tank tops. Bottoms must be a good fit to cover the lower back, midriff, and back of knee. Low waisted bottoms, bottoms that are obviously too small, and flared legs, are prohibited. Baggy clothing is prohibited but may be worn during warm ups or when participant is not on a circus prop. Clothing with vulgar or hate speech are prohibited. Feet - We do not allow shoes in any class other than German Wheel. PCC expects feet to be clean and free of odor. In some cases, socks can worn. Instructor will direct participants to take socks off when necessary. Accessories - No jewelry/watch/accessory of any kind are allowed. Jewelry that is not seen (naval piercing, implanted etc.) is at the discretion of the participant. Hair - Longer hair MUST be kept in ponytail/braid/bun or equivalent without the use of plastic hair clips. Perfume - Scented lotions, perfumes, oils are not allowed for both medical (allergy) and sanitary reasons. Finger & toe nails - Fingernails must be short enough that complete tight fist can be made and not leave nail indentations on the palm (fist test) . PCC doe not allow acrylics, tips, glue on, press on or any artificial nails UNLESS nails are short, rounded, and participant can pass the fist test. Pointed shaped nails or nails with sharp edges of any length are prohibited. Toe nails must be short, clean and free of sharp edges.
Food - Food products are not allowed while participating in a class. In the event of a low sugar incident, upset stomach, indigestion or other GI issues, PCC will excuse the participant to the waiting are as to allow them to correct their condition. PCC allows liquids with lids/caps to be set on the designated tables and sparingly consumed during class. PCC strongly suggests to drink only clear liquids during class. Smoking - PCC has a non smoking/vaping policy while inside PCC, and on the stairwell. Smoking can be done at least 10 feet away from our building. Cigarette butts/vapes must be disposed of properly in an outdoor garbage can or taken with you. Otherwise, PCC will have a person cited for littering.
By signing this waiver, you are agreeing that you read and understand the entire document. In the event of confusion, you are agreeing that you have/will ask appropriate questions before signing. You are agreeing to all the above said policies, rules etc.
