Assumption of Risks, Release of Liability, Waiver of Claims, and Indemnification Agreement 

1000742770 Ontario Inc, operating as ‘Confetti² ’ Indoor Playground & Events 

Nature of Activity: 1000742770 Ontario Inc. is an indoor playground which offers clients the opportunity to participate in a number of imaginative and recreational activities including, but not limited to, physical related activities, soft play activities, private parties, parent-tot programs, music and arts programs, and special events. 

1000742770 Ontario Inc. (and or any entity acting as or on behalf of 1000742770 Ontario Inc.) is a parent/guardian supervised facility. Parents/guardians are required to keep their kids in their own sight and monitor their activities closely.  

In CONSIDERATION OF permission to use 1000742770 Ontario Inc. property, facilities, and services and for other good and valuable considerations, the sufficiency and acceptance of which is hereby acknowledged, to the extent permitted by law, by signing this Waiver, today and on all future dates, I, on behalf of myself, accompanying adults and/or the minor (s) under my supervision as his/her parent/legal guardian, on behalf of my spouse, my children, my heirs, my parents/guardians, guests, personal /legal representatives, assigns and estate, acknowledges and agrees as follows:  

I understand and acknowledge that my participation at 100742770 Ontario Inc. involves known and unforeseen risks that could result in physical or emotional injury, paralysis, death or damage to myself, accompanying adults and/or the minor(s), my and/or the minor's property, 1000742770 Ontario Inc.'s property, the Host’s property and to third parties. The risks include, but are not limited to, muscle strains/sprains; bruises; minor cuts; abrasions and contusions; broken bones; ligament and joint injuries; concussions, eye injury and other serious injuries that could result in brain injury; paralysis; heart attack, and death. 

I, on behalf of myself, accompanying adults and/or the minor(s), children/ward/guest, understand and expressly agree to have read the above paragraphs and know and acknowledge that 1000742770 Ontario Inc.’s activities contain risks and that participating in such activities may result in any type of injury/injuries as mentioned above. I, on behalf of myself, accompanying adults and/or the minor(s), children/ward/guests, hereby assert that my and/or the minor's participation, children/ward/guest’s participation is voluntary and that I on behalf of myself and/or the minor, knowingly assume all of the risks existing in the activities at 1000742770 Ontario Inc. playground and event space. 

I, on behalf of myself, accompanying adults and/or the minor, my dependents, heirs, executors, successors, assigns and personal representatives, hereby waive any and all claims of any kind or nature which I may have against 1000742770 Ontario Inc., their Host, their affiliates and subsidiaries, and all of their respective owners, directors, officers, employees, agents, independent contractors, equipment providers, marketing partners, volunteers, representatives, successors and assigns (collectively, the “Released Parties”) in connection with any claims, suits, costs, (including legal fees), demands, damages, actions, or causes of action whatsoever including, without limitation, any liability for bodily injury, illness, death, economic loss, and property damage, which may arise directly or indirectly from or in connection with my participation in 1000742770 Ontario Inc. where such claims result from the negligence of the Released Parties (collectively, “Claims”). I, on behalf of myself and/or the minor, hereby undertake and agree that I will not bring any legal proceeding in any court or tribunal asserting any such Claims against any of the Released Parties. I, on behalf of myself and/or the minor, hereby agree to indemnify and hold the Released Parties harmless from any and all such Claims. 

I understand and acknowledge that in case I am accompanying adults and/or the minor(s), children/ward/guest who are/get injured while at 1000742770 Ontario Inc., medical assistance would be required, which I, on behalf of myself, accompanying adults and/or the minor(s), acknowledge will be at my own expense or expense of my personal Insurer(s). I, on behalf of myself, accompanying adults and/or the minor(s), understand and agree that 1000742770 Ontario Inc., the Released Parties shall not be liable and will not pay for any cost or expenses incurred. 

I hereby voluntarily release, forever discharge, and agree to hold harmless, defend, and indemnify 1000742770 Ontario Inc., its owners, directors, officers, affiliates, employees, volunteers, independent contractors, equipment providers, and agents and waive any and all claims, that I have or may have in the future against 1000742770 Ontario Inc. I hereby release 1000742770 Ontario Inc. from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my family, heirs, assigns, personal representatives and estate may suffer as a result of my participation in 1000742770 Ontario Inc.  

By signing this waiver, I, on behalf of myself, accompanying adults and/or the minor(s), agree and acknowledge that I am aware of any previous injuries that I, accompanying adults and/or the minor(s) have sustained. I, on behalf of myself, accompanying adults and/or the minor, am aware that by participating in such activity, there is a risk in re-injuring any pre-existing injury and I, on behalf of myself, accompanying adults and/or the minor(s), waive any and all Claims relating thereto.  

If 1000742770 Ontario Inc. deems that I, accompanying adults and/or the minor(s): (a) am/is/are unable to accept instruction, (b) am/is/are unable to adhere to safety rules, or (c) behave(s) in an inappropriate or unacceptable manner, participation may be curtailed immediately at the discretion of 1000742770 Ontario Inc. 

I, on behalf of myself, accompanying adults and/or the minor(s), grant 1000742770 Ontario Inc. permission to use all photographs, film, audio, or other recording, still or moving, taken of me and/or the minor(s) at the event (the "Content") and to use the Content in any media for any purposes which may include, among others, advertising, promotion, marketing of products and services, employee education and training provided the media does not explicitly show my and/or the minor's face. I acknowledge and agree that 1000742770 Ontario Inc. will personally ask for my permission to use media that shows me and/or my minor's identity before it is used in a public way.  I agree the Content may be combined with other images, text, graphics, film, audio, audio-visual works; and may be cropped, altered or modified. I acknowledge and agree that I have and/or the minor(s) have no right to compensation, royalty or payment and acknowledge that the rights to any such photographic and/or video images are solely owned by and the property of 1000742770 Ontario Inc. and that I, on behalf of myself and/or the minor, will make no claim for any reason against 1000742770 Ontario Inc.

I, on behalf of myself, accompanying adults and/or the minor(s), acknowledge that I have read, viewed or heard the rules central to my participation, accompanying adults and/or my child/children/ward/guest's participation and/or the minor's participant in any activity at 1000742770 Ontario Inc., and certify that I understand all the rules that have been implemented for the safety of all participants. 

I on behalf of myself, accompanying adults and/or the minor(s), acknowledge that 1000742770 Ontario Inc. o/a Confetti ² Indoor Playground collects my email to send me a copy of this signed waiver when completed. I may also get emails about upcoming events but I can unsubscribe at any time.  1000742770 Ontario Inc. o/a Confetti ² Indoor Playground and all software used at the establishment does not give out customer contact information in any shape or form to any outside parties or people.

Playground Rules
  1. Children must be supervised by a responsible adult or caregiver at all times.  A responsible caregiver must be a minimum of 16 years old. 
  2. No rough play. Kids will be asked to leave if they are hurting others, or damaging property.
  3. All admissions are for one time usage and is non-transferable unless on subscription. No re-entering privileges. Admission is for an allotted time slot and date. 
  4. Socks are required to be worn beyond the entrance at all times by children & adults. 
  5. Outside food not permitted unless for a pre-booked party. Snacks and drinks are only allowed at the concession stand area or in a pre-booked party room. Please note that all food must be peanut free. Only peanut-free food items are allowed in the premises. 1000742770 Ontario Inc o/a Confetti² is not liable for guests outside food items containing peanuts. 
  6. Food and drinks are not permitted in the play area.   
  7. Alcoholic drinks are not allowed in the premises and are explicitly prohibited. Failure to comply with this will result in guests being asked to leave or will be removed from the premises. 
  8. Confetti² is not responsible for any lost or stolen items.   
  9. Confetti and/or glitter is only allowed to be used by 1000742770 Ontario Inc o/a Confetti² as part of their “confetti add-on.” Guests may not bring their own confetti and/or glitter. Guests will be charged the $100 confetti add-on fee if confetti and/or glitter is used.  
  10. Deposits for party bookings are non-refundable.
  11. Guests are required to leave the party room and venue immediately after their booking is over.   
  12. Please do not visit if you or your child are sick, to prevent the spread of illness.

Face Painting & Temporary Tattoos Waiver

I understand my child(ren) may participate in activities involving face painting and/or temporary tattoos. 1000742770 Ontario Inc. o/a Confetti² Square Indoor Playground will not paint or place temporary tattoos on skin with open wounds/cuts/abrasions. We are not responsible for allergic reactions to the products we use. Please let us know if your child(ren) are prone to skin conditions so we may avoid face paint and/or temporary tattoos and choose a different activity. I agree 1000742770 Ontario Inc. o/a Confetti² Square Indoor Playground may take photos of my child(ren) with face paint & share them on our social media. If you do not want your photos taken and/or shared please let us know.Click to customize text
