General Service Authorization and Release

I ACKNOWLEDGE this is a release of my rights to sue. I AGREE that if any provision of this agreement is found to be unenforceable or invalid, that provision shall be severed from this agreement. The remainder of this agreement will then be construed as though the unenforceable provision had never been contained herein.

THIS AGREEMENT is entered into between Dive Georgia and the individual signed below, hereinafter "CUSTOMER", for the service and/or repair of scuba, cylinder, skin diving equipment, and/or any other equipment provided to Dive Gerogia to service.

THIS AGREEMENT is a release of the CUSTOMER'S rights to sue for injuries or death resulting from use of the equipment after service/repair. CUSTOMER expressly assumes all risks of skin and/or scuba diving related in any way to use of this equipment.

CUSTOMER also understands that Dive Georgia and its employees, owners, officers, or agents (hereinafter "Released Parties"), shall not be held liable or responsible in any way for any injury, death or other damages to CUSTOMER or his/her family, heirs or assigns which may occur as a result of use of the equipment after service/repair.

I hereby grant Dive Georgia, affiliated companies of Dive Georgia, companies, staff, and instructors permission to solicit and market to me directly via fax, email, text, SMS, mail and phone. If I wish to change this permission, I agree to use the “OPT OUT” option provided in each marketing media, whether via link, page, call, or reply text/SMS.

CUSTOMER agrees to personally inspect and verify function of their equipment before each and every use and only use such equipment if it is fully operational. In the event such equipment is not fully functional during inspection, I will stop using such equipment immediately, and bring such equipment to an authorized service center for repairs.

I have carefully read and understand this entire agreement. By signing this agreement, I exempt and release Dive Georgia and all related entities as defined above, from all liability or responsibility whatsoever for personal injury, property damage, or wrongful death as a result of using the equipment, however caused, including, but not limited to product liability or the negligence of the released parties whether passive or active.

I do not request a written estimate provided the repair/service costs do not exceed double of the posted labor cost to cover routine parts and materials. Dive Georgia may not exceed that limit without my approval.

REPAIR AGREEMENT: I hereby authorize the above work to be carried out. I agree that Dive Georgia will not be held responsible for loss or damage to my equipment as a result of fire, theft, accident or any other cause beyond control. Any equipment left after 7 days of notice of completion of work will be subject to a storage charge. Any equipment left after 30 days of notice of completion may be sold to cover the cost of service.

Under Georgia law, there is no liability for an injury or death of an individual entering these premises if such injury or death results from the inherent risks of contracting COVID-19. You are assuming this risk by entering these premises.

Non-OEM Equipment Assembly Authorization

I understand that unless documented in writing by the manufacturer, that each manufacturer only authorizes Original Equipment Manufacturer (OEM) parts to be used and assembled as part of an assembled system. I understand that Dive Georgia does not manufacture this equipment and has no ability to measure compatibility of dissimilar brands, parts, or its effects on the overall system. Using dissimilar manufacturers or non OEM parts may result in reduction of performance or result in failure of equiptment. 

I have personally requested that any and all components from different manufacturers or non OEM parts be assembled and/or reassembled and used on my equipment. I release my rights to sue for injuries or death resulting from use of such mismatched equipment. I agree that there has been no warranties made to me expressed or implied to the performance or compatibility of such items.

Cylinder Service Authorization

Visual safety inspections need to be done on your scuba cylinder to assure its continued safe service. The frequency of these inspections depends upon the kind of use, care and maintenance your cylinder gets. The more often it is used, the worse its care, maintenance and handling, the more frequently it should be inspected.

Your cylinder should also be inspected before further use whenever it is known to have been exposed to temperatures over 350°F, been in an accident, known or suspected to be leaking, dropped, fell, was struck, has obvious corrosion since the last visual inspection, has a gouge, dent, scrape, cut, dig or, in any way, has been damaged since the last visual inspection, or was stored with water, material or matter inside the cylinder. 

Your cylinder should not be used if it is, or is suspected to be, leaking or has been drained of all pressure. 

Your cylinder should be inspected once every twelve months, or more frequently in certain cases. The visual inspector can help you decide how frequently your cylinder should be inspected. If it is time, or, you suspect or have any concern about the general condition of your scuba cylinder, a visual inspection by an experienced visual inspector is needed. Most cylinders require 5 year hydrostatic testings and valve service and pressure relief devices be serviced at least every 5 years.

I agree, as a condition of having this visual inspection or hydrostatic test, that the cylinder will be condemned and rendered unusable if it does not meet the accepted standards by the CFR, DOT, CGA, or manufacturer for continued service. I will receive a written report of any and all conditions, which caused the cylinder to fail the inspection and to be condemned. Also, I will have the condemned cylinder, accessories, components, and valve returned to me.
