Waiver and Hold Harmless Provisions

This Agreement is made for the benefit of Antler Bar Amusements, LLC dba Double JJ Resort, Double JJ Propco, LLC, and their employees and agents (the "Protected Persons"). On behalf of myself, my family and any children who are in my temporary care (the "Parties"), I hereby release the Protected Persons from all liability for all injuries and damages resulting from observing or engaging in any recreational activities sponsored by the Protected Persons, even if caused by the negligence of the Protected Persons. I agree that recreational activities carry risks of injury to people and property, both from foreseeable and unforeseeable causes, and hereby assume such risks on behalf of the Parties. I agree to indemnify the Protected Persons against all losses incurred, including legal expenses, as a result of any claim brought against any of the Protected Persons, which arise out of any of the Parties observing or engaging in any recreational activities provided or sponsored by the Protected Persons, even if caused by the negligence of the Protected Persons.

To fully enjoy our waterpark and resort activities, guests must be in good health. Those suffering from heart disease, high blood pressure, epilepsy, or prescription medication, or major medical conditions should consult their physician before using our slides, hot tubs, or resort activities. Individuals with medical conditions including, but not limited to, pregnancy, heart, or back problems should not use slides, hot tubs, or waterpark or resort activities. Anyone under 18 years of age who has a history of fainting, dizziness, heart condition, epilepsy, or any serious medical condition may not enter the waterpark unless under the supervision of an adult.

I hereby grant the Double JJ Resort permission to use my likeness in a photograph, video, or other digital media ("photo") in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of the Double JJ Resort and will not be returned. I hereby irrevocably authorize the Double JJ Resort to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose.
