DRIFT AND FLOAT BOAT RENTAL AGREEMENT AND LIABILITY WAIVER

This Boat Rental Agreement and Liability Waiver (“Agreement”) is entered into between Drift and Float LLC (“Owner”) and the undersigned renter (“Renter”) on the date of signing. By signing this Agreement, Renter acknowledges, understands, and agrees to the following terms:

1. ACKNOWLEDGEMENT OF RISKS

I, the undersigned, acknowledge that:

  • Operating and riding in a rented boat, pontoon, or jet ski involves inherent risks, including but not limited to drowning, collisions, capsizing, adverse weather, mechanical failures, and injury from watercraft operations.
  • These risks can lead to serious injury, disability, or death, and I voluntarily assume these risks.

2. RELEASE OF LIABILITY & WAIVER OF CLAIMS

To the fullest extent permitted by Virginia law, I hereby release, waive, discharge, and agree not to sue Drift and Float LLC, its owners, employees, agents, and affiliates (“Released Parties”) for any liability, claims, demands, actions, or causes of action arising out of:

  • Personal injury, property damage, or wrongful death resulting from my use of the rented watercraft.
  • Acts of negligence by myself, passengers, other boaters, or third parties.

I understand this waiver does not release liability for gross negligence or willful misconduct by Drift and Float LLC.

3. ASSUMPTION OF RESPONSIBILITY

I accept full responsibility for:

  • The operation and safe return of the rental boat, including all equipment and accessories.
  • Any damages, losses, or theft occurring during my rental period.
  • Ensuring that all passengers comply with safety rules and Virginia boating laws.

4. SAFETY RULES & REQUIREMENTS

I certify that:

  • I am at least 18 years old and possess a valid driver’s license (or 21+ for jet skis, per VA law).
  • I have completed a Virginia-approved Boater Safety Course, as required for anyone born after January 1, 1974, and I can provide proof upon request.
  • I will not operate the rental under the influence of drugs or alcohol.
  • I will wear a U.S. Coast Guard-approved life jacket at all required times.
  • I will follow all Virginia boating laws, including no-wake zones, speed limits, and right-of-way rules.
  • I understand that reckless operation, towing unauthorized objects, or violating laws may result in immediate termination of the rental with no refund.

5. DAMAGE DEPOSIT & FINANCIAL RESPONSIBILITY

  • I authorize Drift and Float LLC to charge my credit card for any damages, excessive cleaning, late returns, or violations.
  • I agree to pay all costs related to damage, towing, or rescue operations caused by my actions or negligence.

6. INDEMNIFICATION

I agree to indemnify and hold harmless Drift and Float LLC from any claims, lawsuits, or costs resulting from my rental, including those by passengers, third parties, or government agencies.

8. AGREEMENT TO TERMS

I have read this Agreement in full, understand its terms, and voluntarily sign it. I acknowledge that I am giving up certain legal rights by signing this waiver.
