RENTAL AGREEMENT & LIABILITY WAIVER


(Applies to all bicycle and e-bike rentals) 

1. AGREEMENT

This Rental Agreement (“Agreement”) is between the individual(s) listed below (“Renter” or “Participant”) and Elwha Ebike Adventures (“Company”). This Agreement covers the rental and use of all bicycle equipment, including but not limited to the bicycle frame, tires, battery, motor, brakes, lights, accessories, and safety equipment (collectively, “Bicycle”).

2. ELIGIBILITY & USE

  • Rider must be 16 years of age or older
  • Only the registered Renter may operate the Bicycle
  • No passengers are allowed at any time
  • No towing, pulling, or modifications to the Bicycle
  • Bicycle must be used in a safe and lawful manner

3. RENTAL PERIOD & RETURN

Renter agrees to return the Bicycle on time, to the designated location, and in the same condition received (excluding normal wear). Late returns, excessive dirt, or misuse may result in additional charges.

4. PAYMENT & CHARGES

Renter agrees to pay all rental fees, taxes, and applicable charges, allow charges to be applied to the card on file, and pay cleaning fees if the Bicycle is returned excessively dirty.

5. *TRAIL & USE GUIDELINES*

Renter agrees to ride only on designated and approved trails, roads, and paved surfaces; not create or use unauthorized paths, trails, or off-road routes; and avoid riding through terrain that may damage the Bicycle or create unsafe conditions.

6. *PROHIBITED USE*

The Bicycle may NOT be used for racing, stunts, or contests; on unsafe terrain or in conditions that may damage the Bicycle; while under the influence of drugs or alcohol; or for illegal activity of any kind. Violation results in immediate termination of rental and full liability.

7. *DAMAGE, LOSS & RESPONSIBILITY*

Renter is responsible for ALL damage, loss, or theft, regardless of fault. This includes crash damage, mechanical damage due to misuse, theft or vandalism, loss of use/downtime, and administrative and recovery costs. If the Bicycle is beyond repair, Renter is responsible for full replacement value.

8. *ACCIDENTS & REPORTING

All accidents must be reported immediately. Renter must notify both staff and authorities (if applicable). Failure to report may increase liability.

9. BATTERY & OPERATION RESPONSIBILITY

Renter understands battery life varies based on terrain, usage, and rider weight; it is the rider’s responsibility to monitor battery levels; and bikes must be returned before battery depletion creates risk.

10. MEDICAL & PHYSICAL CONDITION

Renter confirms they are physically able to operate the Bicycle safely.

11. WEIGHT LIMITS

Ramblas: 275 lbs | Avenue: 250 lbs | Cruiser: 275 lbs Rider (including gear) must not exceed limits.

12. ASSUMPTION OF RISK

Riding a bicycle involves inherent risks, including but not limited to falls, collisions, road hazards, weather, terrain, equipment malfunction, serious injury, or death. Renter voluntarily assumes all risks associated with use.

13. RELEASE OF LIABILITY

To the fullest extent permitted by law, Renter agrees to release and hold harmless Elwha Ebike Adventures, its owners, employees, and agents; waive all claims for injury, damage, or loss; and accept full responsibility for personal safety and actions. This release applies except in cases of gross negligence or intentional misconduct.

14. INDEMNIFICATION

Renter agrees to defend and indemnify Elwha Ebike Adventures from third-party claims, property damage, or injury caused during rental use.

By signing above, each participant acknowledges cycling is inherently risky, accepts full responsibility for participation, and releases Elwha Ebike Adventures from liability as outlined.
