ASSUMPTION OF RISKS AND HAZARDS

WAIVER OF RIGHTS RELEASE AND INDEMNITY AGREEMENT

In consideration of being permitted to utilize the facilities, aircraft and equipment of Servicios Aereos Ahau S de RL de CV. and Club Deportivo de Paracaidismo AHAU A.C., and to engage in skydiving and all related activities, which include but are not limited to, ground and air transportation, training, parachute packing and rigging, aviation, observing, and all related activities with Skydiving (hereinafter referred to as "SkyDiving" I,hereby acknowledge and agree to the fullest extent permitted by law as follows:

1. I hereby waive, reléase and forever discharge Servicios Aereos Ahau S de RL de CV., and Club deportivo de Paracaidismo AHAU A.C., Jumbo tours México Sa de CV., and its subsidiaries, associates, shareholders, officers, directors, agents, employees, administrators, instructors, pilots, jumpmasters and the owner of the aircraft, equipment and land utilized for SkyDiving (hereinafter referred to as the “Released Parties”), arising out of the inherent risks of participating in Skydiving, which inherent risks include, but are not limited to, airplane crash, equipment failure or malfunction, weather and wind, collisions, landing, and/or the decision-making of Participant, other participants, and/or any employees or agents of the Released Parties;

2.- I further agree that I will not sue or make a claim against the Released Parties for damages or other losses sustained as a result of my participation in SkyDiving. I also agree to indemnify and hold the Released Parties harmless from all claims, judgments and costs, including attorney's fees, incurred in connection with any action brought as a result of my participation in SkyDiving, including but not limited to losses caused by the passive or active negligence of the Released Parties; or hidden, latent, or obvious defects on the landing area or in the equipment or aircraft used. The intent of this release is to release and discharge the Released Parties of any duty of care to me what-so-ever in so far as it is possible to do so under the laws of Mexico and/or my original and/or residency country.

3.- I understand and acknowledge that SkyDiving is extremely hazardous and that no amount of care, caution, instruction or expertise can eliminate them. Therefore, I expressly and voluntarily assume all risks associated with SkyDiving including the risk of death, injury, partial or permanent disability, as well as possible passive or active negligence of the Released Parties; and any hidden, latent, or obvious defects on the landing area or in the equipment or aircraft used

4.- I have been advised and recognize that SkyDiving is not covered by any personal accident or general liability insurance policy maintained by the Released Parties. As a consequence I waive, release and forever discharge the Released Parties, from all liability for any loss, damage, injury, or expense that I [and/or my next of kin] may suffer, arising out of the inherent risks of participation in Skydiving.

5.- I understand that because of the unavoidable and unpredictable dangers involved in the use of parachutes, the Released Parties are making no warranty of any kind, expressed or implied, concerning any and all equipment, aircraft, or facilities provided by the Released Parties. Parachuting is a dangerous sport and associated equipment, such as Parachutes, do NOT always work the way they are expected to. Furthermore, I understand that my stability and body position can drastically affect the operation of the parachute. I understand that the parachutes provided by the Released Parties are provided without any warranty that they are fit to use for any purpose whatsoever, without the warranty of merchantability and in particular without any warranty that they are fit to use in descending from an aircraft. Furthermore, I understand that there is no warranty that the parachutes have been packed without a hidden defect in packing. I understand that I need not use the equipment supplied by a Released Party, but I may use my own equipment, if it is approved by a Certified Rigger. The approval for use of any equipment by a Rigger is not a warranty that the equipment is suitable for any purpose. I understand that my participation in Skydiving is voluntary and understand that I had the opportunity to inspect the Released Parties’ equipment, aircraft, and facilities before any participation. I understand these disclaimers and I accept them.

6.- I understand that because of the nature of sport Parachuting, it is impossible for an instructor to determine with any degree of certainty that I have been properly trained to participate in the sport or that I have fully grasped and comprehended the instruction presented to me.

7.- I specifically agree that I have inspected, to the degree I deem appropriate, all the landing area, facilities, and equipment of Servicios Aéreos Ahau S de RL de CV. And Club deportivo de Paracaidismo AHAU A.C.and                 their concessionaires. I acknowledge that the landing area  does  contain  such dangerous objects as water, trees, fences, power lines, buildings, rocks, hidden holes, uneven terrain, unpredictable wind conditions, and other natural and man made objects that can cause injury to me upon landing, and I assume the risk of injury that may result on partial or permanent disability or death upon landing, and I understand that even under the best conditions, landing is an extremely dangerous activity and many injuries occur. Based upon my independent evaluation of all the risks I reaffirm my assumption of these extreme risks and the others set forth in this agreement.

8.- In the event of renting Skydiving Equipment, the undersigned is the sole responsible for the use of the Skydiving Equipment hereby leased from  Servicios Aereos Ahau S de RL de CV. And Club deportivo de Paracaidismo AHAU A.C., therefore, I’m completely liable from any damage that may occur to such Equipment. All expenses, costs and repairs to be performed on the Equipment due to my use of it, whether it be for normal use, abuse, negligence, accident, reckless behavior, robbery, etc., such as any damage to the main canopy, reserve canopy, or any other part or component of  the container,  or full theft, will be my sole responsibility. I hereby authorize Servicios Aereos Ahau S de RL de CV. and Club deportivo de Paracaidismo AHAU A.C., to perform the required repairs on the Equipment, either directly or through third parties, in compliance with the USPA regulations and the Equipment manufacturer and I accept to be solely liable for covering the repair or reposition cost in full, in order for the Equipment to remain in the same or better use and operating conditions than the way I receive it.

9.- I acknowledge and understand that in the case of a Tandem Jump, I will be suited with a harness and other equipment that will allow to be hooked up closely to an instructor’s body and parachute equipment. For reasons of safety and control, these points of connection need to be tightly and snugly adjusted together. This will bring my body within proximity to the instructor. I understand that during instruction, gear-up, and skydive, I may be touched, pushed, pulled, and/or adjusted in areas otherwise considered private or personal; however, I acknowledge the necessity of said actions to participate and acknowledge that said actions shall not constitute inappropriate physical or sexual contact, abuse, or harassment. I understands and acknowledges that if I am not comfortable with this aspect of Skydiving, I can always choose to walk away and not participate.

10.- I promise not to sue any of the Released Parties for any cause of action whatsoever.

11.- I hereby grant Servicios Aereos Ahau S de RL de CV., Club deportivo de Paracaidismo AHAU A.C., its representatives and employees the right to take photographs and video of me in connection with my participation in Skydiving. I hereby expressly authorize Servicios Aereos Ahau S de RL de CV. and Club deportivo de Paracaidismo AHAU A.C., to copyright, use, and publish the same in print and/or electronic form. I also expressly agree and authorize the use of such photographs and video of me for any lawful purpose, including publicity, illustration, advertising, and web content of Servicios Aéreos Ahau S de RL de CV. And Club deportivo de Paracaidismo AHAU A.C.

12.- It is further specifically agreed that venue and jurisdiction for any legal action arising out of any matter herein or from the Skydiving activities, shall be the competent courts located in Playa Del Carmen, Cancun, Quintana Roo Mexico, giving up any jurisdiction that may correspond to me by reason of my present or future address or by any other cause.

13.- I hereby certify, under oath that I have no physical or mental condition that precludes me from participating in Skydiving and that I am not participating against medical advice. I specifically certify that I am not now under treatment for any of the following conditions:

a.              Cardiac or pulmonary condition or disease  

b.        High or low blood pressure

c.              Fainting spells or convulsions

d.              Hearing loss

e.              Nervous disorders

f.               Diabetes

g.              Kidney or related diseases

h.              Shortness of breath

i.               Psychiatric disorders

I further certify that I am not on any regular medication and have not taken any alcoholic beverages or any kind of drugs within the last twelve hours, nor have I been Scuba Diving in the previous 24 hours.

I understand and agree that in case of discrepancy of the content of this document or its interpretation, Spanish language should prevail.

I FULLY UNDERSTAND ITS CONTENTS AND SIGN IT OF MY OWN FREE WILL.


I CERTIFY THAT I AM OVER THE AGE OF EIGHTEEN (18).

I CONSENT TO THE USE OF MY ELECTRONIC SIGNATURE ON THIS AGREEMENT AND UNDERSTAND THAT MY ELECTRONIC SIGNATURE HAS THE SAME FORCE AND EFFECT AS MY ORIGINAL, HANDWRITTEN SIGNATURE.
