RELEASE AND WAIVER OF LIABILITY

AND MEDIA USAGE

AGREEMENT


IN CONSIDERATION of being permitted to participate in any way in Fastpitch Studio/Woodinville Reign Softball Club Corporation ("Fastpitch Studio") training programs, activities, events, and facility usage (“Activities”) I, for myself, personal representatives, assigns, heirs, next of kin, or any other person that accompanies me:  

I ACKNOWLEDGE, agree, and represent that I understand the nature of Fastpitch Studio activities and that I am qualified, in good health, and in proper physical condition to participate in such Activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.  

I FULLY UNDERSTAND THAT: (a) Fastpitch Studio ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or the negligence of the “releases” named below; (c) there may be other risk, social, and economic losses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.  

I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Fastpitch Studio, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the “RELEASES” herein) from liability, claims, demands, losses, or damages on my account cause or alleged to be cause in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations and I further agree that if, despite this Release and Waiver of Liability and Media Usage Agreement I, or anyone on my behalf, makes a claim against any of the Releases, I will indemnify, save and hold harmless each of the releases from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

In the event that I am unable to communicate my own desire, or I cannot be reached during an emergency involving my minor/self, I hereby give consent to emergency medical treatment deemed necessary by a licensed medical provider/hospital.       

I GRANT TO Fastpitch Studio, and its successors and assigns, the irrevocable, perpetual, royalty free, worldwide, sub licensable and unrestricted right to use and/or publish media (images, photographs, and/or video of me, or any materials in which I may be included), for training, editorial, social media, advertising, and any other purpose and in any manner and medium; and to alter and composite the same without restriction and without my inspection or approval.  

I hereby release Fastpitch Studio from all claims and liability relating to any of the foregoing, including but not limited to any claims based on rights of privacy or publicity.

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
