Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement

In lawful consideration of being permitted to voluntarily enter Fortis Defense LLC. weapons range and all associated property ("RANGE") and use its facilities and/or equipment, for the purposes of shooting, target practice, training, observation, work, or recreation in any way or for any purpose; myself, and my guests, relatives, or personal representatives hereby abide by, and agree to the following:

I UNDERSTAND AND ACKNOWLEDGE THAT SHOOTING AND RELATED ACTIVITIES ARE INHERENTLY HAZARDOUS AND POTENTIALLY LIFE THREATENING. These activities involve known, unknown, and unanticipated risks that could result in damage or destruction of my property, physical or emotional injury, including paralysis or death to myself or others. These risks include, but are not limited to: being shot or shooting myself or others; total or partial loss of hearing and eyesight; burns; inhalation or other harmful contact with lead or other contaminants; and being struck by flying or falling objects. I am fully aware of the risks and hazards inherent in participating in any activities or events held at the RANGE.

              


 

I HEREBY ELECT TO VOLUNTARILY ENTER THE RANGE and engage in any/all activities therein, acknowledging the nature and present conditions and dangers of the RANGE facilities, equipment, and premises and further, I acknowledge that conditions and dangers may become more hazardous during the time in which I am on/in the RANGE or walking to and from thereof.

               


 

I HEREBY ASSUME ALL RISKS OF LOSS, DAMAGE, INJURY, OR DEATH that may be sustained while in or on the RANGE, including walking to or from vehicles, or on the premises in general, and I understand that such hazards and risks cannot be eliminated without compromising the essential qualities of the RANGE, it's facilities, equipment, premises, or environment.

               


 

I ACKNOWLEDGE THAT FORTIS DEFENSE LLC. MAKES NO WARRANTY AS TO THE DESIGN, MANUFACTURE, MAINTENANCE, CONDITION, OR FITNESS for any particular use or purpose of ANY RANGE facilities or equipment, including but not limited to: range equipment, firearms, ammunition, vision and hearing protection, or first-aid supplies.

               


 

I UNDERSTAND AND ACKNOWLEDGE THAT FORTIS DEFENSE LLC., its owners, officers, management, employees, and representatives have NO DUTY OR LEGAL OBLIGATION TO UNDERTAKE FIRST AID or rescue operations or procedures in the event that ANY such physical or emotional injury, or property damage occurs. I acknowledge that any injuries received may be compounded or increased by rescue operations and procedures, whether negligent or otherwise, and I assume full responsibility thereof.

               


 

I WILL INSPECT THE RANGE FACILITY, immediately upon entering and continuously thereafter, and I agree that if I feel anything to be unsafe, I will immediately advise the officials or employees of the RANGE, and I will immediately leave and refuse to participate further in any such shooting, training, observation or related activities.

               


 

I AGREE TO ABIDE BY ALL RULES AND REGULATIONS, fire and safety requirements, and the direction of all employees, agents, officers of FORTIS DEFENSE LLC. and any/all emergency personnel. I acknowledge that I may be removed from the RANGE for failure to follow these Rules, Regulations, requirements, or directives.

               


 

I EXPRESSLY AGREE TO HOLD HARMLESS FORTIS DEFENSE LLC., its owners, officers, management, employees, and representatives, and to undertake to defend and to INDEMNIFY FORTIS DEFENSE LLC. from, ANY and ALL LIABILITIES, LOSS or DAMAGE OF PROPERTY, CLAIM OF INJURY, demands, expenses, counsel fees and costs, of whatsoever nature or kind BY ME OR MY RELATIVES, HEIRS, GUESTS, OR AGENTS, arising from the USE OF, EVENTS, or ACTIVITIES in/on the RANGE; whether caused by negligence of the staff, failure to act, negligent rescue or first aid operations, or otherwise. This Agreement shall extend to, and bind my next of kin, heirs, guardians, relatives, representatives, and assigns.

               


 

THIS AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY LAW. Both parties agree that if any paragraph or provision violates the law, is held to be invalid, void or unenforceable, the rest of this Agreement, Range Rules and Regulations, and Consent Form (when applicable) will remain valid and interpreted and applied to give maximum effect to the intent reflected herein.

This Agreement together with the Range Rules and Regulations and Consent Form (when applicable), represent the ENTIRE UNDERSTANDING between the parties and shall supersede any and all previous contracts, agreements, or understandings, written or oral, between the parties concerning the subject matter of this Agreement. This Agreement as well as any signed written amendments shall remain in full force and effect from the date of execution and ever after and shall be applicable to each and every occasion that I or my guests, relatives, or personal representatives enter the RANGE, use its facilities or equipment, or engage in shooting, training, observing or any related activities at the RANGE.

I understand and agree that FORTIS DEFENSE LLC. shall not be liable for any negligence whatsoever including the negligence of its employees, and I hereby, on behalf of myself, my family, invitees, licensees, employees, and permitees; release, discharge and acquit Fortis Defense LLC. for any and all claims for loss, damage or injury of any nature whatsoever to person or property resulting in any way from, or in any fashion arising from, connected with or resulting from occupancy of or use of the RANGE and property, whether caused by negligent acts of Fortis Defense LLC., its agents or servants or otherwise, and I hereby further assume full responsibility for, and risk of, bodily injury or death, while in or upon the RANGE. I further waive for myself and my insurers, any and all right of subrogation that I may have against FORTIS DEFENSE LLC.

I have read this Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement and I FULLY UNDERSTAND AND ACKNOWLEDGE the terms contained within. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS AGREEMENT, and I have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me in consideration of my signing this Agreement which I sign of my own free will. I further intend my signature to be a complete and unconditional release of all liability for FORTIS DEFENSE LLC., and its owners, officers, management, employees, and representatives, to the greatest extent allowed by law.

 

RANGE RULES and REGULATIONS

GENERAL RANGE RULES

1.          TREAT ALL FIREARMS AS IF IT WERE LOADED!

                    - Do not assume this true; Check it, Confirm it

                    - Clear ALL weapons each time you come in contact with them

2.          Keep your finger off the trigger (indexed) until your weapon is pointed down range, your sights are on target, and you are ready to fire your weapon

3.          ALWAYS WEAR EAR AND EYE PROTECTION WHILE ON THE RANGE.

4.          Firearms will be pointed in a safe direction (level and downrange) AT ALL TIMES.

5.          Know what is behind your target, the backstop and beyond at ALL times.

6.          Load and unload firearms only at the firing line.

7.          Closed Toe Shoes must be worn on the range at all times.

8.          NO SMOKING, eating, or drinking while on the Range.

9.          All minors MUST be accompanied by a guardian AT ALL TIMES.

10.        Consumption of alcohol or drugs prior to, or while at the Range, is STRICTLY PROHIBITED.

11.        Always report unsafe or suspicious behavior.

12.        No horseplay of any kind will be tolerated.

13.        Do not rely on your weapons safety

14.        If you are known to be pregnant and/or breastfeeding, you affirm you have received a release letter from your physician allowing you to participate in Range shooting activities.

              You also affirm you have been consulted by your physician on the effects of potential lead exposure and hereby assume all risk to you and your unborn child due to exposure.

15.         The area past the firing line is referred to as the “Red Zone”. Prior to moving forward of the firing line/entering the Red Zone, ALL shooters MUST clear out their firearm and lock the slide or bolt to the open position and lay the firearm with the ejection port facing up. The sooter requesting a clear line MUST verify ALL shooters on the firing line have a cleared firearm. All shooters will leave their firearm on the bench and step away prior to another shooter entering the Red Zone. Once all shooters have cleared the Red Zone, only then are shooters allowed to return to their position and handle their firearm.

16.          You must always be attentive to the Range! Therefore, cell phone calls and text messaging is PROHIBITED while on the firing line. If you need to take a call or text, your firearm MUST be cleared and step away from the firing line.

17.          You agree to keep the facility free from unnecessary wear and tear, nuisance, or garbage while at the Range.

18.          If at any time you do not understand an operation of your firearm, contact the range official or ask another member. DO NOT ASSUME you are operating your firearm correctly.

19.          Any items moved while on the range will be placed back in their original position prior to departing.

20.          Firearms will be kept in a case while transitioning from your vehicle to the Range, and back.

21.          ACTIONS WILL BE OPEN AT ALL TIMES.

22.          Guns will be kept unloaded until you are on the firing line, ready to shoot.

23.          Ensure your firearm is safe to operate. If you do not know, please ask.

24.          If your firearm malfunctions, ensure it stays level and pointed down range while inspecting it. If you are unsure of how to clear your firearm, lay your weapon down, pointed down range, and contact a range official.

25.          If you are using rapid fire, shooting on the move, or firing from prone or kneeling positions or drawing from a holster, ensure any bystanders are clear of the Range prior to engaging in activity. These actions will only be practiced on the "Open Range".

26.          ALL firearms are subject to inspection by FORTIS DEFENSE LLC. staff at ANY time while on the premises.

27.          Do NOT clean, repair, disassemble, or reassemble firearms while on the Range.

28.          You will be required to show proof of legal authority to use ANY/ALL NFA firearms (including suppressors).

29.          No shotguns or automatic rifles or pistols are allowed on the Rifle Range.

30.          No calibers above a .338 are allowed on the Rifle Range.

31.          If shooting steel on the Open Range, NO calibers above 9mm will be utilized.

32.          No rifles/long guns or automatic pistols of ANY kind are allowed on the Pistol Range.

33.          No rapid fire on ANY range except the Open Range.

34.          If using multiple firearms during your range visit, only ONE firearm will be loaded at any given time.

AMMUNITION

35.          If using reloaded/hand loaded ammunition, you assume all responsibility involved and will mitigate all risk to the best of your ability. 

36.          PROHIBITED AMMUNITION: incendiary/tracer.

37.          Shotguns are allowed on the Open Range only with slugs if using our stands or scatter rounds if using your own provided stands and backings.

38.          Unspent ammunition is to be discharged or disposed of in the appropriate containers.

39.          You will pick up all spent brass and place it in the designated area prior to departing the Range.

Fortis Defense LLC. reserves the right to refuse service to anyone at its discretion. The Range may be closed for maintenance, private parties, or special events at the sole discretion of FORTIS DEFENSE LLC.

I am not a prohibited person, nor am I disqualified or prohibited by any local, state or federal law, or court order from owning, using, possessing or handling firearms.

I agree, as a condition of this Agreement, to be familiar with and to obey ALL RANGE RULES and REGULATIONS as adopted or amended from time to time. Upon request, a copy thereof will be provided to me. I shall be responsible for instructing my guests, family, licensees, employees and permitees to follow ALL RANGE RULES and REGULATIONS.

I UNDERSTAND AND ACKOWLEDGE that ANY violation of these Rules and Regulations will be cause for my immediate removal from the RANGE and the premises, and will result in prosecution by FORTIS DEFENSE LLC., and the state and federal authorities to the full extent of the law.  I agree, all damages to the range are my responsibility and will be held financially liable for any damage that occurs due to my negligence or negligent use of a firearm.
