PARTICIPANT WAIVER


AGREEMENT AND WAIVER

This form MUST be completed, signed, and processed by Fastplant Skateboarding to enable you to participate in any events organised and run by Fastplant Skateboarding. If you are under 18, a parent or legal guardian MUST sign this form and their signature witnessed by another person over the age of 18. By signing this agreement, you agree and accept Fastplant Skateboarding’s rules and regulations including following safety protocols, which includes wearing a helmet. Please complete your personal details and ensure the form is properly completed and signed.

DEFINITIONS

“Activities” means skateboarding, physical activities, sports, fitness and related activities.

“Media” means photography and video recordings

“Fastplant Skateboarding” means Taniah Meyers and Mikayla Senior operating under the business name Fastplant Skateboarding 28 156 539 686

“You” means the Participant, the Parent/Guardian where applicable, or both as context permits.

WAIVER RELEASE, DECLARATION, AND INDEMNITY DEED

Fastplant skateboarding will provide the activities to you in part in consideration for you agreeing to this agreement.

All persons must complete this document prior to participation.

Before you participate in the Activities, you must ensure that you understand the risks involved in participating in the Activities. You acknowledge and agree that the Activities are inherently dangerous and carry the risk of serious personal injury, death, or property damage. You acknowledge and agree that you understand the risks involved in participating in the Activities and voluntarily participate in the Activities at your own risk.

By signing this agreement, you agree that the following is true and correct, and that Fastplant Skateboarding has relied on my answers in allowing me to participate in recreational skateboarding activities. 

By signing this agreement, You acknowledge and agree that You understand that You and each participant in the Activities, will be engaging in activist involving a real risk of serious injury, physical or mental injury (including aggravation, acceleration of a disease) even death from various causes including but not limited to equipment failure, accidents with other participants, spectators, course or weather conditions or other causes. You voluntarily accept all risks necessary flowing from your participation, which could result in loss of life or injury.

(Release) By signing this agreement you hereby release Fastplant Skateboarding and all persons or corporations associated directly or indirectly with the conduct of the activities from all demands, claims, or other proceedings in relation to any injury or death or loss or damage to personal property in connection with your participation in the Activities with Fastplant Skateboarding, including liability for their negligence and negligence of others. This release and indemnity continue forever and binds your heirs, executors, personal representatives, and assigns.

(Indemnify) You agree to indemnify each release and demand, claim or proceeding that may be brought in connection with your participation in the Activities with Fastplant Skateboarding.

(Insurance) You acknowledge and agree that the fees for the Activities do not include personal accident insurance cover. You are responsible for your own personal accident, medical and/or life insurance and any or expenses in the event of injury or death.

(Physical Abilities) You must be medically and physically fit and able to participate in the Activities. You agree and represent that you have NO injuries, physical restrictions, disabilities or predispositions to sickness or injury that may affect your participation in the Activities.

(Protective Equipment) You agree to wear your own suitable helmet, (either supplied by Fastplant Skateboarding or self-supplied) enclosed skate shoes or runners plus a tee shirt and shorts as the minimum protective equipment at all times whilst participating in the Activities.

(Medical treatment) You agree and consent to any medical, first aid treatment that Fastplant Skateboarding deems reasonably necessary during or after the Activities.

(Personal Property) You agree that you are solely responsible for your personal property during the Activities.

MEDIA

You hereby consent and permission for Fastplant Skateboarding, to use any Media featuring you for publication on Fastplant Skateboardings, marketing and promotional material, not limited to their website, social media platforms, printed material and on any other website or in any other media Fastplant Skateboaring may select for publication.  You hereby grant permission to use your name, image, and likeness in direct connection with the Activities for promotional broadcasting or reporting purposes in any and all manner and medic, unless restricted by Privacy Legislation.

You assign (including as a present assignment of futures copyright) and transfer to Fastplant Skateboarding all right, title and interest (including intellectual property rights) in and to the Media, free from any encumbrances or other security interests, including all rights, claims, demands, causes of action, rights of action past, present or future arising out of, or in relation to, the Media.

You release Fastplant Skateboarding against all claims, actions, demands, and liabilities in relation to the creation of Media, which you may have against Fastplant Skateboarding.

AGREEMENT ACKNOWLEDGEMENT

You agree that the terms and conditions of this agreement are contractual by nature, are intended to have a legal effect and are not a mere recital or warning.  Fastplant Skateboarding is not responsible for your decision to participate in the Activities, and you have agreed to participate in the Activities under your own free will and there has been no coercion or inducement by Fastplant Skateboarding.  

This agreement embodies the entire agreement between the parties and supersedes any prior negotiation, conduct arrangement, understanding or agreement, express or implied, in relation to the subject matter of this agreement.

You acknowledge that your registration is not transferrable to any other persons. You acknowledge that you have read and understood the agreement and contents and you complete it at your own free will.

By signing the below, the Participant, or if the Participant is not 18 years of age, the Participant’s Parent or Guardian on their behalf, agrees to the terms and conditions of this Agreement and Waiver.

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
