Pre-Exercise Questionnaire:

This Pre-Exercise Questionnaire does not provide advice on a particular matter nor does it substitute for advice from an appropriately qualified medical professional. No warranty of safety should result from its use. The pre-exercise questionnaire in no way guarantees against injury or death. The aim of this waiver is to identify those individuals with a known disease, or signs or symptoms of disease, who may be at a higher risk of an adverse event during physical activity/exercise. An adverse event refers to an unexpected event that occurs as a consequence of an exercise session, resulting in ill health, physical harm or death to an individual. The questions in the questionnaire are to be self administrated and self evaluated by yourself the client. You acknowledge that as the client you believe that to the best of your knowledge, all of the information you will provide within this waiver will be correct & true.


COVID19:

Please understand that despite all the precautions that you, other members, and/or Freshstart 24/7 Gym Pty Ltd may take, we cannot guarantee your health or safety, and you may still be exposed to COVID-19, including through interactions with other individuals who have COVID-19.  By executing this release and gaining access to the facility, you, on behalf of yourself, your heirs, beneficiaries, representatives, successors and assigns: (1) voluntarily assume all risks associated with any exposure to COVID-19, including, but not limited to suffering any type of medical condition, illness and, potentially, death; and (2) knowingly and voluntarily waive, release, covenant not to sue, forever discharge, indemnify, and hold harmless Freshstart 24/7 Gym Pty Ltd, its parents and subsidiaries and their respective officers, directors, employees, contractors, agents, representatives, successors and assigns (“Released Parties”) from any and all liability, damages, losses, suits, demands, causes of action to the fullest extent permitted by the laws of this state, or any other claims of any nature whatsoever, arising out of or relating in any way to your use of the facility and your potential exposure to COVID-19.


Client Acknowledgement:

I acknowledge that physical activity/exercise at Freshstart 24/7 Gym Pty Ltd may be dangerous, and by participating in the recreational activities, I am exposing myself to certain risks and I may suffer loss, bodily injury or damage to my property. The conditions in which the activities are conducted may vary without warning. I acknowledge that my personal property may be lost or damaged as a result of the negligence or breach of contract of Freshstart 24/7 Gym Pty Ltd. I assume the risk of and responsibility for any injury, death or property damage resulting from my participation in physical activity / exercise at Freshstart 24/7 Gym Pty Ltd. I hereby release Freshstart 24/7 Gym Pty Ltd and any of its employees, contractors, associated companies or trusts, agents or affiliates from any liability, now or in the future arising from any medical or physical conditions I may have, whether or not they are known to me prior to participating in physical activity / exercise at, or visiting Freshstart 24/7 Gym Pty Ltd and / or declared on this form.
