Please read, understand, and accept the following terms. By doing so, you agree that you, your children, and your guests will comply with all the guidelines stated below and follow the directions provided by FunZone Indoor Playground personnel.

Liability Waiver and Release Agreement (“Agreement”) is made effective by and between:

Familium Holding ltd / Funzone Indoor Playground and the undersigned participant(s).

The purpose of this Agreement is to exempt the Company and its officers, directors, employees, contractors, agents, successors, landlords from and indemnify them against liability for personal injury, property damage, or economic loss, mental condition which may arise out of the participation of the Participant, their children and guests in using the Company’s playground facilities or inside and outside services and activities provided.

In consideration for allowing me, my children and my guests to enter the play area, the facility and to use the equipment, I agree that I will be bound to the following:

A. Assumption of Risks: I expressly assume the risk of and take full responsibility for any personal injury, mental condition, death, property damage, and economic loss suffered by myself or my children and my guests because of the risks inherent in the playground activities provided by the Company. I acknowledge that I, my children and my guests are voluntarily participating in the playground activities provided by the Company, which may include the use of playground facility, play equipment, slides, balls, and toys and any related activities/services.I acknowledge that I am aware of the risks inherent in the playground activities provided by the Company, which may include but not limited to slipping, tripping, and falling, collision with other participants or malfunctioning equipment. I acknowledge the playground equipment, slides, balls, and toys may be subject to wear and tear and the Company does not represent, or guarantee that the playground equipment, the facility, slides, balls, and toys are always free from defects.I understand that children must always be supervised by a parent or guardian. My children, my guests and I are in good health and free from any physical, emotional or medical conditions that could interfere with their safety or the safety of others. I understand that I am responsible for my child, my guests and my own safety while attending FunZone Indoor Playground. I understand that if I am pregnant, I should not use the play area nor the equipment.

B. Release of Claims: I agree to waive any claim, now or in the future, against the Company and the Indemnified Parties, including without limitation, the Company’s officers, directors, employees, contractors, agents, successors, landlords and assign, for any personal injury, emotional condition, death, property damage, or economic loss suffered by myself, my children and my guests arising from the participation in the playground activities/services provided by Funzone Indoor Playground and Familium Holding ltd.

C. Indemnification: I agree to indemnify and hold harmless the Company and the Indemnified Parties from all kinds of claims, lawsuits, actions, damages, losses, costs, expenses, reputation risk/damage and liabilities including, without limitation, reasonable attorneys’ fees and costs, arising from any personal injury, death, emotional condition, property damage, or economic loss suffered by myself, my children and my guests arising from the participation in the playground activities/services provided by the Funzone Indoor Playground and Familium Holding ltd. (The term indemnified parties includes, but is not limited to, Funzone Indoor Playground, Familium Holding LT D, their officers, directors, employees, agents, contractors, representatives, landlords, succesors and assigns...)

D. Medical Emergencies: I agree that in the event of any personal injury, illness, mental condition or other medical emergency, I will call 911 or otherwise request emergency assistance, as needed. I agree that in such an event, Funzone Indoor Playground staff and owners can intervene and deliver first aid support and call 911 and/or request any other emergency assistance, as needed and that any medical costs incurred will be my responsibilityand that I am liable for any medical expenses.

E. Supervision of children by Funzone Indoor Playground staff: I understand and accept that Funzone Indoor Playground does not provide staff supervision during operating hours. It only provides supervision for a specific extra fee and for the after-school program and summer camp services (indoor and outdoor activities and services). However, I acknowledge that such supervision does not eliminate the need for my own vigilance and responsibility for myself or my child. I hereby fully release and discharge, and hold harmless Funzone Indoor Playground and Familium Holding ltd, its owners, employees, agents, and representatives, from any and all claims, liabilities, damages, or expenses arising out of or in connection with the participation of myself or my children in the activities/services done inside and/or outside of the facility provided by Funzone Indoor Playground and Familium Holding ltd, including but not limited to, personal injury, physical illness, mental illness, reputation risk/damage or property damage. I agree to indemnify and hold harmless Funzone Indoor Playground and Familium Holding ltd, its owners, employees, agents, and representatives, from any and all claims, liabilities, damages, or expenses, including reasonable attorney's fees, arising out of or in connection with my actions or the actions of my children while participating in the activities or services provided by Funzone Indoor Playground and Familium Holding ltd.

F. Photography & Social Media Consent. By signing below, I understand and agree that:

-Photo/Video Capture: Indoor Playground Staff or their authorized representatives may photograph and/or film my child(ren) and me during our visit.

-Usage Rights: Such photos/videos may be used for promotional purposes — including, but not limited to, print advertising, social media (Facebook, Instagram, Twitter, TikTok, etc.), website content, email newsletters, and digital advertising.

-No Compensation: I acknowledge that I will receive no payment or other compensation for any use of these images or footage now or in the future.

-Waiver of Rights:I waive any right to inspect or approve the finished product or the specific use to which these images may be applied. I also waive any claim, now or in the future, related to defamation, invasion of privacy, or infringement of moral rights.

-Revocation Period: I understand that I can withdraw this consent at any time before the images are published. To do so, I must notify Indoor Playground Staff in writing. Withdrawals made after publication will not retroactively remove already-used images.

-Duration of Consent: This consent remains valid indefinitely, unless revoked in writing as described above.

G. Video Surveillance Notice:

- Our facility is monitored by video surveillance in all public play and common areas for safety, security, and quality assurance. No audio recording is made. By signing below or entering our premises, you acknowledge and consent to this recording. Footage may be used if necessary to address incidents, disputes, or suspected false information.

The parent/legal guardian of the participant, as well as their guests and anyone accompanying them, agree that this waiver and release of liability shall remain in full force and effect for all future visits to FunZone Indoor Playground. By signing this waiver, the parent/legal guardian of the participant as well as their guests and anyone accompanying them, acknowledge that certain legal rights, including the right to sue, are being waived. This agreement applies to the participant, their child(ren), and any other minors under their care or accompanying them during participation at FunZone Indoor Playground. The parent/legal guardian further agrees that it is their responsibility to notify FunZone Indoor Playground of any changes to their contact information or circumstances that may affect this agreement.

By signing this waiver, the parent/legal guardian of the participant acknowledges and agrees that FunZone Indoor Playground collects personal information, including but not limited to the participant’s name, contact information, and emergency contact details, for the purpose of processing this waiver and ensuring safety during visits. FunZone Indoor Playground is committed to protecting the privacy and confidentiality of personal information in compliance with applicable privacy laws, including PIPEDA. Personal information will only be used for the purpose of maintaining records of participation, communication regarding safety or emergencies, and providing services related to your visit. Personal data will not be shared with third parties without prior consent, except where required by law. By signing this waiver, you consent to the collection, use, and storage of personal information as described above.

I confirm that I am the parent, legal guardian, or an authorized adult accompanying the participant at Funzone Indoor Playground. I have read, understood, and agree to the terms and conditions outlined in this agreement. I further declare that the information provided is true and accurate to the best of my knowledge. If I am not the parent or legal guardian, I confirm that I have received permission from them to accompany the child and assume full responsibility during their visit to FunZone Indoor Playground. 

Providing false information on this waiver, including name, contact details, or signature, does not release the signer from responsibility for adhering to the waiver’s terms. Video surveillance may be used to verify the identity of guests in case of disputes or incidents.
