Please read this document carefully. It contains important information about your upcoming Georgia Conservancy Trip and must be signed by all participants. If the(Participant) is a minor, at least one parent or deemed guardian (parent and guardian being referred to below as Parent) must also sign, to reflect agreement to these terms and conditions on his or her own behalf and on behalf of the minor participant.

In consideration of the services of the Georgia Conservancy, I, Participant (adult), for myself and on behalf of a minor Participant for whom I sign below, acknowledge and agree as follows:

Please read this document carefully. It contains important information about your (or your minor's) upcoming trip with The Georgia Conservancy, Inc. (the “Georgia Conservancy”) described below (the “Georgia Conservancy Trip”) and must be signed by all participants (each a “Participant”). If the Participant is a minor, at least one parent or deemed guardian of the Participant (“Parent”) must also sign, to reflect agreement to these terms and conditions on behalf of any minor Participant. In consideration of, and as a condition to Participant's participation in the Georgia Conservancy Trip, I, for myself and on behalf of a minor Participant for whom I sign below, acknowledge and agree as follows:

I fully understand and acknowledge that activities associated with the Georgia Conservancy Trip include inherent risk and danger. Such activities may include, but are in no way limited to, caving, paddling, hiking, swimming, games/activities, camping, cooking, service work, trail restoration, and transportation to/from the Georgia Conservancy Trip. These activities may result in injury or illness including, but not limited to, bodily injury, disease, strains, fractures, partial or total paralysis, death and/or other ailments. I acknowledge and agree that at all times over the course of the Georgia Conservancy Trip, I will be responsible for my own health and safety. I further acknowledge that risks and dangers may arise from foreseeable and unforeseeable causes including, but not limited to: service work; tool use; actions, inactions, and decisions of other participants (including Georgia Conservancy’s trustees, supervisors, representatives, volunteers, officers, agents and employees [collectively, “Representatives”]); river conditions; weather; temperature; lightning; uneven terrain; falling trees and rocks; swimming; food preparation; poor trail markings; disorienting terrain; delays in, or unavailability of, medical care in case of an emergency; wildlife and domestic animals; poisonous/toxic plants, insects, and reptiles; mechanical and equipment failures; and other hazards and dangers that are encountered during outdoor activities.

In consideration of my participation in the Georgia Conservancy Trip, I (on behalf of myself and my heirs, representatives, executors, administrators and assigns) hereby: (i) assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or omission of the Georgia Conservancy, its Representatives, or by any other person, and (ii) agree to release, waive, discharge, not sue, hold harmless, defend and indemnify the Georgia Conservancy and its Representatives from any and all claims, causes of actions, demands, losses or costs of any nature which may arise out of my participation in the Georgia Conservancy Trip. I have read and understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for any act, omission, or negligence, whether active or passive, of Georgia Conservancy and its Representatives during the course of the Georgia Conservancy Trip.

I further understand that there is currently a global pandemic associated with the spread of the virus SARS-CoV-2 (and derivatives thereof), which causes the disease “Covid-19” and leads in many cases to serious illness, personal injury, permanent disability and death, and that Covid-19 can be contracted through direct and indirect contact with symptomatic and asymptomatic persons and their bodily fluids. I understand that other participants (including Georgia Conservancy Representatives) are not screened for Covid-19 or any other disease, that I will be in close proximity to the other participants and other third parties during the course of the Georgia Conservancy Trip, and that federal, state and local governments and health agencies are recommending numerous precautionary steps, including social distancing, to limit the spread of this disease. I further acknowledge that my participation in the Georgia Conservancy Trip may increase the risks presented by COVID-19 for myself and my family. By signing this Waiver and Release of Liability, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 during the course of the Georgia Conservancy Trip, and that such exposure or infection may result in serious illness, personal injury, permanent disability and/or death. However, I assume these risks and accept sole responsibility for any injury to myself, or any other member of my immediate family as a result of a COVID-19 infection. Further, I hereby release, covenant not to sue, discharge, and hold harmless Georgia Conservancy and its Representatives from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of a COVID-19 infection occurring before, during, or after participation in the Georgia Conservancy Trip.




Participant and/or Parent authorize the Georgia Conservancy and/or parties designated by the Georgia Conservancy to use photos, videos, recordings, statements and written reports which may include the Participant and/or minor/s, in any manner deemed appropriate by the Georgia Conservancy, for advertising, display, educational or other use.
