Collectively, all of the above people or businesses entering this Agreement will be referred to as the "Parties."

Purpose of the Agreement

Client wishes to hire Vendor to provide services relating to Client’s  as detailed in this Agreement. Vendor has agreed to provide such services according to the terms of this Agreement.

BOUNCE HOUSE RENTAL AGREEMENT AND GENERAL RELEASE + RENTAL RULES (READ CAREFULLY)

This Bounce House Rental Agreement (“Release”), made effective upon signing, is between Hop Haus LLC, a Minnesota limited liability company, (“Hop Haus”) and Renter (“Customer”), collectively referred to as the “Parties.” The Parties agree as follows:

Equipment. Customer would like to rent a bounce house and any associated equipment required for the setup and operation of the bounce house (all equipment and bounce house collectively referred to as “Equipment”), as specified in the order information provided above.

Rental Fee. Payment for the Equipment rental fee (“Rental Fee”), and deposit (“Deposit”) are due in full in advance of the commencement of the Rental Period. The deposit of $100 is to be made at the time of booking and the remaining balance for the rental fee is due 3 days prior to the event date. The Deposit is non-refundable but can be applied to a rescheduled date if it's within a year of the original date booked event date. No refunds will be made after the Equipment has been delivered. Payments may be made via credit card. Customer agrees to pay Hop Haus any reasonable costs that Hop Haus incurs in attempting to collect amounts that Customer owes it pursuant to this Agreement, including reasonable attorneys’ fees.

Rental Period. The rental times and dates, as specified in the order information above, are approximate and run from delivery of the Equipment to the pick-up of the Equipment by Hop Haus (“Rental Period”).

Delivery. Hop Haus will deliver the Equipment to the street address specified by Customer in the order information above (“Property”) for delivery, at the approximate specified times. Customer grants Hop Haus the right to enter such property for delivery, any required set up, and for pick-up at the approximate specified times. Customer is responsible for ensuring a clear pathway, from the parking area to the Equipment setup area, is available for the Hop Haus delivery team during the delivery and pickup times. 

Hop Haus will make its best effort to ensure that delivery of the Equipment takes place on or prior to the event’s start time on the start date. Customer acknowledges that the Hop Haus delivery team may arrive for delivery on or up to 4 hours ahead of the rental start time. An early delivery will not impact the rental end time. Customer acknowledges that rental end time is approximate, and the Hop Haus delivery team may arrive for pickup as early as the rental end time or up to 2 hours after the rental end time. Customer is responsible for Equipment and all the equipment until it is picked up by our delivery team.

Please Note: The Equipment will not be set up if there are high winds (above 15 mph), there is a threat of thunderstorms, lightning, there is other inclement weather present, there is no one over the age of (18) eighteen present, no flat/level grass area or any other reason that would deem the operation of the Equipment unsafe. If it is raining at the time of the delivery, and delivery does not take place, another date may be booked if available, or a credit in the amount of the Rental Fee will be given to be used within 12 months. The deposit that was paid will be applied to the future event. If the delivery team is unable to deliver or safely setup the Equipment for any reason, but the delivery process has begun, no refund or credit will be provided. Hop Haus' is transparent and direct about the type of area and surface needed for the unit in advance so the Customer is responsible for ensuring the unit will be a good fit prior to the coordination and delivery. 

Cancellation: If Customer’s plans change for any reason, Customer must provide Hop Haus at least 48-hour notice.  The fees already paid will be converted into a credit available for use within 12 months from the first date of the Rental Period (no refunds are given). If the credit is unused, it will be forfeited in full. The payment will be forfeited for cancellations less than 48 hours from first date of the Rental Period.

Return. In the event the Equipment is not returned for any reason, including theft, Customer is obligated to pay to Hop Haus the full replacement value of the Equipment, plus any and all incidental costs associated with the recovery of the Equipment by Hop Haus. Customer agrees to keep the Equipment in their possession for the duration of the Rental Period, until Hop Haus picks up the Equipment. Customer may not rent, sell, or remove the Equipment from the Property.

The Equipment must be returned clean, dry and damage-free, determined at the sole discretion of Hop Haus. In the event the Equipment is not returned in dry, clean and undamaged condition, including but not limited to being free from; tears, rips, permanent markings, holes, and/or deformities of any kind, Hop Haus will charge a cleaning fee to the card on file of $350 and may require additional payment to bring the Equipment back to the condition in which it was delivered.

Inspection. Customer rents the Equipment on an "as is" basis. Customer acknowledges that it has inspected the installation of the Equipment and will inspect the Equipment prior to use, making sure to let Hop Haus know of any perceived damage prior to their usage. Customer acknowledges receipt of the Equipment and that it is in good working order.

Operating Procedures. For inflatable Equipment, Customer agrees to provide one electrical outlet rated at 115 volts with 20 amperes capacity per motor unit within 100 feet of each unit. If the blower stops or the air pressure is low, Customer shall remove all users immediately, and check the problem. Air tubes in the rear of the unit must be tied securely to the blower or tied off to prevent air from escaping. The electrical cord must be plugged into an outlet and be the only item operating on that electrical circuit. Customer shall confirm the functionality and capability of circuit breakers prior to the delivery of Equipment. Customer is subject to an additional charge of $75.00 for all service calls due to electric issues, including but not limited to, faculty circuit breakers or inadequate electrical outlets. Hop Haus rents out a Generator if there is no electricity within 100 feet.

The Equipment must be operated over a smooth, compatible surface such as grass or hard top surface. The Equipment may NOT be operated on any rough surface, such as rocks, brick, glass, or any jagged objects. The Equipment MUST BE properly anchored prior to use. The Equipment will be anchored initially by Hop Haus, or its representatives, and the anchors MUST NOT be removed during the Rental Period. If stakes are not allowed to be used at the Property, Customer shall order sandbags from Hop Haus at an additional cost of $10.00 per sandbag each to ensure appropriate anchoring of the Equipment.

Safety Procedures. Customer will read all safety instructions prior to use. Customer agrees to operate the Equipment in accordance with the safety instructions. Customer understands that Hop Haus will not provide any operators with the Equipment and that Customer is solely responsible for the correct and safe operation of the Equipment. Customer must keep the Equipment and all related equipment away from swimming pools or water and Customer agrees not to operate any electrical equipment near water.

Before entering the unit, all users must remove their shoes, eyeglasses, buckle belts, and any sharp objects. Never play, jump, or enter a partially inflated/deflated inflatable unit. Never allow users to climb or play on the outside or inside walls of the unit, columns, netting, or roof of the unit. Do not plug or unplug the motor repeatedly as this will cause the unit to burn and Customer will be responsible for any resulting damage. Always have an adult present, who has reviewed and understands both this Agreement and the rules posted in or around the unit. Do not allow horseplay on, in or around the unit. Never allow more users than the maximum number of users per age group as directed within this Agreement and on the unit itself. Only children of the same age group are to play on the unit at the same time. The maximum number of users in each age group is as follows:

Wind or Rain Operations. If winds exceed 15 mph, lightning occurs, or it begins to rain please clear all users from the inflatable. After all users are out, unplug the blower from the power outlet, and wait for the weather to subside. After the weather has passed, wipe the unit and motor dry, and re-inflate the unit. Wait for the unit to fully inflate, and then use towels to dry the inside of the inflatable to avoid any slipping. Please keep in mind the inflatables become very slippery when wet. Hop Haus knows everyone wants to get back to playing, but safety is always the priority. Leaving inflatable equipment up in strong winds, or thunderstorms could cause the unit to blow away, even if the Equipment is anchored. Remember Customer is responsible for the unit during the Rental Period. Hop Haus cannot guarantee weather conditions. In the event weather conditions do not allow for safe use of the Equipment, or if Customer decides not to use the Equipment for any reason, Customer will not be entitled to any refund whatsoever.

Prohibited Actions. Customer shall never place a hose or water on the Equipment unless authorized by Hop Haus. Using a hose or sprinkler on Equipment not designed for use with water will be charged a $350.00 cleaning fee. Customer shall never use, or permit the use, of silly string or similar items, such as, but not limited to, food, drinks, confetti, face paint, foam, trash, or water in or around the Equipment at any time. Silly string and similar objects will cause permanent damage to the Equipment and Customer will be responsible for the full replacement value ($3,000) of the Equipment or $350.00 cleaning fee if the Equipment is determined not to be permanently damaged.

Assumption of Risk. Customer acknowledges there is a risk of injury or damage arising out of the use of the Equipment and related equipment. Customer agrees to follow all safety instructions for the correct and safe operation of the Equipment. Customer will not permit the Equipment to be operated by anyone who has not received proper safety and operating instruction from Customer. If the Equipment is in need of repair, Customer will not allow any person to use the Equipment and will notify Hop Haus immediately.

Disclaimer of Warranties. Hop Haus makes no warranty of any kind, either express or implied, as to the condition of or performance of any of the Equipment and Customer agrees to immediately cease use of the Equipment and contact Hop Haus at 320-979-0294 if any of the Equipment develops any indication of defect of improper working condition. Customer agrees to use the Equipment at Customer’s own risk. Customer will provide clean and properly working Equipment and if the Equipment is not working immediately call the Hop Haus office 320-979-0294 and Hop Haus will replace the defective Equipment or issue a full refund for the item not working properly.

Hold Harmless. Customer agrees that it will fully defend, indemnify, and hold harmless Hop Haus, its owners, members, employees, contractors, agents, and representatives (“Hop Haus Parties”) from any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever (including without limitation all claims for monetary loss, property damage, equitable relief, personal injury and/or wrongful death), whether brought by an individual on their own, on behalf of a minor, or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, or in any way related to Customer’s actions or omissions or the actions or omissions of those who Customer is responsible for. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgments, awards, decrees, attorneys' fees, and related costs or expenses, and any reimbursements to Hop Haus for all legal fees, expenses, and costs incurred by it.

LIMITATION OF LIABILITY.  ABSENT ITS WILLFUL OR INTENTIONAL MISCONDUCT, HOP HAUS, ITS OWNERS, REPRESENTATIVES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, CONTRACTORS OR OTHER ASSOCIATED THIRD PARTIES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR RESULTING FROM CUSTOMER’S RENTAL AND USE OF THE EQUIPMENT AND OTHER EQUIPMENTS AS STATED IN THIS AGREEMENT. REGARDLESS OF THE FORM  OF ACTION, WHETHER IN CONTRACT, TORT OR OTHERWISE, INCLUDING INJURY OR DEATH, CUSTOMER AGREES THAT THE MAXIMUM AMOUNT OF DAMAGES THAT IT IS ENTITLED TO, IN ANY CLAIM AGAINST HOP HAUS, ITS OWNERS, REPRESENTATIVES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, CONTRACTORS OR OTHER ASSOCIATED THIRD PARTIES ARISING OUT OF OR RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT, WILL NOT EXCEED $250.00, AND ANY CLAIM BROUGHT AGAINST HOP HAUS PARTIES MUST BE INITIATED WITHIN SIX MONTHS OF THE FACTS GIVING RISE TO THE CLAIM.

Governing Law, Dispute Resolution, and Venue. Any action brought by any party hereto shall first be submitted to mediation, and if not resolved, shall be brought within Hennepin County, Minnesota state courts, and interpreted under Minnesota law.

Assignment. Customer may not assign this Agreement or any part of this Agreement without the written consent of Hop Haus. In the event of a permitted assignment, such assigning Party will require its assignee to assume all of its obligations hereunder in writing.

Modification and Amendment. No modification, or amendment of this Agreement shall be binding unless executed in writing and signed by both Parties.

Enforceability, Severability, and Reformation. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable and either party may ask a court to modify the invalid or unenforceable provision to make it valid and enforceable and as close to the intent of the original provision as possible.

 

RENTAL RULES: READ CAREFULLY

 

Below are the safety rules from HOP HAUS. These rules must be followed for user's safety. The renter is ultimately responsible for the injuries that happen on the inflatable.

1. There must be one person appointed to supervising the device at all times. Adult supervision is required at all times while the inflatable is in use.

2. The inflatable should not be operated if wind exceeds 15 mph, or in rain, snow or lightning conditions, or temperature of less than 40 degrees.

3. All extension cords and straps should be placed in such a manner that no one can trip on them. Also, no electrical cords should run through puddles or near a pool.

4. The operator should let the riders aware of the posted warning sign on the inflatable device. The rules on the sandwich board must be followed at all times.

5. All riders must remove their shoes, eyeglasses and any other hard or sharp objects in their hair or clothing. ABSOLUTELY NO face paints, party poppers, colored streamers, or silly string to be used either on or near the inflatable. (Please note these products will cause irreparable damage to the inflatable and you will be liable for replacement for $4,500.)

6. Be sure children are not holding or leaning on the side walls.

7. Maximum weight per passenger is 220 lbs for all inflatable units. 

8. Operator should observe the users of the inflatable device at all time.

9. Divide children by ages and give each group their own time to bounce, jump or slide. No children 3 year old and under, or less than 42" tall play on any inflatable device. Persons with mental or physical impairment should not be allowed to use any of the inflatable amusement devices.

10. If the inflatable is deflated accidentally (i.e. power outage), have all children exit orderly through the door, or emergency roof/ceiling release, or alternate exit. Do not panic, you will have time to get everyone out safely!

11. Operators and attendants shall incorporate the use of whistles or other devices or signal equipment and take appropriate action at the first sign of misbehavior or violation of posted rules.

12. NO smoking in or around the Inflatable.

13. Climbing, hanging, or sitting on walls is NOT allowed.

14. Ensure children are not pushing, colliding, fighting, or behaving in a manner likely to injure or cause distress to others.

15. No pets, toys, or sharp instruments in the inflatable at anytime.

16. Do not allow anyone to bounce on the front safety step.

17. Do not allow anyone to be on the inflatable equipment during inflation or deflation, as this is highly DANGEROUS and could result in death.

***In the event the blower stops working, please ensure all users get off the inflatable immediately. Check your breaker(s) and make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. In the event it overheats, or loses power, switch the blower off at the mains, then switch it back on again 1 or 2 minutes later, and it should restart. If it does not, inform us immediately at 320-979-0294.

This rental equipment has been received in good condition and will be returned in the same condition (ordinary wear and tear accepted).

Customer assumes all responsibility for injuries to persons or damages to property, and agrees to release and hold Hop Haus LLC harmless for any and all claims, of whatsoever nature, arising out of use of the rental equipment while in his/her custody. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, Customer herby agrees to a limit on any damages claimed by Customer to the total paid to Hop Haus LLC for the rental.

Customer agrees to reimburse Hop Haus, LLC for all attorney fees, an amount not less than 75% of all sums due, court cost and expenses incurred by Hop Haus, LLC to enforce collection or to preserve or enforce rights under this contract.

Customer agrees not to loan, sublet, or otherwise depose of equipment.

Customer agrees to pay in full the cost, including labor, for all damages to rental equipment.

If the inflatable equipment is lost, stolen, stained, or damaged beyond repair, the renter agrees to pay $4,500.00 (four thousand five hundred dollars and 0 cents) for a replacement inflatable. The damaged inflatable will remain property of Hop Haus LLC.

Customer agrees to ensure that all users (and users’ guardians) of the rental equipment sign liability waivers.

Hop Haus LLC shall not be held responsible for any type of unfavorable weather conditions, to wit, rain or high winds, electrical outages, hurricanes or other acts of God.

This contract and agreement shall be in accordance with and governed by the laws of the State of Minnesota. And if, in fact lawsuit is brought, it shall be filed in Hennepin County, in the State of Minnesota.

Maximum occupancy for each group that should play in the bouncer at one time is: For 16x16 bouncer, maximum of 6-7 adults less than 220 lbs and no more than 7-8 children at once.

Hop Haus LLC shall not be held responsible for any grass damage.

For safety reasons, stakes & sandbags are used to support inflatables. Customer is responsible for selecting location, and any damage incurred to sprinklers, pipes, cable etc. will be customer’s responsibility.

The person(s) or organization renting this Equipment from Hop Haus LLC will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever.

 

READ IF YOU REQUESTED BALLOONS: 

By signing the Terms & Conditions, the Client acknowledges that some balloon decor may be affected by temperature and humidity, something that Hop Haus can not be held liable for. Hop Haus will not be held liable for the reaction of any balloon decor to the weather or uncontrollable acts of nature including but not limited to rain, wind, or extreme heat. Hop Haus NEVER guarantees perfect results for any installation done outdoors or in these uncontrollable situations.

• In the event there is a situation that prevents a Creative Director from installing the balloon decor in the original location at a venue, the Creative Director is able to move the balloon decor to that location 

(still on site at original address) and attempt to complet the installation.

• It is the Client’s sole responsibility to have an alternate location available and ready in the event theoriginal location is not able to be utilized. Failure to do so will cause the payments to be forfeited and considered non-refundable.

• Hop Haus will however, not be able to guarantee a quality and perfect installation due to last minute setup changes, but will promise to do everything possible to ensure it is as close to perfect as physically possible.

•The Client is responsible for locating an alternate location to setup as well as ensure access to Hop Haus.

• If dangerous weather or a natural disaster occurs that causes the venue to close and prevents the event from taking place, the Client may reschedule the installation for a different date, within the next 365 days.

• Dangerous weather and natural disasters are only accepted if acknowledged by a local state/government official.

• If the Client cancels the event due to rain or other bad weather, not designated as “dangerous weather”or “natural disaster”, the Client understands that the payments will be forfeited and considered non-refundable. The payments will not be transferable.

• Hop Haus agrees to be present and ready for installation even if it is raining, snowing, or displaying any othertype of “irregular” weather, with the exception of road closures.

Pricing & Fees

All pricing regarding the entire order including but not limited to; retainer fee, delivery fee, installation fee, striking fee, cancellation fee, etc. will be documented during the booking stage. All payments made towards any and all of these charges are non refundable. Please make sure you have communicated the necessary details to any other vendors you may be working with prior to booking with Hop Haus. 

Striking Fee - Must be paid for prior to the event and documented. This means that we will dispose of the balloons for you. Please let Hop Haus know if you'd like this to be added to your invoice. 

Display & Promotion

By signing the Terms & Conditions, the Client agrees that Hop Haus may use the decorated display including video recordings and photographs for usage on the official Hop Haus website, including but not limited to social media networks, flyers, billboards, displays, commercials, and any other form of promotional marketing.

All designs/displays installed by Hop Haus are the property of Hop Haus, in return Hop Haus reserves the right to utilize any/all photographs and video recordings as deemed necessary, for promotional use. This also includes any personal photographs or video recordings taken by the Client or the Clients’ guests. Hop Haus reserves the right to include the official Hop Haus logo on any personal photographs or video recordings made, from a Hop Haus installation. Hop Haus also reserves the right to refuse to use any photographs or video recordings made by any of the following, including but not limited to; Hop Haus, the Client, the Clients’ guests, photographers, videographers, venu personnel, or any other vendors.

Vendors & Event Coordinators

Hop Haus is focused on making balloon decor that stands as an unforgettable piece in your event. Our main focus is providing exceptional service and installing a quality design. We strive for perfection and in return, we expect all vendors or event coordinators who are working together to create this unforgettable event, to expect nothing less than perfection as well. With that being said, all vendors and event coordinators can be referred to the Client.

• Hop Haus is not responsible for assisting other vendors in tasks related to their designated field.

• Hop Haus is responsible for maintaining a safe and healthy work space, installing the balloon decor, striking and disassembling if applicable, and cleaning up the workspace utilized by Hop Haus. 

• Hop Haus is not responsible for poor services rendered by other vendors. It will be the Client’s responsibility to settle any discrepancies with the vendors directly.

• Hop Haus will not refund any payments made due to other vendors hindering or becoming detrimental to the progress and quality of the installation.

• Hop Haus expects any Client working with an Event Coordinator to ensure their coordinator is abreast of the installation arrangements prior to the day of the event.

Independent Contractor

The Terms & Conditions are not to be misconstrued as an employment agreement in any way. Hop Haus and its Creative Director, as well as the team and/or any vendors accompanying the Creative Director functions solely as Independent contractors. The Client understands that the Creative Director is a professional and does not need to be supervised during the installation of the balloon decor. 

Safety 

In the event Hop Haus or the Creative Director deems the event or the installation to be unsafe, the Creative Director has the authority and obligation to refuse service of the installation until the unsafe situation is made safe again. If the Clients guests or other vendors have made the installation or location unsafe, the Client assumes full responsibility and pays any fees for travel, rentals, staff, etc. If this situation occurs, Hop Haus will leave all balloon decor onsite for the Client and will remove themselves and all property, equipment, staff, etc. from the property immediately. If ever there is a safety issue such as this, Hop Haus will exercise our right to refuse service and the Client/Client’s guests will be blacklisted.

By signing the Terms & Conditions document and or submitting payment, I certify that I have read this document in its entirety, I fully understand and agree with this agreement. I also understand my role as a Client and the role that my Creative Director will play in the installation for my event. 

 

I have read the above agreement and fully understand and accept the conditions as above. I am aware that while in my care I am fully responsible for the inflatable and all other installations provided by Hop Haus and will pay for any loss or damages that may occur.

 

Signatures. The person(s) signing below have the authority to enter into this Agreement. The signer understands, agrees and has had a chance to ask questions if anything was unclear.
