ASSUMPTION OF RISKS

I understand and EXPRESSLY AGREE to the fact that skiing in its various forms is an inherently hazardous sport that has many dangers and risks. I realize that injuries are common and ordinary occurrences of this sport. I acknowledge that SKI RACING AND TRAINING and related activities are ESPECIALLY HAZARDOUS activities and GREATLY INCREASE THE RISKS of skiing and that I have made a voluntary choice to participate in those activities myself or to allow my child(ren) to do so despite the risks they present. I recognize that the risks associated with participating in ski racing, training, and competing include, but are not limited to, the fact that the racer will be traveling at high speed, that collisions and falls are a probability. Trail and racecourse conditions vary constantly because of weather changes and skier use and even the best equipment and coaching cannot prevent injury. Natural and manmade obstacles, including other skiers, may exist and collisions do occur. I also understand that my child will be using SKI LIFTS WITHOUT A COACH OR OTHER ADULT PRESENT. I understand and acknowledge that this list is not complete or exhaustive and that other risks, known or unknown, identified or unidentified, may also result in injury, death, illness, or damage to my property. Accordingly, I understand that the child must control him or herself at all times.

 

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the Los Alamos Ski Racing Club making ski racing, training and related activities available to me and/or my child(ren), I EXPRESSLY AGREE that I freely accept and voluntarily assume ALL RISKS OF PERSONAL INJURY OR DEATH or property damage for myself and my child(ren) and FULLY RELEASE Los Alamos Ski Racing Club and its agents, sponsors, employees, coaches, directors, officers and volunteers FROM ANY AND ALL LIABILITY for personal injury, death or property damage which results IN ANY WAY from my or my child(ren)'s participation in this sport, or while working on any Los Alamos Ski Racing Club project or while traveling to and from any Los Alamos Ski Racing Club event, including any caused by NEGLIGENCE, conditions on or about the premises and facilities of any ski area where the Los Alamos Ski Racing Club may be skiing or the operations of the ski area including, but not limited to, grooming, snow making, ski lift operations while loading or unloading, gate setting, course setting, coaching, other skiers or any other activities related to ski racing and ACCEPT MYSELF THE FULL RESPONSIBILITY FOR ANY AND ALL such damages or injury of any kind which may result TO ME OR MY CHILD(REN).

 

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19

Participating in organized ski racing and ski practices presents certain risks regarding infectious diseases. The COVID-19 virus can spread before a person shows signs of the virus or is symptomatic.

Stay at home if you have any symptoms, and if you might infect an individual at increased risk of severe illness, or if you or your family members are at increased risk of severe illness.

Los Alamos Ski Race Club requires that anyone who is sick, has symptoms of COVID-19 or currently testing positive for COVID-19, shall not participate in practice or races until recovered.

Participation in Los Alamos Ski Race Club practices and events, includes possible exposure to and illness from infectious diseases including but not limited to MRSA, Influenza, and COVID-19. While safe practices and personal discipline may reduce this risk, the risk of serious illness and death cannot be eliminated; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation and/or the participation of my minor child/ward; and, I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. The coaches will be following all state, local and USSA regulations to prevent infectious disease. If one governing body has regulations that is more stringent than the others we will be following the one with the most stringent regulations. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself and my child from participation and bring such to the attention of the Coach immediately; and,

I, for myself and on behalf of my child/ward, heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Los Alamos Ski Race Club, their officers, coach, agents, volunteers, other participants, sponsoring agencies, and sponsors, WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to the Release of Liability and Assumption of Risk provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM RELEASEES’ NEGLIGENCE, to the fullest extent provided by law.

​I understand that participation in Los Alamos Ski Racing Club is voluntary.

I also agree to DEFEND, INDEMNIFY AND HOLD HARMLESS Los Alamos Ski Racing Club from any claims for damages against it by me, or any minors I have signed for, even after they have reached majority, or any third parties arising out of my conduct or the conduct of my child(ren) while participating in any Los Alamos Ski Racing Club activity.

I, the undersigned, HAVE READ AND UNDERSTAND the terms of the above Full Release from Liability and Indemnity Agreement and I am signing it freely and of my own accord, realizing IT IS BINDING upon me, my heirs, assigns and, in the event I am signing it on behalf of ANY MINORS, that I have FULL AUTHORITY TO DO SO REALIZING ITS BINDING EFFECT ON THEM as well as me.

I AM AWARE THAT THIS CONTRACT IS LEGALLY BINDING AND THAT BY SIGNING BELOW I AM RELEASING MY LEGAL RIGHTS AS WELL AS THOSE OF ANY MINOR FOR WHOM I AM SIGNING.
