RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS, AND ASSUMPTION OF RISK AGREEMENT

User understands and agrees to this Release, Waiver, Indemnification, Hold Harmless, and Assumption of Risk Agreement (the “Agreement”), by and between the User and Law Enforcement Officer Practical Shooting Group, LLC (LEOPSG), a New Jersey limited liability company and 501(c)(3) nonprofit organization. For purposes of this Agreement, LEOPSG and its partners (including, without limitation, its general partner(s)), agents, employees, facilities, sponsors, donors, instructors, staff, volunteers, and any other affiliated entities or individuals shall be referred to collectively as “Owner”.

User represents that he/she is older than 18 years in age, has not been convicted of a felony or domestic violence, and is authorized to carry and trained to use firearms. If User is under 25 years of age, User also represents that he/she has not committed a delinquent act that would constitute a felony if committed by an adult. User desires to enter an event hosted or facilitated by Owner, described as courses for instruction in firearms, USPSA/PCSL-style matches (whether sanctioned or not), classes with various instructors, or other events involving firearms (the “Event”). User understands that the Event is used for activities involving the active use and discharge of firearms, ammunition, and related equipment (collectively “Firearms”). User recognizes that User and/or others have and will be utilizing Firearms at the Event when User enters onto the Premises and that as such User will be at risk of bodily harm or death as a result of such activity and such Firearms. User acknowledges and is fully aware of the danger User is subjected to by entering the Event and onto the Premises and also by engaging in activity with respect to the Firearms. User recognizes that User is at risk of harm including, but not limited to, bodily injury or death from Firearms currently in use or Firearms previously used on the Premises by User or others and from any other activities or conditions on the Premises or taking place in the Event. User recognizes and understands that Owner makes no representations that the Premises or Event is safe and assumes no obligation whatsoever to protect User from risk of injury including, but not limited to, bodily harm and death. User understands the risk fully and assumes all risk of injury or death to him or herself or to any others.

In consideration of its having received permission to enter the Event and use the Premises, for receipt of any items (such as ammunition, firearms, accessories, holsters, rigs, magazines, optics, etc.) donated by Owner or its partners, for sponsorship by any individual, entity, or organization for participation in such events, for payment of match or event fees by Owner, and having acknowledged the receipt and sufficiency of such consideration, User hereby knowingly waives and releases in advance any and all claims and rights which User might otherwise have against Owner relating to User’s entry into the Event or onto or use of the Premises, at any time, including any claims based on Owner’s negligence. User agrees that Owner shall never be liable for any such claims.

User voluntarily assumes all risk and responsibility for any potential loss, property damage or personal injury (including death) which might be sustained by User or any of User’s guests, as a result of User entering onto the Premises or participating in any activity on the Premises, at any time. User understands and assumes risks including, but not limited to, handling firearms, noise-related hearing damage (and agrees to use proper hearing protection), eye injuries (and agrees to use proper eye protection), injury from ammunition or ricochets, weather conditions, animals/insects, property damage, exposure to communicable diseases or illnesses, lead exposure, and other harmful substances (such as residues from gunpowder, primers, or ammunition) that may result from the discharge of firearms or handling of ammunition. User further acknowledges and understands that instruction, matches, events, etc., can be held on mixed surfaces either indoor or outdoor and involve athletic movements; User is solely responsible for ensuring they are properly equipped to handle these various terrains and events.

Should any claim or liability arise, under the laws of the United States, New Jersey or any other state, and under any theory of law or equity, User will indemnify, hold harmless, and defend Owner from any and all costs, expenses or liability, including the cost of any settlement or judgment made or rendered against Owner, together with all cost of court or expenses incurred in connection with any such claim, demand or lawsuit including attorneys’ fees.

User acknowledges and agrees that any sponsorship of his/her attendance at an Event, including payment of match or event fees, does not limit, reduce, or transfer in any way the risks, responsibilities, or liabilities assumed by User under this Agreement. All risk is voluntarily assumed solely by User, regardless of sponsorship or financial assistance.

User hereby expressly assumes the risk of taking part in the course for instruction in firearms, taking part in the activities on the Premises, participating in Events hosted or facilitated by Owner, which include, but are not limited to, instruction in the use of firearms, the discharge of firearms, the firing of live ammunition, the use or receipt of any items donated by Owner or its partners (on or off Premises), and participation through sponsorship or payment of fees by any individual, entity, or organization.

Participant Acknowledgments:

User hereby acknowledges and agrees to the following:

  • I am not under the influence of drugs or alcohol and will not use drugs or alcohol while handling firearms or participating in any activities.
  • I am lawfully permitted to possess and handle a firearm and have not been denied the purchase of a firearm through lawful means.
  • I have not been convicted of a felony or of domestic violence.
  • I am not depressed or having suicidal or homicidal thoughts, nor have I made plans to carry out an act of suicide or homicide.
  • I have previously attended gun safety training programs or training courses, or will be attending one as part of this activity.
  • If I receive or rent a firearm or item, it is not permitted to leave the property or be used in a manner other than what was specified, unless otherwise authorized.
  • I will seek instruction from a Range Safety Officer or instructor prior to handling any firearm I am not familiar with.
  • If I do not understand a range rule or procedure or feel there is a safety risk to myself or others, I will notify a Range Safety Officer or staff immediately.
  • I understand that I am responsible for any damage to myself, property, or persons by my use or misuse of firearms or actions while on site or using donated items.
  • I acknowledge that Owner does not provide insurance coverage for participants and that I am responsible for my own medical, liability, or other insurance.
  • I am aware of the risks of lead exposure and other harmful substances from firearm use and ammunition handling, and I agree to follow hygiene practices such as washing hands after activities to minimize exposure.
  • I will use my service firearms and department-supplied equipment in accordance with local, state, and federal laws and department policy, especially regarding transportation of service firearms across state lines.
  • I am solely responsible for understanding and following all local, state, and federal firearms laws, especially in states that restrict magazine capacity and types of ammunition and firearms; I am also responsible for transporting my firearms and ammunition in accordance with local, state, and federal laws.

User hereby acknowledges and agrees that User has read this instrument and understands its terms and is executing this instrument voluntarily. User furthermore hereby acknowledges and agrees that he/she has read, understands, and will at all times abide by all range rules and procedures and any other rules and procedures stated by any member, affiliated member, instructor, staff, or volunteer of Owner. User covenants not to sue the Owner for any claims released herein.

User expressly agrees that this instrument is intended to be as broad and inclusive as permitted by law, and that if any provision of this instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. No remedy, and each and every remedy shall be cumulative and shall be in addition to every other remedy now or hereafter existing at law or in equity or by statute or otherwise. The election of any one or more remedy hereunder by the Owner shall not constitute any waiver of the Owner’s right to pursue other available remedies. This instrument binds User and his/her executors, personal representatives, administrators, assignees, heirs, and next of kin. This agreement shall be governed by the laws of the State of New Jersey without regard to conflict of laws principles.

USER WAIVES ANY RIGHT TO JURY TRIAL AND AGREES TO SUBMIT ALL DISPUTES RELATING TO THIS AGREEMENT OR ENTRY IN EVENT OR THE USE OF THE PREMISES OR ANY INJURIES OR DEATH SUFFERED THEREON TO ARBITRATION BEFORE THE ATTORNEYS OF LAW ENFORCEMENT OFFICER PRACTICAL SHOOTING GROUP, LLC.

Due to the nature of the Events, if a participant overstates their abilities to safely compete and/or complete a course of fire, and it is determined by the safety officer, staff, or judge, that the participant is not conducting themselves in a safe manner, they will be stopped and will not be allowed to continue the competition. If stopped due to a safety violation or concern, the participant will not be allowed to continue under any circumstances. A small infraction may result in a scoring penalty, but a flagrant safety violation will result in immediate forfeiture and immediate removal from the Event. The judges and staff will be trained to identify these violations, and once it is determined that a violation has occurred, there will not be an appeal.

This agreement may be executed electronically, and any electronic signature (including any digital representation of a signature, such as typing a name into a signature field or using a stylus or finger on a touchscreen) shall have the same legal effect, validity, and enforceability as a manually executed signature, to the fullest extent permitted by applicable law, including the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA).

GENERAL MEDIA RELEASE FORM

I, the User, do hereby grant permission to Owner to use and post my, my child, and/or my group’s story, photo, or other item, hereinafter referred to as “Materials,” across all mediums, including but not limited to all social media channels, websites, print media, television, streaming services, and any other mediums.

I hereby release you, your representatives, employees, managers, members, officers, parent companies, subsidiaries, and directors, from all claims and demands arising out of or in connection with any use of said “Materials,” including without limitation, all claims for invasion of privacy, infringement of my right of publicity, defamation, and any other personal and/or property rights.

By signing, I acknowledge and agree that no sums whatsoever will be due to me as a result of the use and/or exploitation of the “Materials” or any rights therein.
