CONSENT, RELEASE, AND WAIVER AGREEMENT

PLEASE READ CAREFULLY — BY SIGNING YOU ARE WAIVING CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE

This Consent, Release, and Waiver Agreement (“Agreement”) is executed by the undersigned parent or legal guardian (“Parent/Guardian”) on behalf of themselves and the child named below (“Student”) in favor of Lonestar Dance Center LLC, a Texas limited liability company, including its owners, employees, contractors, representatives, and agents (collectively, the “Company”).

AUTHORIZATION FOR FIRST AID & EMERGENCY MEDICAL CARE On behalf of myself or the child named below (the “Student”), I, the undersigned, hereby authorize Lonestar Dance Center LLC, a Texas limited liability company hereinafter referred to as Lonestar Dance Center, its agents, representatives, owners, contractors, and employees (collectively, the “Company”) to administer simple first aid to the Student in the event of minor injuries, and understand that family members or doctors will be called when in the discretion of the Company it is deemed necessary. If I cannot make arrangements for emergency medical attention at the time of serious illness or injury of the Student, I hereby authorize the Company to take any action as necessary for the Student’s well-being, including, but not limited to, transporting the Student to a nearby hospital, in the discretion of the Company. I further agree to be financially responsible for any medical services provided to the Student.

ACKNOWLEDGMENT OF RISKS I am aware that dancing, and the physical training associated with it place unusual stresses on the body, and carry with them the risk of physical injury including but not limited to muscle strain, falls, collisions, and other forms of physical injury. I understand that the reaction of the heart, lungs and vascular system to exercise cannot always be predicted with accuracy. I understand that there is a risk of certain abnormal changes occurring during or following exercise which may include, but not limited to: abnormalities of blood pressure or heart rate; chest, arm or leg discomfort; transient light-headedness or fainting; rhabdomyolysis falls, and in rare instances, heart attack, paralysis, stroke or even death. I further acknowledge that injuries may occur due to the Student's own actions, negligence on the part of the Student, the actions of other participants (including myself), or improper use or failure of equipment. I agree to abide by and follow all instructions or rules established by the Company.

ASSUMPTION OF RISK I have voluntarily chosen to have the Student participate in the Lonestar Dance Center programs, classes and activities. On behalf of myself or my child (the Student), I hereby assume all risks and agree that the Company shall not be liable in any way for any injuries sustained during attendance at Lonestar Dance Center or any of its related functions or activities. 

I understand that Texas law requires extra scrutiny for waivers signed on behalf of minors, and I affirm that I have read and understood this Agreement in its entirety, and that it is a fair and reasonable allocation of risk.

RELEASE OF LIABILITY & WAIVER OF LEGAL RIGHTS (INCLUDING NEGLIGENCE) I AGREE THAT THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES, CLAIMS, OR COMPENSATION OF WHATEVER NATURE (INCLUDING LIABILITY FOR NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) THAT MAY ARISE IN THE NAME OF OR FOR THE BENEFIT OF THE STUDENT AND/OR ANY OTHER PERSON AS A RESULT OF PERSONAL INJURY WHILE ON THE PREMISES OF THE COMPANY, AT A COMPANY-SPONSORED EVENT, THROUGH INTERACTIONS WITH OTHER PARTICIPANTS WHETHER CAUSED BY THE STUDENT, OTHER STUDENTS, OR ANY THIRD PARTY, INCLUDING ANY ACTS OR OMISSIONS OF NEGLIGENCE BY THE COMPANY OR ANYONE ELSE, OR OTHERWISE IN THE CARE OF THE COMPANY, INCLUDING ANY SUCH INJURIES SUSTAINED WHILE THE STUDENT IS BEING TRANSPORTED BY THE COMPANY. I HEREBY AGREE TO RELEASE, WAIVE, COVENANT NOT TO SUE, INDEMNIFY, AND HOLD HARMLESS THE COMPANY FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, JUDGMENTS, ACTIONS, EXECUTIONS, AND CAUSES OF ACTION WHATSOEVER. I UNDERSTAND THAT I AM WAIVING MY RIGHT TO TAKE LEGAL ACTION, INCLUDING FILING A LAWSUIT FOR INJURIES TO MYSELF AND/OR MY CHILD (THE STUDENT).

PHOTO & VIDEO RELEASE On behalf of myself or my child the Student, I further hereby grant the Company the absolute right and permission to take and use photographs and/or videos of the Student during attendance at the Lonestar Dance Center or any of its related functions. I understand that the photograph(s) and/or video(s) may be used in a publication, print ad, direct mailing, electronic media (e.g., the internet, presentations, etc.), and/or other form of promotion. I release the Company, the photographer, their offices, employees, agents, and designees from liability for any violation of any personal or proprietary right I and/or the Student may have in connection with such use(s). Neither I nor the Student will make any monetary or other claim against the Company for the use of any such photograph(s) and/or video(s).

COMMUNICABLE DISEASE ACKNOWLEDGMENT I understand that contagious illnesses (e.g., colds, flu, COVID-19, RSV) may be present in any group environment. I agree that the Student will not attend classes if experiencing symptoms of illness. I agree that the Company cannot guarantee a disease-free environment. I voluntarily assume all risks associated with exposure to communicable illnesses. I release the Company from all Claims arising from or related to such exposure, including those based on negligence.

PARENT/GUARDIAN AUTHORITY By signing below, I hereby represent and warrant that I am the parent or legal guardian of the Student and that I have complete capacity and authority to sign this instrument and approve the agreements set forth herein on behalf of myself and the Student.

CONDITION OF PARTICIPATION & PERPETUAL EFFECT I acknowledge and agree that the execution and delivery of this instrument to the Company is a condition precedent and a material inducement to the Company to permit the Student to use the Lonestar Dance Center and/ or participate in any of the Company’s related functions, without which the Company would not have agreed to permit such use and/or participation. 

This Agreement shall remain in full force and effect for all future participation of the Student at Lonestar Dance Center, unless expressly revoked in writing by the Parent/Guardian.

SEVERABILITY If any provision of this Agreement is held invalid, the remainder shall continue in full force and effect.
