LUMBERJACK JOHNSON'S AXE THROWING, LLC - RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

IN CONSIDERATION of attending and participating in any activity hosted by Lumberjack Johnson’s Axe Throwing, LLC on the date of the booked event ("Event"), which will take place at 301 N Oklahoma, Shawnee OK 74801 or any otherwise agreed-upon location ("Premises"), I, individually and/or as parent and/or legal guardian of each of the Additional Participants listed above, hereby acknowledge, agree, and represent that I have, or will immediately upon entering the Premises, and will continuously thereafter, inspect such Premises and all portions thereof which I and the Additional Participants enter and with which we come in contact, and further warrant that our entry upon such Premises and our participation, if any, in the Event constitutes an acknowledgment that I have inspected such Premises and find and accept the same as being safe and reasonably suited for myself and the Additional Participants and for the purposes of the Event, and further agree and warrant that if, at any time, while I or one or more of the Additional Participants are on the Premises and feel anything to be unsafe, I will immediately advise the on-duty manager or, if unavailable, an employee of Lumberjack Johnson's Axe Throwing, LLC of such and, if necessary, will leave the Premises with the Additional Participants. 

I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENENT NOT TO SUE Lumberjack Johnson’s Axe Throwing, LLC; and their respective employees, officers, directors, owners, agents, heirs, assigns, and personal representatives (“Releasees”) from any and all liability to myself and/or 

to each of the Additional Participants and our respective heirs, assigns, personal representatives, and next of kin, for any and all loss or damage, and any claim or demands thereof on account of injury to the person or property or resulting in the death of myself or any or all of the Additional Participants, whether caused by the negligence of the Releasees or otherwise while myself and/or one or more of the Additional Participants are on the Premises, and/or, participating in or attending the Event.

            I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS the Releasees and each of them from any loss, liability, damage, or cost they may incur due to the presence of myself and/or one or more of the Additional Participants on or around the Premises and/or while participating in or attending the Event, and whether caused by the negligence of Releasees or otherwise.

            I HEREBY ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE for myself and each of the Additional Participants due to the negligence of Releasees or otherwise while on or around the Premises and/or while participating in or attending the Event.

            I EXPRESSLY ACKNOWLEDGE AND AGREE that the activities of the Event are potentially very dangerous and involve the risk of serious injury and/or death and/or property damage to myself and to each of the Additional Participants.  I further expressly agree that this Release and Wavier of Liability and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the law of the State of Oklahoma and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

            I HAVE READ AND VOLUNTARILY SIGN THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agree that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.
