WAIVER, RELEASE, AND INDEMNIFICATION AGREEMENT

In signing this document, you understand that you are waiving the right to bring a court action to recover compensation or seek any other remedy for personal injuries, property damage, loss of property, accidents of any kind, or death arising out of your use of 1000976100 Ontario Inc. o/a Maple Jiu-Jitsu Academy ("Maple Jiu-Jitsu Academy"), located at 20 Cranston Park Ave, Maple, ON L6A 2W2. This waiver includes, without limitation, injuries or damages that may arise in connection with Maple Jiu-Jitsu Academy's facilities, equipment, classes, or any activities sponsored or facilitated by Maple Jiu-Jitsu Academy (including, but not limited to, tournaments, boot camps, seminars, clinics, workshops, martial arts classes, and special events), whether such activities are supervised or unsupervised. You must be 18 years of age or older to sign this Waiver, Release, and Indemnification Agreement; if under 18, a parent or guardian must sign on your behalf.

ACKNOWLEDGEMENT AND ASSUMPTION OF RISK 

1. Awareness of Risks
I understand and acknowledge that participating in activities at Maple Jiu-Jitsu Academy located at 20 Cranston Park Ave, Maple, ON L6A 2W2 may involve various risks and dangers that could lead to serious bodily injury, permanent disability, paralysis, property damage, and even death. These risks may arise from:

  • My own actions, physical condition, or inactions
  • The actions, inactions, or negligence of other participants or instructors.
  • Conditions of the facilities, equipment, or environment in which activities are conducted.
  • The negligent supervision, maintenance, or operation of Maple Jiu-Jitsu Academy by its staff or contractors.

2. Acceptance of All Risks 
I voluntarily agree to accept and assume all inherent risks associated with my use of the Gym and participation in Gym Activities. I accept full responsibility for all losses, costs, and damages I may incur as a result of participating in these activities, both now and in the future.

3. WARRANTY OF PHYSICAL CONDITION AND FITNESS FOR PARTICIPATION
I warrant that I am in good health, have no physical or mental condition that would make my participation unusually hazardous, and am physically capable of participating safely in Gym Activities.

RELEASE, WAIVER, AND INDEMNIFICATION

4. Waiver and Release of Liability 
I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE 1000976100 Ontario Inc. o/a Maple Jiu-Jitsu Academy, including its officers, directors, employees, volunteers, instructors, agents, facility owners, equipment manufacturers and installers, and any other affiliated or associated persons (collectively referred to as the "Releases"). 5. Indemnification and Hold Harmless 
Should I, my estate, or any other party on my behalf bring a claim against any of the Releases, I agree to indemnify, defend, and hold harmless each of the Releases from any litigation expenses, attorney fees, loss, liability, damages, or costs incurred as a result of such claim. I understand that this indemnification extends to all claims, including but not limited to, any claims of negligence, wrongful death, personal injury, property damage, or breach of contract.

6. Disclaimer of Warranties 
I understand that Maple Jiu-Jitsu Academy makes no warranties, representations, or guarantees, either express or implied, regarding the safety of the facilities, equipment, or Gym Activities. I accept all facilities, equipment, and activities "AS IS" and assume full responsibility for any risks inherent in their use.

CONSENT AND PERMISSION 

7. Media Release 
I consent to the photographing, videotaping, or recording of my image or likeness by Maple Jiu-Jitsu Academy for promotional and marketing purposes. I understand that Maple Jiu-Jitsu Academy may use these images without payment or further consent in marketing materials, advertisements, social media, or any other promotional medium.

8. Consent for Medical Treatment
In the event of an emergency or injury, I consent to receive medical treatment deemed necessary by Maple Jiu-Jitsu Academy staff, including emergency medical transport. I acknowledge that Maple Jiu-Jitsu Academy is not responsible for the quality or results of any medical treatment.

LEGAL AGREEMENTS 

9. Choice of Law and Jurisdiction 
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable within. I agree that the courts of the Province of Ontario shall have exclusive jurisdiction to resolve any disputes or claims arising out of or related to this Agreement, my use of the facilities, or my participation in any Gym Activities.

10. Successors, Assigns, and Binding Effect 
This Agreement shall bind me, my heirs, assigns, personal representatives, and any party acting on my behalf. It shall endure to the benefit of Maple Jiu-Jitsu Academy, its successors, assigns, heirs, executors, and legal representatives.

11. Severability 
I agree that if any portion of this Agreement is found to be invalid or unenforceable, the remaining portions shall continue in full force and effect to the greatest extent permitted by law.

12. Entire Agreement and No Reliance 
This Agreement constitutes the entire agreement between Maple Jiu-Jitsu Academy and me regarding my participation in Gym Activities and use of the facilities. I acknowledge that I have not relied on any oral representations, statements, or promises not expressly contained in this Agreement.

13. Voluntary Participation and Understanding of Agreement 
I certify that I am signing this Agreement freely and voluntarily, fully aware of the rights I am waiving. I understand the legal consequences of this Agreement, including the waiver of my right to bring a claim against Maple Jiu-Jitsu Academy and its affiliates. I acknowledge that I have read this document in its entirety, fully understand its terms, and agree to be bound by it.
