Snowmobile Tour Release Form



By signing this document you are agreeing to have read, understand and to be bound by the terms listed within this Vermont Mountain Adventures LLC release form.

WARNING!: All forms of winter activities, such as snow machine and snowmobile operating and rides [“snowmobiling”] are hazardous. Risks include accidents, collisions or mishaps related to operator error, machine malfunction, changing weather, visibility, surface conditions, variations in terrain, surface or subsurface snow or ice conditions, bare spots, rocks, trees, stumps and other forms of forest growth or debris, lift components and snow making equipment (all of the foregoing whether above or below snow surface, marked or unmarked), pole lines, fence posts and ropes. I am fully aware that all forms of snowmobiling are hazardous and filled with high risks. I acknowledge that only, I know whether myself and/or my minor child/children can safely participate in this activity.

I EXPRESSLY ACCEPT FOR MYSELF AND/OR MY MINOR CHILD/CHILDREN the full responsibility for this decision and for any damage or injury of any kind that may result from my participation in snowmobiling.

This agreement affects your ability to bring a civil law suit for injuries arising out of the rental, tour and operation of snowmobiling with Vermont Mountain Adventures LLC. This agreement is intended in all respects to be consistent with the laws of the State of Vermont.

NOTE: Vermont Mountain Adventures LLC is an independent unaffiliated business from Pinnacle Lodge. Pinnacle Lodge has no operation or control of Vermont Mountain Adventures LLC.

I agree that my participation in the snowmobiling is voluntary and that as a condition of being permitted to participate, rent and operate a snowmobile from Vermont Mountain Adventures LLC and to use the Green Mountain National Forest premises for this purpose.

I hereby covenant not to sue and promise not to make any claim or bring any suit against Vermont Mountain Adventures LLC and Pinnacle Lodge and all their owners, affiliates, employees, volunteers, agents, sponsors and all their insurers (hereinafter Vermont Mountain Adventures LLC and Pinnacle Lodge) as I FREELY AND VOLUNTARILY ACCEPT ALL RISKS inherent in snowmobiling such as, but not limited to, those stated above, and those that can reasonably be inferred therefrom including the contraction of virus or sickness. I also agree that these risks are both obvious and necessary to all forms of snowmobiling including rental and operation, and the condition of the terrain used for snowmobiling.

I agree to defend, indemnify and hold harmless Vermont Mountain Adventures LLC and Pinnacle Lodge from any and all liability for personal injury, including death and property damage, resulting from snowmobiling, including but not limited to those listed in the WARNING! At the beginning of this document and from my participation in snowmobiling.

I further agree that any claim that I may at any time bring for any reason against Vermont Mountain Adventures LLC and Pinnacle Lodge shall be submitted exclusively to the jurisdiction of the State or Federal Courts in Vermont and no other jurisdiction and shall be governed by Vermont law. I agree to pay and reimburse Vermont Mountain Adventures LLC and Pinnacle Lodge any and all attorney fees, costs and expense incurred by either of them in responding to or defending any claim or litigation brought by me or on my behalf related to my participation in snowmobiling or incurred by Vermont Mountain Adventures LLC and/or Pinnacle Lodge to enforce any terms of this Agreement including my indemnification obligations. I acknowledge that I have read, agree with and understand the terms of this document and that I am signing it freely and that the terms of this Agreement state that I expressly assume all risk of damage, injury and/or death resulting in any way from any inherent risks of the activities described in this winter release form. I agree that if any portion of this Agreement is determined to be unenforceable by a court of law that all other parts of this Agreement shall remain in full force and effect and that the conditions and covenants herein shall be binding on my heirs and assigns. I also agree that this Agreement can be used as evidence in any claim or suit brought by me or on my behalf against Vermont Mountain Adventures LLC and/or Pinnacle Lodge. I fully understand Vermont Mountain Adventures LLC 48 hour cancellation policy and hereby waive my rights to dispute charges involving my reservation/rental agreement any time after the 48 hours before my scheduled and reserved tour time regardless of the circumstances.

Required if participant is age 17 or younger: To the extent that I am signing this document on behalf of any minor child, I represent and guarantee that I have full authority to do so, realizing the full binding effect of this Agreement on them, as well as on myself. I further agree to defend, indemnify and hold harmless Vermont Mountain Adventures LLC and Pinnacle Lodge for any claims brought on behalf of the minor child, relating to any damages or claims allegedly sustained by the minor child while he/she was participating in snowmobiling, and for all awards, legal fees and expenses and settlements, including attorney’s fees, that result from such claim and/or incurred by Vermont Mountain Adventures LLC and/or Pinnacle Lodge to enforce the terms of this Agreement.

I hereby grant Vermont Mountain Adventures LLC to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of Vermont Mountain Adventures LLC will not be returned.

I hereby irrevocably authorize Vermont Mountain Adventures LLC to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge Vermont Mountain Adventures LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I HAVE READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THEIR SIGNATURES BELOW. 

I HEREBY AGREE TO ACCEPT AND FREELY ASSUME ALL FINANCIAL OBLIGATIONS FOR ANY DAMAGES DONE TO THE SNOWMOBILE/HELMET AND AGREE TO FINANCIAL RESTITUTION TO VERMONT MOUNTAIN ADVENTURES LLC THE UNDERSIGNED STATES THAT HE/SHE HAS READ AND UNDERSTANDS THE FOREGOING RELEASE AND SIGNS THIS RELEASE AS HIS/ HER OWN FREE ACT. ANY DAMAGES DONE WILL BE CHARGED TO THE CREDIT CARD ON FILE WITH VERMONT MOUNTAIN ADVENTURES LLC/STRATTON ADVENTURES LLC VIA BROWN ENTERPRISES, INC S. LONDONDERRY, VT.

I will respect the rights of all snowmobile operators and passengers, cross-country skiers, hikers and anyone on participating in snow activities while in control of the snowmobile. I understand that I will not receive a refund if I am removed from the tour due to but not limited to: 

  • Improper clothing
  • Suspected to be under the influence of drugs and/or alcohol
  • Reckless driving
  • Inability to follow the Tour Guide's direction
  • Refusal to wear a fitted helmet
  • Damages done to the vehicle

I agree to pay any and all damages caused by myself or any other drivers/passengers within my reservation with either the card on file under my reservation through Fareharbor or a different card connected to my name if I choose not to purchase the additional damage waiver insurance in the amount of $15.00 I understand that the damage waiver insurance carries a $250.00 deductible. I hereby authorize the credit card information provided/on file with our Vermont Mountain Adventures LLC reservation to be used for insurance or any damages caused by myself or any other drivers/passengers within my reservation. This waiver applies to all types of collisions i.e another vehicle, random pieces of equipment, snow embankments..etc. I hereby waive my rights to dispute charges involving my reservation/rental agreement.

How to’s and Rules of the Ride

 

Never operate a snowmobile under the influence of drugs and/or alcohol.

Always wear a helmet properly secured.

If you come across terrain that you feel uncomfortable with, STOP AND WAIT. Your guide will return to assist you.

Conditions often vary on the snowmobile trails throughout the tour. Operate the snowmobile carefully and stay in control. Snow drifts, ruts, ice, and other varying terrain or obstacles may be present on the trails, please slow down and be aware of your surroundings. Drivers and passengers should keep both hands on the handlebars at all times. Snow, rain, hail, and fog, all limit your vision - Slow down in these areas. If you can’t see stop. Only travel at a speed in which you are comfortable with and in control of the snowmobile.
