Membership / Participation Release and waiver of Liability, Assumption of Risk, And Indemnity and, Where applicable, Parental Consent Agreement (“Agreement”)

 Participant terms and waiver release of liability

1. Assumption of Risk

I understand that participation in ninja warrior training, obstacle course activities, fitness classes, climbing, swinging, jumping, running, and related activities involves inherent risks. These risks include, but are not limited to:

  • Slips, falls, and impact injuries
  • Contact with equipment or other participants
  • Sprains, fractures, concussions, or other serious injury
  • Equipment failure or misuse
  • Negligence of other participants
  • Negligence of Movement Terrain staff

I understand that these activities may result in serious injury, permanent disability, or death.

I voluntarily assume all risks, known and unknown, associated with participation in Movement Terrain activities.

2. Medical Acknowledgment

I certify that I (or my child) am physically able to participate in these activities and have no medical condition that would prevent safe participation.

I understand that Movement Terrain does not provide medical insurance. I authorize staff to seek emergency medical treatment if necessary and agree to be financially responsible for any such care.

Notice: Certain lighting effects used during events may include flashing lights, which could affect individuals with photosensitive conditions.

3. Release of Liability

In consideration of being permitted to participate, I hereby release, waive, discharge, and covenant not to sue Movement Terrain LLC, its owners, officers, employees, coaches, volunteers, and agents from any and all liability, claims, demands, damages, or causes of action arising from participation in any Movement Terrain activity, including claims arising from negligence.

 4. Indemnification

I agree to indemnify and hold harmless Movement Terrain LLC from any claims, damages, costs, or attorney fees arising from my participation or my child’s participation.

5. Facility Rules & Conduct

To maintain a safe environment, I understand and agree that:

  • Participants must follow all staff instructions at all times.
  • Appropriate athletic footwear and shirts must be worn unless otherwise directed by staff.
  • Participants must use equipment as instructed.
  • Unsafe behavior may result in removal from the facility without refund.
  • Anyone under 16 must be supervised according to Movement Terrain policies.

Movement Terrain reserves the right to modify schedules, close the facility for events, or adjust programming as necessary.

6. Makeup Classes & Open Gym

I understand that makeup classes and open gym privileges are subject to Movement Terrain’s posted Makeup Policy and are not guaranteed.

7. Photo & Media Release

I grant permission for Movement Terrain LLC to use photographs, video, or audio recordings taken during participation for promotional, marketing, or educational purposes without compensation.

If I do not wish to grant media permission, I understand I must notify Movement Terrain in writing.

8. Parent / Guardian Consent (For Participants Under 18)

I am the parent or legal guardian of the minor participant. I understand the nature of the activities and believe my child is physically capable of participating.

I agree to all terms of this Agreement on behalf of my child and release Movement Terrain LLC from all liability to the fullest extent permitted by law.

9. Acknowledgment

I acknowledge that:

  • I am at least 18 years old (or the legal guardian of the participant).
  • I have read and understand this Agreement.
  • I am signing voluntarily and intend this to be a complete and unconditional release of liability to the fullest extent allowed by law.

If any portion of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
