Nixi City Play Cafe Release and Waiver

Sickness Policy

  • For the health and safety of all children, visitors, and staff we ask that only "well" children and adults enter our facility. If you or your child has a fever, a sore throat, runny nose, is coughing or sneezing or exhibiting any other typical cold, flu, or covid like symptoms, please keep your child at home. 
  • If you visit our facility and we notice visible signs of illness, we reserve the right to ask you to return on a different day.


Rules & Policies

  • Socks must always be worn by all adults and children in order to enter the play area. Socks are available for purchase.
  • We are a shoe-less facility for the health and safety of all guests. Shoes are not permitted in the play area and must be removed and stored in the storage cubbies outside the play area. 
  • Please leave food and drinks outside of the play areas.
  • Parents are required to supervise their children at all times. Never leave your child unattended.
  • The baby and toddler area is designed and designated for children under three years of age.
  • Nixi City is not responsible for any lost, broken or stolen items. We have the right to donate items that have been left unclaimed for over 90 days.
  • For the health and safety of all the children, visitors and staff, if anyone has visible signs of illness (coughing, runny nose, fever etc.) will be asked to return when they are no longer symptomatic.
  • Nixi City reserves the right to update pricing & policies without notice.


Assumption of Risk, Waiver, Release from Liability

I desire and choose to use the facilities of Nixi City Play Cafe (Nixi City LLC, dba Nixi City) located at 1437 Northwest Richmond Beach Road, #E Shoreline, WA 98177.

I understand and acknowledge that inherent risks and hazards may be present by participating in all activities and overall use of Nixi City Play Cafe. Such risks, for example, but without limitation, may include: illness, risk of loss, property damage, collisions with other visitors/customers, slipping, tripping, falling, and bodily injury or harm. I assume full responsibility for all risks that may arise from using the facilities or participating in activities at Nixi City. 

On the behalf of the participant(s) under my care, that enter the Nixi City Play Cafe space, as well as their executors, heirs, and successors do hereby acknowledge, understand and agree to the following:

  1. Responsible for Minor Participant – I hereby certify that I am the parent, caretaker, legal guardian or responsible party of the participant who enters the premises with me and I have authority to waive rights on behalf of the minor participant. I understand that the employees of Nixi City Play Cafe are not responsible for the participants who utilize the space and it is the responsibility of the undersigned individual to supervise any minors they bring into the facility at Nixi City Play Cafe.                                         
  2. Health Statement – Both myself and the minor children with me, utilizing Nixi City Play Cafe have no illness, or condition that will affect the health or safety of other guests.                                                                         
  3. Acknowledgement of Policies & Procedures – I acknowledge that I have read, know and agree to all the policies relating to the use of Nixi City Play Cafe. I agree to comply with all rules and regulations of Nixi City Play Cafe, and that Nixi City Play Cafe and its employees have the right to terminate my use of the Nixi City Play Cafe facilities, if I violate said rules and regulations.                                                                                                                     
  4. Security Camera Usage – I understand that security cameras installed around and within Nixi City Play Cafe are for the safety of all participants and may be referenced if needed.                                                                                                                                    
  5. Insurance/Liability for Injury – Nixi City Play Cafe is not liable for any injury, while at Nixi City Play Cafe facilities. I also understand that I am solely responsible for any medical, health, or personal injury costs related to my or my minor child/(ren)’s use of Nixi City Play Cafe.                                                                           
  6. Photo Release – I approve the use of any pictures that may be taken at Nixi City Play Cafe in which myself and/or the minor(s)/child(ren) in my care are a part of, to be used on any Nixi City Play Cafe social media, website, print media or marketing advertisements.                                                                           
  7. Payment for Damages – I agree to pay for any and all damages to any property or equipment as a result of my or my minor child(ren)’s willful actions, neglect, or recklessness and agree to be held liable for all such costs associated with such damages.
  8. Arbitration – All parties to this agreement agree to mediate, in good faith, any dispute prior to arbitration or litigation based on the laws of the state of Washington.                                                                              
  9. Release, Indemnify, and Defend – I hereby release, waive, discharge, and hold harmless Nixi City Play Cafe and all employees, past or present, from any claims, suits, liabilities, judgments, costs, and expenses for any property damage, loss or theft, personal injury or illness, death, or other loss arising from the use of Nixi City Play Cafe.
  10. Idea appropriation- By entering Nixi City Play Cafe, you agree not to enter with the intent to steal ideas, concepts, layout and are restricted from measuring equipment for the purpose of replicating or using such information for personal or third-party gain. Any attempt to do so will result in immediate expulsion from Nixi City Play Cafe premises without a refund or the ability to return to our facility permanently. Nixi City Play Cafe reserves the right to take legal action against any individual or entity found in violation to this.                          
  11. COVID-19 Acknowledgement - I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that myself and the minor child/ren, in my care, may be exposed to, or infected by COVID-19 while visiting Nixi City Play Cafe. Nixi City Play Cafe is not liable for any exposure to the COVID-19 virus while visiting Nixi City Play Cafe.

I hereby certify that I have read and understand this entire agreement and agree to and accept the terms and conditions of this agreement. I do so freely and voluntarily on behalf of myself and any minor child/children for which I am the parent, legal guardian or otherwise responsible, named below. I also agree with the health statement described above.
