DISCLAIMER AGREEMENT Between The Indoor Climbing Centre Pty LTD T/A CityROCK, hereafter referred to as CityROCK And The Climber, or any person entering CityROCK, hereafter referred to as the Climber CityROCK and the Climber have entered into an agreement in terms whereof CityROCK has allowed the Climber/Observer to make use of its facilities on the terms and conditions below. The Climber understands that participation in, or observing of the sport of rock climbing and the use of CityROCK's indoor climbing wall includes certain dangers and risks: - Injury sustained in a fall and hitting the wall, projections (permanent or temporary in place), or the floor (including any object or objects resting on the floor).
- Injuries resulting from rope management error and normal rope activity on the premises (including abrasion, entanglement, belaying, rappelling and lowering, and rescue scenarios).
- Injury due to falling climbers or objects.
- Cuts and abrasions resulting from bodily contact with the climbing wall.
- Failure of harnesses, ropes, slings, carabiners or any other hardware or part of the climbing systems and structures.
- Failure to properly tie the rope into the harness using a double figure eight knot.
The Climber further acknowledges that this list is not inclusive of all possible risks and dangers associated with the use of the indoor climbing facility. The ability of the Climber to climb in CityROCK gives no indication of his/her ability to climb on natural rock in the outdoor environment. I Agree
THEREFORE IT IS AGREED UPON AS FOLLOWS:
The Climber acknowledges that the activity in which he/she participates in by its very nature dangerous and carries inherent risks. These risks could cause him/her to sustain bodily injury or death and/or suffer damages and the Climber waives any claim however arising against CityROCK or its members, employees or any third party. The Climber makes use of CityROCK's facilities at entirely his/her own risk. The Climber agrees that CityROCK will not be held liable and/or responsible for any loss, injury, damages, death, and/or compensation of whatsoever nature and howsoever arising as a result thereof. We will not be responsible for, and shall not pay for, any loss, damage or theft of items left unattended. The Climber hereby warrants that he/she is medically fit so as to participate in activities of this nature, it not being the responsibility of CityROCK to have the Climber undergo any medical examination, the onus being on the Climber to do so. CityROCK shall not be obliged to call upon the Climber to provide a medical certificate. CityROCK, its members or employees, shall not be liable for any claim or injury or loss, damage or even death arising from or in connection with the use of the facility. I Agree
Novice Supervision CityROCK will allow a maximum of two novices per supervisor. Novice climbers are the responsibility of the supervisor and the supervisor must remain with their novice(s) when in the centre at all times. The Supervisor has a duty to inform the novice of relevant risks and help them manage these risks. Both the Supervisor and the Novice should understand and agree to the standard of supervision as outlined below by CityROCK: - The supervisor must be CityROCK belay certified by taking a top-rope belay test and/or lead test.
- Supervision requires being in arms reach of the novice(s) at all times.
- Novices must not belay without a CityROCK belay certification.
- Supervisors are to follow CityROCKS' standard rules and regulations at all times. They are available at reception and on the website: https://cityrock.co.za/rules-and-regulations/
- The Supervisor agrees to be responsible for the safety and behaviour of your novice during your visit.
- The Supervisor must be able and willing to assist your novice(s) in the correct fitting and use of the climbing harness.
- The Supervisor must tie in your novice(s) with the correct figure eight knot before climbing along with the relevant safety checks.
- The Supervisor must ensure your novice(s) are clipped in correctly and on the correct attachment points on the harness, and supervised at all times when using the auto-belays.
- The Supervisor must correctly spot your novice(s) when necessary and encourage down climbing and correct falling techniques when bouldering.
- Failure to supervise your novice(s) properly will result in both yourself and your novice being stopped from climbing.
