ASSUMPTION OF RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19

PLEASE READ CAREFULLY - YOU ARE RELEASING IMPORTANT LEGAL RIGHTS BY SIGNING THIS DOCUMENT 

In consideration for permission to use the premises and facilities of The Rose Bowl Riders (“Rose Bowl Riders”), I hereby acknowledge and agree as follows:

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend physical distancing at a minimum of 6 feet or more and have, in many locations, prohibited the congregation of groups of people. 

Rose Bowl Riders of Pasadena (“RBR”) has put in place preventive measures (collectively, the “Measures”) to reduce the spread of COVID-19 and requires all those who use the facilities to follow all of the Measures which include, without limitation: practicing social distancing when in groups or requested by others, wearing face masks when indoors, especially if unvaccinated and if you feel sick, please stay home. Please see the full list of Measures on the RBR website and posted at RBR. The Measures may be amended from time to time by the RBR Board of Directors in its sole judgment and without notice. 

Attending RBR could increase your risk and your child(ren)’s risk of contracting COVID-19. RBR cannot guarantee that you or your child(ren) will not become infected with COVID-19 by your or your child(ren)’s voluntary use of the facilities. 

With your signature below, you hereby acknowledge and agree as follows:

By signing this agreement, I agree to follow the Measures at all times while at RBR, and to ensure that my child(ren) do so as well. I further acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19. By attending and using the facilities at RBR, I acknowledge that exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at RBR may result from the actions, omissions, or negligence of myself and others, including, but not limited to, RBR employees, board members, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Rose Bowl Riders or participation in Rose Bowl Riders/Myrtle Hill Farm program (“Claims”).

On my behalf, and on behalf of my children listed below, if any, I hereby release, covenant not to sue, discharge, and hold harmless City of Pasadena, Rose Bowl Riders, Myrtle Hill Farm, and their respective employees, agents, and representatives (together, the “Released Parties”), of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. 

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Released Parties, whether a COVID-19 infection occurs before, during, or after participation in any Rose Bowl Riders and Myrtle Hill Farm programs.

I HAVE BEEN INFORMED THAT THIS AGREEMENT INCLUDES A WAIVER AND RELEASE OF VALUABLE LEGAL RIGHTS. I hereby agree to release and waive these rights.
