FACILITIES WAIVER

ACKNOWLEDGMENT OF RISK, LIABILITY RELEASE, AND RANGE / FACILITY RULES

(All-Encompassing Waiver for Franktown Firearms / Colorado CQB, Associated Entities, Agents and Affiliates)

All persons legally permitted to possess and use a firearm, airsoft marker, simunition training device, or any other equipment, and all persons who wish to shoot, train, participate in any activity, or simply be present in any portion of the facilities, using ANY FIREARM, AIRSOFT EQUIPMENT, SIMUNITION, TRAINING DEVICE, OR NO EQUIPMENT AT ALL, must complete this form completely. All information supplied herein is for the sole purpose of properly identifying anyone using the facilities of Franktown Firearms Shooting Center (FFSC), Colorado CQB (COCQB), and related operations, and will be kept confidential and will not be released to others unless required by law. This is being done to ensure the safety of all facility users.

ACKNOWLEDGMENT OF RISK

I understand that the use of firearms, airsoft markers, simunition training devices, martial arts training, medical training, physical training, and/or being in the vicinity of others using or possessing any of the above, are hazardous activities that can cause serious bodily injury and/or death. By signing below, I acknowledge that I accept that risk and that I am responsible and liable for my actions while using any portion of the facilities and at all times while on the property.

LIABILITY RELEASE

The undersigned applicant, for itself, its heirs, executors, administrators, successors, and assignees, hereby releases Franktown Firearms Shooting Center, 7460 E HWY 86, Franktown CO 80116, Franktown Firearms LLC, Franktown Firearms Enterprises LLC, Somerstep, LLC (dba Colorado CQB / COCQB), their Agents, Instructors, Employees, Partners, Members, Officers, Directors, Landlords, Affiliates, Associated Agencies (including but not limited to the ANY and ALL authorized law enforcement, fire, EMS, and private security entities and/or their members or affiliates, using the facilities), Staff Members (Staff), Contractors, Guest Speakers, Trainers, and their respective families, heirs, and estates (hereafter collectively referred to as Franktown Firearms / Colorado CQB), in perpetuity, from any and all liability for personal injury or property damage arising out of the use of the equipment or facilities of Franktown Firearms / Colorado CQB.

Applicant agrees to hold harmless and indemnify Franktown Firearms / Colorado CQB from any responsibility for any and all claims and/or demands for personal injury or property damage arising from use of the facilities or equipment.

In consideration for my being permitted to participate in activities of Franktown Firearms / Colorado CQB, I acknowledge that shooting, airsoft, simunition training, martial arts, medical training, physical training, and related activities have inherent risks, hazards, and dangers that cannot be completely eliminated.

I UNDERSTAND THAT THESE INCLUDE BUT ARE NOT LIMITED TO:

  1. Handling firearms, airsoft markers, simunition devices, and being near others that have any of the above in their possession.
  2. Personal injury and/or damage to personal property from shooting events, airsoft play, simunition training, physical activity, or training scenarios.
  3. Personal injury from the physical requirements of shooting events, airsoft, simunition, martial arts, medical, or other training.
  4. Possible ear damage from noise.
  5. Possible eye damage, facial injury, or other bodily injury.
  6. Exposure to lead dust and particles (live-fire activities).
  7. Impact from airsoft BBs, simunition projectiles, or training rounds.
  8. Injury from physical contact, falls, or exertion during training.

While Franktown Firearms / Colorado CQB may maintain certain liability coverage, I understand that each organization conducting any event is responsible for maintaining its own liability insurance for that event. Franktown Firearms / Colorado CQB is not responsible for that coverage or verification of that coverage. Completion of any separate waiver for another organization is the responsibility of that organization, not Franktown Firearms / Colorado CQB. I further understand that I will be required to meet and abide by any rules or requirements of the organization as well as those set forth by Franktown Firearms / Colorado CQB.

I understand the risks, hazards, and dangers as described above and have had the opportunity to discuss any questions with an authorized representative of Franktown Firearms / Colorado CQB. I understand that these activities may require good physical condition and a degree of skill and knowledge. I believe that I have the physical conditioning and degree of skill and knowledge needed for me to engage in these activities safely. I understand that I have responsibilities. My participation in this activity is purely voluntary. I am voluntarily using the services and facilities of Franktown Firearms / Colorado CQB with full knowledge of the inherent risks, hazards, and dangers involved and hereby assume and accept any and all risks of injury, paralysis, or death.

Last, I, for myself, my heirs, successors, executors, and subrogates, hereby knowingly and intentionally waive and release, indemnify, and hold harmless Franktown Firearms / Colorado CQB and all officers, partner companies and entities, agents, employees, instructors, volunteers, landlords, affiliates, associated agencies, contractors, guest speakers, and their respective heirs and estates from and against claims, actions, causes of action, liabilities, suits, and expenses (including reasonable attorney’s fees) which are related to, arise out of, or are in any way connected with any participation in any activity including, but not limited to, negligence of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property, services, animals, or equipment, whether such damage, loss, injury, paralysis, or death is a result of negligence of Franktown Firearms / Colorado CQB, course designs, or from some other cause. I, for myself, my heirs, my successors, executors, and subrogates, further agree not to sue Franktown Firearms / Colorado CQB, any officers or directors, agents, employees, instructors, volunteers, or affiliated parties as a result of any injury, paralysis, or death suffered in connection with my use and participation in any activity connected with Franktown Firearms / Colorado CQB.

I have read and understand the Waiver and Release Agreement above and I understand that this Waiver and Release Agreement applies equally to any minor children in my care that I have listed as family members or dependents on this application.


VIOLATION OF ANY RULE OR POLICY MAY RESULT IN THE LOSS OF FACILITY PRIVILEGES AND REMOVAL FROM THE PREMISES WITHOUT REFUND WHEN DEEMED NECESSARY BY FRANKTOWN FIREARMS / COLORADO CQB STAFF.

PLEASE READ & INITIAL ACKOWLEDGEMENT OF THE FACILITY RULES, THEN SIGN AND DATE BELOW.

WHERE APPLICABLE DEPENDING ON YOUR VISIT EACH DAY

Proper PPE will be worn at the sole responsibility of the participant (eye, ear, face, body protection) depending on the activity. IF YOU DON’T KNOW, ASK! We are HAPPY to help! Your safety is YOUR responsibility, but we want you to be SAFE and have FUN!

  1. Eye and ear protection must be worn at all times while inside any live-fire range area. Appropriate eye, face, and body protection must be worn during airsoft, simunition, or other training activities as directed by staff or instructors.
  2. Drug and alcohol use is strictly prohibited. We will not allow anyone to participate in any activity if we believe they are under the influence of any drugs or alcohol.
  3. No food or beverages are allowed in any live-fire range area. Follow posted rules for food/beverage in other training areas.
  4. NEVER cross the firing line or proceed in front of the shooting benches on the live-fire range.
  5. Personal firearms must be unloaded and cased, or holstered and concealed with a current CHP (where applicable). DO NOT EXPOSE ANY FIREARM IN THE STORE OR NON-RANGE AREAS; if you walk in with a firearm holstered, it stays holstered until you are on the range and facing downrange. Airsoft markers and simunition devices must remain unloaded and safe until in the designated training area and under staff or instructor direction.
  6. All FIREARMS MUST BE POINTED DOWN RANGE AT ALL TIMES and never pointed higher than the target. Airsoft markers and simunition devices must be treated with the same respect and pointed in a safe direction at all times.
  7. DO NOT BRING A LOADED OR MALFUNCTIONING FIREARM, AIRSOFT MARKER, OR SIMUNITION DEVICE OFF THE RANGE OR OUT OF THE TRAINING AREA EVER! If there is a problem, lay the device on the bench or designated safe area with the muzzle pointed in a safe direction and notify staff immediately.
  8. FIREARMS MAY ONLY BE HANDLED IN SHOOTING STALLS. Do not load, unload, repair, or in any way handle a firearm outside of the shooting stalls. Airsoft markers and simunition devices may only be handled in designated training areas under staff or instructor supervision.
  9. Only one person may fire from a shooting stall at a time. Do not exchange firearms between stalls. Please switch shooters between stalls, never firearms between stalls. The same principle applies to airsoft/simunition lanes or stations when directed by staff.
  10. Brass may only be retrieved from behind the firing line and only the amount you brought into the range. Airsoft BBs and simunition spent casings are to be handled only as directed by staff.
  11. DO NOT throw brass in garbage cans. Please push brass forward when finished shooting. Follow staff directions for cleanup of airsoft BBs or training debris.
  12. All ammunition, firearms, airsoft markers, simunition devices, and related equipment may be inspected by staff at any time.
  13. NO STEEL JACKET, STEEL CORE, TRACER, OR ARMOR PIERCING BULLETS ALLOWED ON THE LIVE-FIRE RANGE. IF YOU ARE CAUGHT WITH STEEL, YOU WILL BE ASKED TO PERMANENTLY LEAVE. Only approved airsoft BBs and simunition rounds are permitted in those respective activities.
  14. Only FRANKTOWN FIREARMS ammunition is to be used in rental firearms. Only COCQB / Colorado CQB approved ammunition or BBs are to be used in rental airsoft markers or simunition devices. We do not allow outside ammunition, reloads, or unapproved BBs/rounds in our rental equipment. Only approved BB's / training munitions allowed on our grounds, generally available for purchase from us, or provided with training, including, but not limited to biodegradable BB's. We reserve the right to inspect outside firearms, Airsoft markers and munitions, BB's, etc for FPS ratings, safety, and refusal if we deem necessary on our grounds at ALL TIMES. SAFETY IS OUR NUMBER ONE PRIORITY.
  15. Un-aimed or uncontrolled fire is strictly prohibited. All shots (live fire, airsoft, or simunition) must be fired at approved targets or as directed in a training scenario. You are financially responsible for any damage that you cause to the facility beyond normal wear and tear. Failure to report such an incident will jeopardize your use of the facility and may result in civil and/or criminal legal action.
  16. Anytime a cease fire is called (live fire, airsoft, or training), stop immediately, make the firearm/marker/device safe, place it in a safe direction, and back away from the line or training area as directed. Any participant is allowed to call a cease fire for any safety violation at any time.
  17. Participants under the age of 18 must be supervised by a parent or legal guardian. Minimum age for live-fire shooting is 12 years old without prior authorization from staff, AND AT LEGAL GUARDIAN'S COMPLETE RISK. Minimum ages and supervision requirements for airsoft, simunition, and other training activities will be set by staff or the specific program and must be followed, AND AT LEGAL GUARDIAN's COMPLETE RISK, including NERF Virtual / Augmented Reality, Martial Arts, Educational Training, or any other activity without limitations or exceptions to release of liability.
  18. FRANKTOWN FIREARMS / COLORADO CQB employees, agents, and instructors have complete authority regarding the operations of all facilities and activities.
  19. Members or participants caught shooting steel ammunition on the live-fire range will have their membership or privileges permanently canceled WITH NO REFUND. (If you are not sure of your ammunition or equipment, please ask.)
  20. Any unsafe act, as defined by range or training staff, will result in immediate removal and possible revocation of membership or privileges until further training is received.
  21. The facilities are available to be rented or reserved for training or other related activities by authorized organizations. As such, there are times when portions or all of the facilities will be closed to the general public, including members. We will try to keep those instances to a minimum, but reserve the right to close the range or training areas as needed to support defensive instructors, private/VIP training, law enforcement, and other contracted activities. Notifications will be made via our Facebook page, online channels, and other electronic means. Franktown Firearms / Colorado CQB also reserves the right to change the terms and conditions of membership or facility use, including benefits, at any time.
  22. I agree to follow ALL posted facility rules at all times.
  23. Staff members’ and instructors’ directions must be followed at all times.
  24. I agree that I am responsible for damages I may cause to facility equipment and property if deemed by facility staff to be beyond normal wear and tear.
  25. I have read and understand these rules and agree to follow them at all times. By signing below, I acknowledge that I accept the risks involved and that I am responsible and liable for my actions as well as any minor or dependent that I bring onto the premises.
  26. This single waiver covers all current and future activities conducted on the property under Franktown Firearms / Colorado CQB, including but not limited to live-fire range use, airsoft, simunition training, martial arts, medical training, law-enforcement and security training, classroom instruction, and related programs.
