Definitions: In this Agreement, the term Equipment Rental shall include all activities, events, equipment or services provided, arranged, organized, conducted, sponsored, or authorized by Routes Outfitter, LLC and shall include, but is not limited to: bikes and accessories (Equipment), snowshoes and accessories (Equipment), Helmets (Equipment), travel, transportation and accommodations, and other such activities, events, services in any way connected with or related to the rental of Equipment from Routes Outfitter, LLC.


Review Routes Outfitter's Privacy Policy

Rental Agreement: I, The User, accept full responsibility for the Equipment rented and will pay for any damage to the Equipment that occurs during my usage and to replace the Equipment at full retail value if not returned by the agreed date and time. I agree to report any problems, mechanical or otherwise, upon returning the equipment. 


Safety Equipment: I, The User, acknowledge that it is safest to wear all necessary or required safety equipment and/or apparel at all times while using the Equipment.


Equipment use: I, The User, am familiar with the proper use of the Equipment and its components, including but not limited to: all release or tightening mechanisms, straps, poles, paddles, inflation mechanisms, and buckles. I am aware that there are technicians available to answer questions that I may have as to the proper use of the equipment. I have made no representations regarding my ability to use the equipment or engage in any activies. 


Responsibility of Determination: I, The User, acknowledge and accept that I am responsible for determining whether the terrain used is safe for the use of the equipment or whether an accident may occur. The ground or aquatic terrain where I will use the equipment may be uncontrolled, unmarked, not inspected and may involve many risks, dangers, and hazards. These may include, but are not limited to: attacks by dogs or other animals, trees, falling trees, tree wells, tree stumps, holes and depressions on or below the ground surface, steep slopes, road banks, fences and other man-made structures, impact or collision with other equipment users or individuals, wind, lightening, inclement weather, failure to predict weather, unsafe driving, unsafe road conditions, unsafe water conditions or levels, failure to travel within one's ability or within designated areas, human error, failure to forecast or recognize a hazardous situation, negligence of other pedestrians, athletes, motorists and/or cyclists, paddlers, and negligence on the part of Routes Outfitter, LLC and the equipment manufacturers and distributors, or their employees, and contractors including the failure of Routes Outfitter, LLC or their employees, agents, and contractors to safeguard or protect me from the risks, dangers, and hazards as a result of my use of the equipment. I nevertheless freely and voluntarily assume all of the aforesaid risks and hazards and my use of the equipment shall be entirely at my own risk. 


Assumption of Risks: I, The User, am aware that the use of the Equipment involves risks, dangers and hazards; including but not limited to: the loss of balance, difficulty or inability to control one's speed and direction, variation or steepness in terrain, rapid or uncontrolled acceleration on hills and inclines or water rapids, mechanical failure of the equipment and/or any of its components, changes or variation in the ground or aquatic surface including rocks, gravel, cliffs, trees, roots, tree stumps, waterways and manmade structures such as bridges, ladders, berms and jumps, changing weather conditions, travel on highways and backcountry roads, encounters with domestic and wild animals, collision with pedestrians, motor vehicles, and other cyclists or athletes, failure to travel safely within one's own ability, negligence of other athletes or individuals. Hazardous conditions may occur in the use of the equipment and may be caused by but not limited to natural forces or people. 


I, THE USER, UNDERSTAND THAT MY USE OF THE EQUIPMENT, INCLUDING ANY SAFETY EQUIPMENT, CANNOT GUARANTEE MY SAFETY OR FREEDOM FROM INJURY WHILE ENGAGING IN ANY SPORTING, RECREATION, OR ATHLETIC ACTIVITY. I AM AWARE THAT IT IS NOT POSSIBLE TO PREDICT EVERY CONDITION OR CIRCUMSTANCE UNDER WHICH THE EQUIPMENT AND/OR SAFETY EQUIPMENT WILL NOT OPERATE AS INTENDED. I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE USE OF THE EQUIPMENT AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS, AND THE RESPONSIBILITY FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGES AND LOSS RESULTING THEREFROM.


State of The User: I, The User, state to the best of my knowledge that I have no medical, physical, or mental health conditions that would hinder or prevent my active participation in any activity while using the Equipment. I furthermore attest that I am fully responsible for my own ability to perform in an activity I engage while using the Equipment.


Care and Cleaning: Equipment is rented out clean and in proper working condition and must be returned in the same manner. Customer agrees to return the equipment in clean, undamaged condition to avoid any additional charges for repair, maintenance, or replacement. I, The User, accept use of equipment as is, in good working condition, and accepts full responsibility for care of the equipment while under my possession. Damaged parts or components will be repaired/replaced at the shop’s discretion and I, The User, agrees to pay regular rates and retail prices for repair and/or replacement. Clean condition means normal wear and tear is accepted but does not include broken or punctured frames, parts, or boards resulting from misuse and/or crashes or falls. Note: All equipment should be returned clean of mud and debris. A cleaning fee of $5 dollars may be applied for returned Equipment with excessive mud and debris present.


Credit Card Hold: I, The User, will provide Routes Outfitter with a physical credit card or credit card details, for precautionary use/hold. I authorize Routes Outfitter to charge the credit card they have on file for me for all eventual costs in case of damages to or loss of the equipment during my rental period, comprehensive of labour. In case of theft, I will be responsible for reimbursing Routes Outfitter for the original price of the Equipment, plus the cost of any accessories that were provided at the time of the Equipement rental. 


Release of Liability, Waiver of Claims, and Indemnity Agreement

In consideration of Routes Outfitter, LLC agreeing to exchange participation in Equipment Rental and permitting my use of their services, equipment and other facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I, The User, by signing below hereby agree as follows:

To waive any and all claims that I have or may have in the future against Routes Outfitter, LLC and the equipment manufacturers and distributors and to release Routes Outfitter, LLC from any and all liability for any loss, damage, expense, or injury, including death, that I may suffer or that my next of kin my suffer, resulting from or arising out of my use of the equipment, due to any cause whatsoever, including negligence, breach of contract, or breach of warranty on the part of Routes Outfitter, LLC in respect of the design, manufacture, selection, installation, maintenance, inspection, service or repair of the equipment, or in respect of the provision of or the failure to provide any warnings, directions, instructions or guidance as to the use of the equipment. There are no warranties, express or implied, concerning the equipment listed on this form; to hold harmless and indemnify Routes Outfitter for any and all liability for any property damage, loss or personal injury to any third party resulting from my use of the equipment; this agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity; this agreement and any rights, duties, and obligations as between the parties to this agreement shall be governed by and interpreted solely in accordance with the laws of Colorado and the United States.

In entering into this agreement I am not relying on any oral or written representations or statements made by Routes Outfitter, LLC with respect to the safety of my use of the equipment, other than what is set forth in this agreement. 

I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS GENERAL EQUIPMENT RENTAL AGREEMENT, RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST ROUTES OUTFITTER, LLC. I AM SIGNING THIS WAIVER AND RELEASE VOLUNTARILY. I UNDERSTAND THAT I MAY NOT PARTICIPATE IN THIS OR ANY ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
