Please agree to the following Rental Agreement which includes the terms, conditions and waivers for your upcoming reservation at Salty Squad Rentals. 

BY SIGNING THIS AGREEMENT, YOU ARE INTENTIONALLY RELINQUISHING CERTAIN SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE.

BY THIS AGREEMENT, SALTY SQUAD RENTALS ABSOLVES ITSELF FROM ITS OWN NEGLIGENCE.

I (“You”), the undersigned adult “Renter” (18+) or the parent, legal guardian of a minor Recreational User of SALTY SQUAD RENTAL Equipment hereby agree(s) and acknowledge(s) that You are engaging in extreme activity and the use of boats, watercraft, and other equipment could cause serious injuries, even death, to You or others. The equipment You will rent/lease includes, but is not limited to boats, personal watercraft, Sea-Doos, tubes, wakeboards, surfboards, skis, personal flotation devices, and ropes. All equipment listed in this paragraph shall herein be referred to as “Equipment.”

The extreme activities include use of Equipment, but are not limited to use in the capacity of driver or passenger in, boating, operating, towing, surfing, wake surfing, wakeboarding, kneeboarding, water skiing, tubing, swimming, driving, and exploring. All activity listed in the previous sentence, and any other possible use of equipment, shall herein be referred to as “Recreational Use.”

You understand that the Recreational Use of SALTY SQUAD RENTALS Equipment is intended at water and land locations not owned, maintained, or controlled by SALTY SQUAD RENTALS. The intended use locations, both land and water, shall herein be referred to as “Use Locations.” Recreational Use at Use Locations poses inherent risks from including, but not limited to, water, water conditions, weather, rocky terrain, cliffs, docks, marinas, buoys, landscapes, roads, and other operators of Recreational Use Equipment. These hazards can cause serious injury, damage to persons or property or even death, to You or others. You agree to comply with regulations applicable to the Use Locations and understand that SALTY SQUAD RENTALS is not responsible for any injury or injuries of whatever nature sustained to your person or property.

IN CONSIDERATION of the rights granted to You, the Undersigned, to Recreational Use of Equipment from SALTY SQUAD RENTALS, You agree, covenant, and promise as follows:

1. Assumption of Risk. You hereby acknowledge and knowingly assume that as a Renter, you are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals who you invite to, or otherwise provide access to the Equipment, including all risks of injury to persons, including death, and property that may be sustained in connection with your Recreational Use of the Equipment at all Use Locations. The risks include, but are not limited to, those caused by water, water conditions, terrain, temperature, weather, actions of other people including, but not limited to, other boaters, drivers, swimmers, hikers, and Equipment and/or respective users or operators. This assumption of risk on your part also includes, but is not limited to, bodily injury and death, resulting from the negligence of SALTY SQUAD RENTALS and/or its directors, officers, employees, servants, agents, representatives, or contractors. You further acknowledge that unanticipated and unexpected dangers may arise during your Recreational Use of Equipment may include, but are not limited to, collision, falling, slipping, whiplash, being thrown from and/or run over by Equipment, lacerations, bruises, burns, broken bones, concussions and any and all injuries, including death. Finally, You assume all risk of illness, to persons, including death, which may be sustained in connection with your Recreational Use of Equipment. Potential unexpected illnesses include, but are not limited to, COVID-19, MRSA, Influenza, dehydration, sunburn, sun exposure, heatstroke, etc. In addition, You hereby intentionally relinquish your substantial legal right to a jury trial pursuant to Article 18, Section 5 of the Arizona Constitution and acknowledge that You knowingly assume all risk pursuant to this paragraph. 

2. Release and Waiver of Claims. You, for yourself and your heirs, administrators, and representatives hereby fully release, acquit, and forever discharge SALTY SQUAD RENTALS, its officers, directors, shareholders, agents, employees, representatives, affiliates, parents, successors and assigns of and from any and all known or unknown obligations (including, without limitation, the obligation to warn of known dangers), actions, causes of action, claims, demands, judgments, liabilities, losses, costs, damages and expenses of whatever kind of character (“Losses”) for any injury or injuries of whatever nature sustained to your person or property, by reason of or in any way connected either directly or indirectly to your participation in the Recreational Use of Equipment, and arising out this Agreement, out of the use (misuse, or abuse) of Equipment regardless of Use Location, in whole or in part, by any negligent act or omission of You, SALTY SQUAD RENTALS, or any of your or its respective officers, directors, agents, employees or representatives. The scope of this Release includes, but is not limited to, all claims for negligence against SALTY SQUAD RENTALS, and/or its employees, servants, agents, or contractors, including claims for negligence resulting in bodily injury or death.

3. Indemnification. You, for yourself and your heirs, administrators, and representatives hereby agree to indemnify, defence and hold SALTY SQUAD RENTALS, its officers, directors, shareholders, agents, employees, representatives, affiliates, successors and assigns harmless from and against any known or unknown Losses based upon or in any way growing out of or connected directly with your participation, use, misuse or abuse in the Recreational Use of Equipment at any Use Location caused, in whole or in part, by any negligent act or omission of You, SALTY SQUAD RENTALS, or any of you or its respective officers, directors, agents, employees or representatives. The scope of this indemnification provision includes but is not limited to, Losses resulting from the negligence of SALTY SQAD RENTALS and/or its employees, servants, agents or contracts. enter hereby expressly agrees to indemnify and hold harmless Owner, Owner’s agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands, damages, personal injury or death that arise out of Renter’s use, misuse or abuse of the Watercraft.

4. Covenant Not to Sue. You, for yourself and your heirs, administrators and representatives hereby covenant not to sue or bring any action (whether at law or in equity) against SALTY SQUAD RENTALS, its officers, directors, shareholders, agents, employees, representatives, affiliates, successors or assigns for injuries sustained to your person, including, but not limited to, death, and property damage due to or in any way growing out of or connected directly or indirectly with your Recreational Use of Equipment at any Use Location. This Covenant Not to Sue includes, but is not limited to, claims arising from the negligence of SALTY SQUAD RENTALS and/or its employees, servants, agents or contractors explicitly intends to absolve itself from its own negligence. If You violate this paragraph, You agree to pay all reasonable attorney’s fees and costs incurred by SALTY SQUAD RENTALS as a result of your violation.

5. Governing Law and Extent of Agreement. You, for yourself and your heirs, administrators and representatives hereby expressly agree that the foregoing Request, Release, Waiver, Assumption of Risk, Covenant Not to Sue, and Indemnity Agreement is governed by the law of the State of Arizona and State of Utah and is intended to be as broad and inclusive as is permitted by Arizona and Utah law. In the event that any portion of this Agreement is determined to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effect.

THE UNDERSIGNED HEREBY CERTIFIES THAT THE UNDERSIGNED HAS CAREFULLY READ AND UNDERSTANDS ALL PAGES OF THE FOREGOING LIABILITY RELEASE AND WAIVER, ASSUMPTION OF RISK, COVENANT NOT TO SUE, AND INDEMNITY AGREEMENT; THAT THE UNDERSIGNED HAS HAD AN OPPORTUNITY TO ASK SALTY SQUAD RENTALS QUESTIONS CONCERNING THE FOREGOING LIABILITY RELEASE AND WAIVER, ASSUMPTION OF RISK, COVENANT NOT TO SUE AND INDEMNITY AGREEMENT, AND TO NEGOTIATE ADDITIONAL OR DIFFERENT TERMS; THAT AFTER NEGOTIATION AND BARGAINING REGARDING THIS LIABILITY RELEASE AND WAIVER, ASSUMPTION OF RISK, COVENANT NOT TO SUE, AND INDEMNITY AGREEMENT, THE UNDERSIGNED INTENTIONALLY RELINQUISHES ITS RIGHT TO RECOVER DAMAGES IN CASE OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE; AND THAT THE UNDERSIGNED VOLUNTARILY AND KNOWINGLY AGREES TO BE BOUND TO THE CONTRACTUAL TERMS CONTAINED HEREIN.

SALTY SQUAD RENTALS- Rules and Rental Agreement 

You hereby acknowledge and agree to abide by the following SALTY SQUAD RENTALS Recreational Use Rules:

1. Renter Insurance and Company Coverage

SALTY SQUAD RENTALS maintains liability and hull insurance on all watercraft, subject to a deductible. Renter remains financially responsible for any damage to or loss of the watercraft or accessories occurring during the rental period. To secure this obligation, Renter provides a security deposit (“Deposit”) as set forth in Section 4 below.

• Insurance Coverage: SALTY SQUAD RENTALS carries insurance covering damage or loss to the watercraft up to its policy limits, with a deductible of $___ per occurrence (the “Deductible”).³
• Renter Liability: Renter agrees to pay for all damages incurred, up to the full amount of the Deductible. SALTY SQUAD RENTALS will apply the Deposit toward any such damages.
• Excess Damages: If the cost to repair or replace exceeds the Deposit, Renter is responsible for the balance (i.e. cost – Deposit).

2. Condition and Inspection of Equipment. SALTY SQUAD RENTALS certifies that the Equipment is in good mechanical and physical condition. Any known damage or problems will be listed on the final check-in agreement (agreed upon at time of pick-up). Renter will inspect the Equipment prior to use and leases the same without any representations by SALTY SQUAD RENTALS. If Equipment has damage or problems not listed on this agreement, Renter must notify SALTY SQUAD RENTALS before use begins. Acceptance or use of the Equipment by Renter is acknowledgement that the Equipment is in good and acceptable operation condition. Renter acknowledges and agrees that failure to conduct a pre-rental check-in may result in damages or repairs being charged to the Renter at the end of the rental period.

3. Damage to and/or Loss of Equipment. Renter acknowledges that all Equipment (including watercraft, ropes, vests, boards, tubes, etc.) must be returned in the same condition as received. Renter authorizes SALTY SQUAD RENTALS to apply the Deposit to:

1. Damage repair costs up to the Deductible;
2. Replacement of lost or damaged non‐watercraft items (e.g. safety vests, ropes, tubes);
3. Cleaning fees, fuel charges, and any other costs incurred under Sections 5 and 6.

If such costs exceed the Deposit, Renter shall pay the additional amount upon demand. Renter further authorizes charges to the credit card on file for any balance owed.

4. Security Deposit and Credit Card Authorization. Renter hereby authorizes SALTY SQUAD RENTALS to hold a security Deposit to be used as follows:

• Deductible Application: Up to Deductible costs for any damage to the insured watercraft.
• Other Charges: Cleaning fees, refuel charges, lost or damaged equipment, and late fees as detailed in Section 5.

Should the Deposit be insufficient to cover all charges, Renter authorizes SALTY SQUAD RENTALS to charge the credit card on file for the remaining balance.

5. Renter Acknowledges the Return Condition and Cleaning and Repair Fees. Equipment should be returned to SALTY SQUAD RENTALS in the condition it was delivered which includes cleaning such as removal of water spots, garbage, and Renter’s personal belongings. Fuel tank should be returned full.

a. CLEANING FEE: Hourly rate of $60 per hour, not to exceed $240

b. FAILURE TO INSPECT + DECONTAMINATE: $1,000 plus fine and fees

c. REPLACEMENT KEYS: $50

d. FAILURE TO RETURN EQUIPMENT: Replacement cost of each item

e. REFUEL FEE: Cost of fuel via receipt obtained when watercraft is refueled

f. LATE FEE: If Equipment is not returned on time at the end of the rental period; a $60 charge per hour will be applied against the deposit. 

6. Inspecting and Decontaminating of Boat Rentals Leaving Lake Powell. After recreating on Lake Powell, ALL watercraft are required to receive an inspection before leaving the various Glen Canyon Recreational Area locations. By law, it is required that Inspection and decontamination occur prior to transporting watercraft from Lake Powell. Therefore, the inspection, decontamination, and applicable fees are the responsibility of the renter for watercraft that is leaving Lake Powell. 7. Prohibited Activities. The following activities are not permitted on the watercraft. Violation of this provision will result in the immediate termination of this contract and forfeiture of all monies paid by the Renter, including the full amount due for the rental regardless how much time is remaining on the rental.

a. No operating the watercraft faster than 45 mph to avoid damage to boards and bimini cover;

b. Watercraft are not to be beached, if you beach the watercraft, a $2,500.00 charge will be incurred;

c. Two anchors are provided to moor boat. When anchoring boat, make sure the front (bow) of the boat is away from shore to prevent damage. Information on how to anchor your PWC's will be covered in your orientation.

d. No boats or PWC shall be operated after Sunset on the lake. No night time operations of SALTY SQUAD RENTAL Equipment. If your scheduled return time appears like it will fall after sunset, it is the Renter’s responsibility to return Equipment early to avoid operating after Sunset;

e. No smoking;

f. No operating the watercraft while intoxicated;

g. No glass bottles or containers;

h. No operating the watercraft with more people or weight on board than the boat is rated for;

i. No wearing shoes while onboard the watercraft;

j. No pets weighing more than 20 lbs.

6. Service Calls. SALTY SQUAD RENTALS agrees to have all rented Equipment in good, running condition and will provide for or arrange service calls free of charge for mechanical failure not caused by Renter. However, Renter hereby acknowledges that the ability of SALTY SQUAD RENTALS to perform service calls may be limited by the National Park Service who controls all the activities on Lake Powell. Therefore, SALTY SQUAD RENTALS may have to rely on NPS personnel and/or current contract concessionaires to perform timely service calls. Renter agrees to pay for service calls which are the result of negligent use or operation of the Equipment. Negligent use by Renter includes, but is not limited to: activities such as running into foreign object (ex: other vessel, rocks, tree, floating debris, etc.), or inappropriate operation of the vessel causing mechanical failure or vessel damage. If a service call is required due to mechanical failure, and not due to any negligence on the part of the Renter, SALTY SQUAD RENTALS shall give a prorated refund starting from the time Renter contacted SALTY SQUAD RENTALS.

If you go past Mile marker 53 (near Rainbow Bridge), Renter will be responsible for returning Equipment to SALTY SQUAD RENTALS at the Renter’s own expense regardless of fault of SALTY SQUAD RENTALS.

7. Renter Warranties and Representations. Renter represents and warrants the following:

a. That he/she acknowledges all laws governing operation of the Equipment and that he/she will comply with the laws and regulations at all times;

b. That he/she shall have exclusive possession, command, and control of any and all SALTY SQUAD RENTAL Equipment during the rental period;

c. That he/she is adequately familiar with the operation of the Equipment;

d. That he/she will operate the Equipment in a safe manner at all times;

e. That he/she will operate the Equipment with no more than the maximum number of passengers permitted onboard and not to exceed the maximum weight limit of the watercraft.

f. The he/she understands the operation of the Equipment involves risks and that he/she assumes all liability associated with the operation of the Equipment; and

g. That he/she has viewed the power boat safety videos provided at rentalboatsafety.com

8. Cancellation Policy. If Renter cancels his / her reservation within 30 calendar days of the reservation, Renter shall forfeit the deposit. Within 14 days of the reservation, Renter shall forfeit the full amount of the rental. For day rentals only, if the cancellation is due to inclement weather, then the deposit will be applied to an alternate date or if inclement weather causes the rental period to end prematurely, the rental rate shall be prorated based on the time used.

10. Life Jackets and Safety Equipment. By law, life jackets must be onboard the watercraft for all persons on the watercraft. Any person under the age of 13 must wear a life jacket at all times while on the watercraft. All persons must wear life jackets while swimming from the watercraft.

In addition, accessories, safety equipment and documentation is provided and must remain on the watercraft at all times. Fines incurred for not having proper life jackets or safety equipment are the responsibility of the renter.

11. Governing Law. This Agreement is governed, construed, and administered according to the laws of Utah, as from time to time amended, and any applicable federal law. No effect is given to any choice-of-law or conflict-of-law provision or rule (whether of the State of Utah or any other jurisdiction) that would cause the application of the law of any jurisdiction other than those of the State of Utah.

12. Acknowledgment of Proper Use. Renter will be required to acknowledge that Owner has reviewed instructions for the proper operation of the watercraft including towing, launching, and settings. Renter releases Owner from liability or damage caused by improper use of the watercraft, trailer and equipment. 

13. Operation of Personal Watercraft. Renter represents and warrants the following:

a. That all children between the ages of 12 through 17 who may operate a PWC, have completed a Utah State Parks approved boating education course and will be operating the personal watercraft under direct supervision of a responsible adult who is at least 18 years of age.

b. That a person less than 18 years of age who has not met the above requirements may not operate a PWC unless accompanied on board by a responsible adult.

14. Frequently Asked Questions. Renter acknowledges that SALTY SQUAD RENTALS has a list of answers to frequently asked questions on the FAQ portion of the SALTY SQUAD RENTAL website. Renter acknowledges that they have read and agree to all information listed on the FAQ as part of this Agreement.

15. Entire Agreement. This Agreement constitutes the sole and entire agreement of its parties with respect to the Agreement’s subject matter. This Agreement supersedes all prior and contemporaneous understandings, agreements, representations, and warranties with respect to the subject matter. As between or among the parties, oral statements or prior written material not specifically incorporated in this Agreement have no force or effect. The parties specifically acknowledge that, in entering into and executing this Agreement, each is relying solely upon the representations and agreements contained in this Agreement and no others.
