305 Sand Society - Sand Series Waiver

PARTICIPANT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

PLEASE READ CAREFULLY BEFORE SIGNING

By signing this Waiver, I acknowledge and agree to the following:

1. ASSUMPTION OF RISK

I understand that participation in Sand Series, a beach volleyball tournament, and related activities involves inherent risks, including but not limited to:

  • Physical exertion, overexertion, and fatigue
  • Contact or collisions with other participants
  • Uneven or shifting sand surfaces, holes, or debris
  • Weather conditions including extreme heat, sun exposure, wind, and rain
  • Equipment failure or misuse
  • Dehydration, heat exhaustion, or heat stroke
  • Serious injury, permanent disability, paralysis, or death

I voluntarily choose to participate with full knowledge and acceptance of all risks, whether known or unknown, foreseeable or unforeseeable.

2. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)

In consideration for being permitted to participate, I hereby release, waive, discharge, and covenant not to sue:

305 Sand Society LLC, Sand Series, the event organizers, owners, directors, officers, employees, contractors, volunteers, sponsors, vendors, the venue, any applicable City or County, and all affiliated parties (collectively, the “Released Parties”)

from any and all claims, demands, actions, or causes of action, including those arising from the negligence of the Released Parties, resulting from injury, illness, death, or property damage arising out of or related to my participation.

3. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising from my participation or from my actions during the event.

4. MEDICAL CONSENT

I authorize the Released Parties to obtain emergency medical treatment for me if deemed necessary. I understand that I am solely responsible for any medical expenses incurred and that the Released Parties assume no responsibility for providing medical care.

5. PHOTO & VIDEO RELEASE

I grant permission for the Released Parties to capture and use photographs, video, and audio recordings of me taken during Sand Series for promotional, marketing, social media, website, or other lawful purposes without compensation.

6. PARTICIPANT ELIGIBILITY & CONDUCT

I affirm that:

  • I am physically able to participate safely
  • I have no medical condition that would make participation unsafe
  • I will follow all tournament rules and instructions
  • I understand that failure to sign this waiver disqualifies me from participation

7. MINORS (UNDER 18 YEARS OF AGE)

If the participant is under the age of 18, a parent or legal guardian must complete and sign this Waiver on the minor’s behalf.

The parent or guardian agrees to all terms of this Waiver and assumes full responsibility for the minor’s participation.

8. GOVERNING LAW & VENUE

This Waiver shall be governed by and interpreted under the laws of the State of Florida, and any legal action shall be brought exclusively in the courts of Florida.

9. SEVERABILITY

If any portion of this Waiver is held unenforceable, the remaining provisions shall remain in full force and effect.

10. ACKNOWLEDGMENT & ELECTRONIC SIGNATURE

I acknowledge that:
