WAIVER AND RELEASE OF LIABILITY In consideration for my participation in the below activities, including renting and utilizing an
unsupervised ice fishing shack, accessories and/or attachments, including but not limited to ice
augers, heaters, electrical generators and/or renting and utilizing mobile powersports
equipment including but not limited to snowmobiles, watercraft, trailers and RVs I HEREBY
ACKNOWLEDGE, WARRANT, COVENANT, AND AGREE WITH SELECT RENTALS/SELECT
PROJECTS as follows: 1. I have read the “Waiver and Release of Liability”, fully understand it, and sign it
voluntarily.
2. I am twenty one (21) years of age or older and/or I am the parent/guardian having full
legal responsibility for decisions regarding the minor child(ren)/ward
3. I am in good health and I have not and will not be under the influence of any drugs or
alcohol of any kind, which may affect my ability to participate in the activities in a safe
manner. I possess sufficient knowledge in the operation and safety precautions of all
rented equipment and have sufficient ability to operate the equipment, and I freely
accept any danger or risk associated with the operation of such equipment
4. I am familiar with and acknowledge that all recreational/motorsports/outdoor activities
have inherent risks, dangers, and hazards and such risks particularly exist in
participation of angling by way of ice fishing or watercraft as well as operating
motorized recreational vehicles, trailers, equipment, and attached/related accessories
5. I COMPLETELY UNDERSTAND MY VOLUNTARY PARTICIPATION IN ANY OF THE
ACTIVITIES COULD RESULT IN INJURY OR ILLNESS, INCLUDING BUT NOT LIMITED TO
DISABILITY, HYPOTHERMIA, DROWNING, CONCUSSION, DISMEMBERMENT, CARBON
MONOXIDE POISONING, OR DEATH. I FREELY ACCEPT ON BEHALF OF MYSELF AND THE
MINOR CHILD(REN)/WARD AND FULLY ASSUME ALL SUCH VOLUNTARY RISK AND THE
POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS RESULTING
THEREFROM
6. I agree to assume all risks associated with the use of an ice fishing shack and related ice
fishing equipment on a frozen body of water, as well as the risks associated with renting
and utilizing snowmobiles, boats, watercraft, trailers, RVs, vehicles, attachments and
accessories. By signing this Waiver and Release of Liability, I hereby assume all risks,
dangers, and all responsibility for any loss of rented equipment or supplies, personal items, bodily injuries, damages or fatalities, whether caused in whole or in part by the
negligence or gross negligence or other conduct of the owners, agents, officers, or
employees of Select Rentals/Select Projects. I also take full responsibility for any and all
persons involved in the use of any of the Rental Equipment and related equipment or
accessories during the agreed rental period. I also agree the individuals utilizing this
Rental Equipment and related equipment and accessories are limited to the individuals
outlined in this Waiver and Release of Liability.
7. I have read and understand all the POLICIES,TERMS, AND CONDITIONS involved with
renting Equipment and related equipment and accessories from Select Rentals/Select
Projects. My participation in all activities with Select Rentals/Select Projects is voluntary.
Representatives of Select Rentals/ Select Projects have taken all reasonable steps to
provide me with appropriate information and training to ensure safe operation. I
acknowledge the activities are not without risk. Certain risks are inherent of outdoor
activities and cannot be eliminated without destroying the unique character of the
activity and can be the cause of loss or damage, the risk of which I assume.
8. I, ON BEHALF OF MYSELF, MY PERSONAL REPRESENTATIVES, NEXT OF KIN, ASSIGNS
AND HEIRS, HEREBY:
(a) RELEASE, WAIVE, HOLD HARMLESS AND DISCHARGE Select Rentals/Select
Projects, its owners, agents, officers, affiliates, contractors, employees,
representatives, successors, and assigns (the “Releasees”) from any and all
liabilities, claims, demands, actions, and causes of action whatsoever, directly or
indirectly arising out of or related to any loss, damage, injury, or death that may
be sustained by me while participating in any activity while in, on , or around the
premises or while using the rental equipment,related equipment, and
accessories, including but not limited to any claims or actions that I may have as
a result of the negligence or gross negligence of Select Rentals/Select Projects or
the Releasees.
(b) INDEMNIFY, AND SAVE AND HOLD HARMLESS Select Rentals/Select Projects and
the Releasees, and each of them, from any litigation expenses, legal fees, liability,
damage, award or cost, of any or type whatsoever, they may incur due to any
claim made against them or any one of them whether the claim is based on the
negligence or the gross negligence of Select Rentals/Select Projects, or the
Releasees, or otherwise 9. I, on behalf of myself, my personal representatives, next of kin, assigns and heirs hereby
voluntarily agree to release, discharge, hold harmless, defend and indemnify Select
Rentals/Select Projects and the Affiliates from any and all claims, actions, or losses for
bodily injury, property damage, wrongful death, or otherwise which may arise out of my
participation while utilizing rental equipment, related equipment and/or accessories, including but not limited to any claims or actions that I may have at the present time or
in the future for the negligence, gross negligence, or other conduct of Select
Rentals/Select Projects and its Affiliates I HAVE CAREFULLY READ AND UNDERSTAND THE ENTIRETY OF THIS WAIVER AND RELEASE OF
LIABILITY AND BY SIGNING IT AGREE THAT IT IS MY INTENTION TO EXEMPT AND RELEASE
SELECT RENTALS/SELECT PROJECTS FROM LIABILITY FOR PERSONAL INJURY, PROPERTY
DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. I FULLY
UNDERSTAND THE TERMS OF THIS RELEASE AND WAIVER, UNDERSTAND THAT I HAVE GIVEN
UP ALL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY
INDUCEMENT RESERVATION, PAYMENT, CANCELLATION POLICIES Bookings may be cancelled and are fully refundable in form of a gift card provided a minimum of 48 hours of notice has been provided. Alternative arrangements or refunds are at the discretion of Select Rentals All payments may be made by credit card, etransfer, debit, or cash with the exception of
damage deposit. Damage deposit must be paid for with pre-authorized payment on valid credit
card. Damage deposit will be returned to The Renter within 7 days of the rental end date, less
deductions for damages should they be incurred. In the event that the rental equipment is not returned at the agreed upon time, The
Renter agrees to pay for damages that may be incurred as a result, such as extra or excessive
travel charges, cancelled rentals, etc TERMS AND CONDITIONS The Renter agrees and acknowledges that he/she is renting, operating, or using the
rental equipment at his/her own risk. The Renter agrees that he/she is voluntarily participating
in all activities related to the rental, operation, and use of the rental equipment. The Renter
acknowledges that the activities for which the rental equipment is designed include inherent
dangers, including the risk of illness, bodily injury, and/or death. The Renter assumes and
accepts all risks associated with the use of the rental equipment and its related equipment and
accessories. The Renter must be at least 21 years of age, have a valid driver’s licence, and produce
valid photo ID for all rentals. The Renter must possess a valid Pleasure Craft Operator’s Card
to rent/operate boats and/or Personal Watercraft. The Renter (if born after Jan 1, 1989) must
possess a valid Snowmobile Safety Certificate to rent/operate snowmobiles. The Renter must ensure that
any additional operator of the supplied rental equipment will possess and carry the above
listed/required licences and certificates, and all must be submitted to Select Rentals/Select
Projects prior to rental commencing. Only persons who have read/agreed to/signed the rental
agreement and supplied required documentation shall be permitted to operate the rental
equipment. The Renter agrees that the rental equipment will only be operated by
competent/qualified operators, in accordance with all relevant laws and regulations, as well as
the terms within this agreement. The Renter and all other approved operators shall not operate
the rental equipment so as to cause harm, injury, or damage to any other person or property. The Renter agrees that the rental equipment shall not be operated between ½ hour
after sunset and ½ hour before sunrise. Watercraft is to be removed from water and trailered
every night. Attaching watercraft to a dock overnight shall only be allowed with written permission
from Select Rentals/Select Projects. Anchoring or beaching watercraft is not permitted.
Snowmobiles shall be parked and covered if required. All rental equipment must be secured to
prevent theft. Insurance does not cover loss to theft. Loss to theft is the responsibility of the
renter at replacement value. The Renter agrees and acknowledges receiving proper loading /
unloading instructions for rental equipment. The Renter agrees that under no circumstances shall alcohol, narcotics, or other intoxicating substances
be consumed or used by any person in/on rental equipment. No person shall be allowed to operate rental equipment while impaired by alcohol, narcotics, or other intoxicating substances. Any violation of this policy shall entitle Select Rentals/Select Projects to terminate/cancel this agreement and
immediately take possession of rental equipment The Renter agrees that clean head coverings, such as balaclavas, shall be worn
underneath all rental helmets at all times. Rental helmets are thoroughly cleaned and
disinfected between rentals. The Renter agrees to operate the rental equipment as well as its related equipment and
accessories in accordance with the instructions and guidance of Select Rentals/Select Projects.
The Renter agrees that he/she has been given sufficient instruction and has sufficient prior
experience/credentials to operate the rental equipment in a competent and safe manner. The
Renter has read and understands all rules and regulations applicable to equipment rental and
operation. The Renter further assumes the responsibility that its guest(s) and alternate
operator(s) will understand and follow all applicable rules and regulations. The Renter assumes
responsibility for the safety and wellbeing of all passengers in/on rental equipment. The Renter agrees and acknowledges that the rental equipment may only be
transported to and operated at approved locations. Locations must be disclosed to Select
Rentals / Select Projects and documented prior to departure. At no time will the rental
equipment be allowed to be operated or transported outside of the Province of Saskatchewan,
Canada. The Renter acknowledges receiving proper instructions regarding transport of rental
equipment as well as proper accessories to be utilized for transport, including but not limited to
covers and/or windshield protection, hitches, tie downs, locks, and pins. The Renter
acknowledges that in a situation where a snowmobile needs to be towed, that the drive belt
shall be removed prior to towing. The Renter acknowledges that he/she, and all other persons permitted to operate the
rental equipment, have been shown and completely understand how to operate the rental
equipment and all of its accessories, including safety equipment and location of same. The Renter agrees to ensure that Rental equipment is not occupied by a greater number
of persons than is permitted by manufacturer’s guidelines. Watercraft limits are posted on the
watercraft manufacturer’s tag. Snowmobiles are not permitted to carry passengers unless
manufacturer rated to do so and are also equipped with a second seat rated to carry a
passenger (a 2-up seat). The Renter of watercraft equipment is aware of “no wake zones” and assumes
responsibility for any damages caused by operation of watercraft equipment that does not
comply with rules and regulations of “no wake zones” The Renter agrees to operate the rental equipment, it’s trailer, as well as all related and
attached equipment and accessories in conformity with all government, municipal, marine, and
road rules and regulations, and in a manner which does not infringe upon the rights or safety of
waterfront homeowners, residential, businesses, and other vessels or equipment on the road
or water. The Renter agrees not to use, nor permit the use of the rental equipment for any illegal
or unlawful purpose, or in any careless or negligent manner including a race or competitive
event The Renter agrees and assumes responsibility to ensure that all persons in or on rental
equipment during the rental period comply with all terms and policies herein set forth The Renter is responsible for all charges owing on the rental of equipment, including
refuelling, loss or damage to the rental equipment or its accessories and attachments not
deemed by Select Rentals/Select Projects to be a result of “ordinary wear and tear”. The Renter
is responsible for any or all other charges/fines deemed necessary by Select Rentals/Select
Projects. All rental equipment must be returned fully fuelled. If rental equipment is returned
without being fully refuelled, renter will be charged pump rates plus 25% to refill. The Renter
agrees to utilize only premium fuel (91 octane minimum) in all rental equipment. The Renter authorizes and allows Select Rentals/ Select Projects to charge the Renter’s
credit card for any and all charges assessed to the Renter by Select Rentals/Select Projects
pursuant to this agreement The Renter agrees to immediately report to Select Rentals/Select Projects any
deficiencies, malfunctions, or damages involving the rental equipment, attached equipment, or
accessories. Although all rental equipment is fully inspected prior to departure as well as on
return, Select Rentals/Select Projects recommends that renter perform its own inspection and
document any damages or defects immediately, preferable before rental departure. By
accepting the rental equipment the Renter confirms that he/she has examined said equipment
and acknowledges that it is in good condition and repair, and that it is suitable for the purpose
for which it is being rented The Renter agrees that the rental equipment shall not be used for any towable that would carry, tow, or transport passengers, including
but not limited to tubes, sleds/toboggans, snowboards, water skiing, wakeboarding, or any other similar sport. The renter agrees that there will be no pets, no sunflower seeds, no glass bottles, and no smoking
allowed in or on any rented equipment. The Renter agrees to return the Rental equipment at the assigned return time. The
rental equipment shall be returned clean and in the same working condition as it was at
departure. If rental equipment needs to be cleaned, a base cleaning charge of $150.00 will be
charged as well as any further amounts deemed necessary by Select Rentals/Select Projects to
return the equipment to satisfactory condition. The Renter is responsible to ensure any vehicle used to tow or transport Rental
equipment is rated and properly insured to do so legally, safely, and effectively. The Renter shall ensure that the
vehicle is equipped with appropriate hitch, pins, brake controllers, safety and electrical hook
ups to allow for lights, safety, and brakes to operate satisfactorily. Towing or transporting rental
equipment without such equipment is strictly prohibited. The Renter agrees that Select Rentals/Select Projects is not responsible for any damages
to the towing or transport vehicle, whether or not it is the Renter’s vehicle. The Renter acknowledges his/her responsibility for the safe and proper operation of the
rental equipment, and for the safety and welfare of other operators, passengers, and persons The Renter shall ensure that any/all persons utilizing the rental equipment shall have,
and use at all times, the proper safety equipment, including but not limited to life jackets, seat
belts, and helmets. Due to Covid-19 restrictions it is preferred that the renter supply their own
safety equipment. If unavailable, Select Rentals/Select Projects can supply at an additional cost.
All personal safety equipment must be readily available for inspection should Select
Rentals/Select Projects deem necessary. The Renter acknowledges that this agreement is non transferrable or assignable The Renter acknowledges that no part of this agreement assigns title interest or
ownership of any equipment to the Renter. Nothing in this agreement is to be taken as
transferring any proprietary interest to The Renter The Renter acknowledges and agrees to the following: On the failure of The Renter to
perform any obligation stipulated in this agreement, or if The Renter or anyone in The Renter’s
party are in violation of any of the terms of this agreement, or on default and payment of rental
fees as is provided, Select Rentals/Select Projects may, at its option, cancel this agreement
whereupon The Renter shall surrender to Select Rentals/Select Projects possession of the
rented equipment. If this agreement is so terminated, The Renter will not be refunded the
rental rate or the security deposit. Select Rentals/Select Projects reserves the right to cancel
this agreement due to inclement or impending bad weather in the event of which rental fees
will be prorated based on time used. The Renter acknowledges and agrees that in the event of any malfunctions, mechanical
or electrical failure, or breakdown of the rental equipment, or any of its parts, equipment, or
accessories, Select Rentals/Select Projects shall not be responsible to adjust amounts paid for
any delays or interruptions that may occur. Select Rentals/Select Projects shall endeavour to
service the equipment and to complete any required repair as quickly as reasonably possible. I, “The Renter” and I “The Operator”, by signing below, confirm that I have read this entire
agreement and fully understand and agree to the terms and conditions as set forth herein. May 7, 2024
