I, (“Participant”) , commit to participate in the 2025 SheJumps Grand Teton Fundraising Climb (“Climb”) as a member of the team. Date of Climb July 13-16, 2025 with a non refundable registration fee $500 (“Registration Fee”) payable to SheJumps, a nonprofit Corporation (“SheJumps”). The Registration Fee for SheJumps Grand Teton Fundraising Climb is $500 and does not count towards the Fundraising Total. I Agree I agree to fundraise or be personally responsible for a fundraising total (“Fundraising Total”) of $3,800 for SheJumps programs. I Agree Half of the Fundraising Total due to SheJumps by April 25, 2025 (“Midpoint Fundraising Deadline”), and the other half of the Fundraising Total due to SheJumps by June 27, 2025 (“Final Fundraising Deadline”). I Agree The non refundable Registration Fee along with this signed “Participant Agreement,” is due at the time of registration with SheJumps. I understand that if I am unable to secure half of the Fundraising Total on or before the Midpoint Fundraising Deadline, or all of the Fundraising Total on or before the Final Fundraising Deadline, then I will be personally responsible for the remaining amount of the Fundraising Total, and commit to paying any remaining amount of the Fundraising Total via Classy. AGREEMENT I agree to be responsible for all other costs associated with the Climb, including but not limited to training, clothes, equipment, food & drink that is not provided, transportation that is not provided, lodging that is not provided and any expenses I incur over the Basic Guide Services. WAIVER I understand that mountaineering can be physically challenging and may expose me to dangers and risks of personal injury or death that cannot be anticipated or prevented. I assume the known safety risks posed by the Climb and related activities, including training. I acknowledge that I have read all of the “Climb Information” on the Website, verify that I have full knowledge of the risks involved, and confirm that I am in good health and am physically fit to participate in this Climb and training. I hereby release SheJumps and any SheJumps Grand Teton Fundraising Climb sponsors and their agents, directors, employees, managers and volunteers from any and all claims, demands, or causes of action (including those relating to property damage, personal injury or death) arising from participation in the SheJumps Grand Teton Fundraising Climb and related activities, including training. In addition, I grant permission for all of the foregoing to use any photographs, motion pictures, recordings, or any other record of this event for any legitimate purpose. I understand that the guide services reserve the right to withdraw a climber’s eligibility should a team or individual’s safety be jeopardized (“Guide Service Cancellation”). As to SheJumps, I agree that this Participant Agreement shall be governed by the laws of the States of Utah and Wyoming. CANCELLATION AND REFUND POLICY Due to the costs associated with the Climb and the limited availability of climber spots, SheJumps must adhere to a stringent cancellation and refund policy, as described in the following section 5. Cancellation. I have read this Participant Agreement and agree to the terms set forth therein. PARTICIPANT TERMS AND CONDITIONS These Terms and Conditions (“Terms”) will apply to each participant (“Participant”) of the SheJumps Grand Teton Fundraising Climb (“Event”) to benefit SheJumps (“SheJumps”) that is described in the Participant Agreement. In order to protect SheJumps’ name, marks and reputation, participation must be conducted in accordance with these Terms. Only Participants that agree to comply with these Terms are permitted to use SheJumps’ name and marks. 1. Fundraising on Behalf of SheJumps 1.1 These Terms together with the Participant Agreement to which they are attached (collectively “Agreement”) provide the basis of any dealings with SheJumps in relation to the Event. Unless separately defined in these Terms, or unless the context clearly indicates a different meaning, capitalized terms shall have the meaning specified in the Participant Agreement. 1.2 SheJumps cannot accept and Participant agrees not to donate to SheJumps donations from donors or events affiliated with or directly sponsored by any organization associated with terrorist activities or donations obtained by illegal means. 1.3 All donations for the Event are directed to SheJumps. Participant must promote the fact that donations for the Event will be directed for programs at SheJumps in advance on all promotional materials (including Web-based, advertising, TV/radio, public relations materials). 2. Processing and Receipting of Donations 2.1 All donations toward Fundraising Totals must be raised on or before the Midpoint and Final Fundraising Deadlines as detailed in the Participant Agreement. 2.2 All donations made payable to and received by SheJumps will receive a written acknowledgment from SheJumps for tax purposes acknowledging the donation. SheJumps will use the name and address received with the donation for purposes of the tax acknowledgment. 2.3 SheJumps can verify matching gifts only for donations received directly by SheJumps that are eligible to receive a tax acknowledgment from SheJumps. 3. Use of SheJumps’ Name and Marks 3.1 The name “SheJumps,” and its logos and other promotional materials or photographs relating to SheJumps (including any that appear on its website, shejumps.org), are trademarked and copyrighted materials (collectively “SheJumps Marks”). SheJumps Marks cannot be displayed, copied or used in any manner without prior written consent from SheJumps. Acceptance of the Agreement does not constitute consent to use SheJumps Marks except as provided in Section 3.4 below. 3.2 Consent to use SheJumps Marks is at the discretion of SheJumps and may be subsequently negotiated at the discretion of SheJumps. 3.3 Use of the SheJumps name is permitted under this Agreement, the name “SheJumps” must always be used in its entirety. Participant has no rights to any SheJumps Marks or any combination or derivative of such SheJumps Marks, nor is Participant given the right to raise funds in the name of “SheJumps” for any purpose other than those outlined in the Agreement accepted by SheJumps. 3.4 Participant may state that the Event is to support SheJumps programs, or that proceeds from the Event benefit SheJumps programs, but may not use any other SheJumps Marks unless agreed in writing by SheJumps. 3.5 Any material (including Web-based, advertising, TV/radio, public relations materials) using SheJumps Marks must be submitted for approval prior to being printed or circulated. Requests to use any SheJumps Marks take at least seven (7) business days to process and may take longer depending on the circumstances. 4. Use of Participant Web Page 4.1 Subject to the Terms in this Agreement, SheJumps will provide to Participant a personal web page and associated event page (“Participant Web Page”) to promote her participation in the Event. 4.2 SheJumps may use for any purpose, the text, personal information, names, images and other materials that Participant submits to the Participant Web Page. Participant confirms he/she owns or has rights to use these materials, and he/she has the authority to grant to SheJumps this permission. 4.3 SheJumps may remove or disable Participant’s Web Page at any time, in its sole discretion. 4.4 Participant has read and agrees to comply with SheJumps’ Website Terms of Use and Privacy Policy, which apply to the Participant Web Page. 5. Cancellation 5.1 Cancellation Policy 5.1.1 Cancellation on or before the Midpoint Fundraising Deadline: If Participant wants to cancel his/her participation in the Climb before the Midpoint Fundraising Deadline noted in this Participant Agreement, then Participant must email SheJumps. SheJumps will process cancellation notices received before the Midpoint Fundraising Deadline, and Participant will be responsible for half of the Fundraising Total, but will not be responsible for the final Fundraising Total. Under no circumstances are fundraising amounts refunded or credited back to the individual donors. Any donations received up to the point of cancellation will directly support programming at SheJumps, regardless of the reason for cancellation. 5.1.2 Cancellation after the Midpoint Fundraising Deadline: After the Midpoint Fundraising Deadline noted in the Participant Agreement, there is no cancellation, and the Participant must raise the full Fundraising Total or have the remaining amount of the Fundraising Total charged by credit card or online payment. Under no circumstances are fundraising amounts refunded or credited back to the individual donors. 5.1.3 Guide Service Cancellation: If, at any time, the guide service determines that a team or individual’s safety is jeopardized by a Participant, then the guide service may immediately withdraw Participant’s eligibility for the Climb. Under these circumstances of Guide Service Cancellation, the withdrawn Participant must still meet the fundraising amounts due at the Midpoint Fundraising and Total Fundraising Deadlines. SheJumps may carry over a Participant’s eligibility to another climb or to the following year in SheJumps’ sole discretion. Under no circumstances are fundraising amounts refunded or credited back to the individual donors. 5.1.4 Cancellation in the Case of a Global Catastrophic Event: if the the climb is cancelled in the case of a global pandemic or some other global catastrophic event, SheJumps will credit Participant with 50% of funds raised at the time of cancellation, not to exceed the cost of the guide fee for this climb (maximum $2,100). These funds may only be used toward a fundraising climb in the following calendar year. Under no circumstances are fundraising amounts refunded or credited back to the individual donors. Participant may choose to donate these funds to SheJumps. 5.1.5 Exception: If a climber drops out due to unforeseen medical issues, and the spot can be filled within two weeks of the drop notice, SheJumps will not charge the climber the remainder of the fundraising balance. These Terms and Conditions (“Terms”) will apply to each participant (“Participant”) of the 2025 SheJumps Grand Teton Fundraising Climb (“Event”) to benefit SheJumps (“SheJumps”) that is described in the Participant Agreement. In order to protect SheJumps’ name, marks and reputation, participation must be conducted in accordance with these Terms.
