FRITZY’S ROLLER SKATE SHOP – RENTAL AGREEMENT AND POLICIES

I hereby acknowledge and agree to the following rental agreement terms and conditions:

Roller skates/blades are rented out clean and in proper working condition and must be returned in the same manner. Roller skates/blades are maintained on a daily basis. It is the responsibility of the client to check the skates at the store BEFORE setting out on any skate adventure.

Gear and Helmets are available to rent or buy from FRITZY’S ROLLER SKATE SHOP. It is strongly recommended that all participants wear a helmet and gear at all times while on skates.

I agree to allow FRITZY’S ROLLER SKATE SHOP to use my image in photographic reproduction for advertising/promotional purposes.

I acknowledge that it is my responsibility to return rental skates/blades/equipment under all circumstances and that FRITZY’S ROLLER SKATE SHOP does not provide pickup/rescue service. I understand that FRITZY’S ROLLER SKATE SHOP requires a security deposit of at least $50/per set of skates/blades. When the roller skates/blades are returned, deposits made on credit/debit cards will be released within a period of time dependent upon the policy of my financial institution. I understand and agree that in the event that said rental skates/blades/equipment are lost, stolen, or damaged, to forfeit my security deposit and immediately pay FRITZY’S SKATE SHOP the total cost to replace/repair skate(s)/equipment plus any rental charges incurred. A minimum fee of $179.00 will be charged for loss of roller skates/blades, $60.00/helmet, plus any additional rental equipment.

I understand and agree that a 2-hour minimum charge applies to all hourly rentals and that the rental time begins when deposit is submitted. After 2 hours, rentals are calculated on half day increments with a 10 minute grace period and will be charged a $25 late fee along with the additional half day rates. Late fees will accrue for 3 days. Once the items are 3 days delinquent the cost to replace the rental items will also be charged.

Customer agrees to return the skates/blades in clean, UNDAMAGED condition to avoid any ADDITIONAL charges for repair, maintenance or replacement. Customer accepts the use of the equipment, AS IS, in good condition and accepts full responsibility for care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced at the shop’s discretion and the customer agrees to pay regular shop rates and retail prices for components replaced. Clean condition means normal wear and tear is accepted but does not include broken trucks, plates, bearings, wheels, and boot rips, tears, etc. Hourly and Daily rentals are due back 15 minutes before closing time. Late returns are subject to additional fees.

Customer agrees to provide FRITZY’S ROLLER SKATE SHOP with credit card details, for rental and precautionary use only: I authorize FRITZY’S ROLLER SKATE SHOP to charge the credit card provided by me for all eventual costs in case of damages to the roller skates/blades(s) during my rental period, comprehensive of labor, except in the case that I can demonstrate other’s faults with evidence and all necessary information for reimbursement. In case of theft, I will be responsible for reimbursing FRITZY’S ROLLER SKATE SHOP for the original price of the roller skates/blade(s), plus the cost of any accessories or gear that were provided at the time of the rental.

ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT

Assumption of Risk:
I understand and accept that renting these roller skates/blades and participating in roller skating exposes me/my child to many hazards that may entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I/my child should be in good physical health to participate in roller skating, and I confirm that I/my child have no significant health issues that prevent me/my child from participating in roller skating. I/my child have no medical conditions, nor have I/my child been diagnosed with a condition that prevents me from roller skating.  In spite of the aforementioned risks and acknowledgements, I hereby assume all risk of injury or loss of life to myself/my child and loss of or damage to property arising out of renting these roller skates/blades and participating in roller skating. I understand the inherent risk involved in using these rental roller skate/blade equipment and accept full responsibility for any and all such damage or injury which may result.

Waiver And Release:
I acknowledge that rough roads and paths are an inherent risk of roller skating. I further understand that although roads, routes, and surfaces are suggested to me for skating by FRITZY’S ROLLER SKATE SHOP, they are not owned, monitored, managed, or kept by FRITZY’S ROLLER SKATE SHOP and hence release FRITZY’S ROLLER SKATE SHOP from any responsibility for condition of said areas. I understand that it is unsafe to roller skate/blade after dark without lights.

I agree to indemnify and hold harmless FRITZY’S ROLLER SKATE SHOP, including owners, officers, agents, employees, volunteers, participants, landlords, tenants, sponsors, advertisers, and any other entity or person acting on their behalf, from any and all liability for damage, injury, or death to myself or to any other person or property, which are in any way connected to my participation in the activity stated herein. I waive my right to present any legal claim or lawsuit against these entities or persons regardless of how any damage,injury, or death may have occurred, through negligence or any other manner considered through legal claim.

I agree to release, discharge, indemnify, and hold harmless all manufacturers and/or distributors of any equipment provided to me by FRITZY’S ROLLER SKATE SHOP, including but not limited to roller skates/blades, helmets, and gear, from any and all liability for damage, injury, or death to myself, or any other person or property, which are in any way connected to my participation in the activity stated herein. I hereby waive my right to present any legal claim or lawsuit against these entities regardless of how any damage, injury, or death may have occurred, through negligence or any other manner considered through legal claim.

I agree that this contract is a warning, release of liability, assumption of risk, and indemnity agreement that serves as a legally binding contract. I agree that this contract is intended to serve as comprehensive a release of liability and indemnity agreement as is legally allowed. I agree that if any portion of this contract is found to be void, invalid or unenforceable, the remaining portions shall remain in full force and effect. I agree that this contract shall be binding for myself, my children, my heirs, assigns, executors, and personal representatives and administrators of my and/ or their estate(s).

FURTHERMORE I AGREE TO THE TERMS OF THE FRITZY’S ROLLER SKATE SHOP AGREEMENT ABOVE.
