STOKE RUN LLC — SPECTATOR WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENTPlease read the following terms and conditions carefully before entering the premises at Stoke Run. By signing this agreement, you acknowledge your understanding of the risks involved as a spectator or visitor and agree to release Stoke Run LLC, Gillson Jeffrey T Trustee ETC, Soundall LLC, and all owners, operators, employees, and partners/affiliates (collectively, the “Released Parties”) from any and all liability. 1. ACKNOWLEDGEMENT OF RISKI, the undersigned, understand that as a spectator or visitor at Stoke Run Action Sports Park, I may be exposed to certain inherent risks, including but not limited to: being struck by riders or equipment, collisions with other visitors or fixed objects, tripping hazards, uneven terrain, and weather-related obstacles. I acknowledge that the park contains ramps, trails, jumps, and features intended solely for riders, and that entering or standing near these areas presents a risk of injury. I accept full personal responsibility for remaining aware and alert during my time on the premises.
2. NO INSURANCE PROVIDED / RESPONSIBILITY FOR MEDICAL COSTSI understand and agree that the Released Parties DO NOT PROVIDE OR MAINTAIN HEALTH, MEDICAL, OR DISABILITY INSURANCE for spectators or visitors. I am solely responsible for securing my own insurance coverage and for all costs and expenses related to any injury, illness, or incident that may occur while on the premises.
3. RELEASE OF LIABILITYI hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, losses, or liability arising out of or related to any injury, illness, damage, or death that may occur while I am on the property. This includes any incidents caused by proximity to riders, trip hazards, natural features of the land, or the actions of others—whether caused by the negligence of the Released Parties or otherwise.
4. ASSUMPTION OF RESPONSIBILITY FOR HAZARDSI understand that obstacles, ramps, and trails are off-limits to spectators, and I agree to remain in designated areas. I accept full responsibility for my decision to be on the premises and acknowledge the risks associated with moving through an active action sports environment. I understand that entering rider zones, standing near jumps, or ignoring posted signs increases the likelihood of injury, and I voluntarily accept these risks.
5. INDEMNIFICATIONI agree to indemnify and hold harmless the Released Parties from any claims, damages, or expenses (including attorney’s fees) that may result from my actions or presence on the property, including claims that arise from being struck by riders or any other hazards associated with Stoke Run Action Sports Park.
6. PHOTO AND VIDEO RELEASEI grant the Released Parties full rights to photograph or film me while I am at the park. These images and recordings may be used, without compensation, for promotional, commercial, or informational purposes in any format or medium.
7. RULES AND REGULATIONSI agree to follow all posted signage, verbal instructions from staff, and park rules during my visit. I understand that failure to follow rules may result in my removal from the premises without refund or re-entry.
8. GOVERNING LAW AND JURISDICTIONThis Agreement is governed by the laws of the State of Ohio. Any legal disputes shall be resolved in the state or federal courts located within Ohio.
9. SEVERABILITYIf any part of this Agreement is found to be invalid or unenforceable, all other provisions shall remain in effect.
NOTICE TO PARENT OR LEGAL GUARDIAN By signing below, I affirm that I am the parent or legal guardian of the minor named and have the authority to sign on their behalf. I understand and accept the risks on behalf of the minor and agree to all terms of this waiver.
