STOKE RUN LLC — POWERSPORTS, MOTOCROSS, & E-BIKE WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT

Please read the following terms and conditions carefully before participating in any activities at Stoke Run.

By signing this agreement, you acknowledge your understanding of the risks involved and agree to release Stoke Run LLC, Gillson Jeffrey T Trustee ETC, Soundall LLC, and all owners, operators, employees, and partners/affiliates (collectively referred to as the “Released Parties”) from any and all liability.

1. ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND EXPRESS WAIVER OF CLAIMS

I, the undersigned, understand that motocross, e-bike riding, and the use of other powersports vehicles (including but not limited to ATVs, UTVs, and any gas or electric-powered vehicles) (collectively, “Motorized Activities”) at Stoke Run Action Sports Park involve inherent and unavoidable risks, including but not limited to: collisions with other participants or fixed objects; loss of control; terrain changes; mechanical failure; dust, mud, or debris; and other hazards that may result in serious injury, disability, or death.

These activities take place on outdoor trails, jumps, and a race track, which may naturally degrade over time. I understand and accept that I am participating entirely at my own risk and I take full responsibility for my safety and conduct. I also understand that use of ramps in the indoor facility is strictly prohibited for Motorized Activities.

2. NO INSURANCE PROVIDED / RESPONSIBILITY FOR MEDICAL COSTS

I understand and agree that the Released Parties DO NOT PROVIDE OR MAINTAIN HEALTH, MEDICAL, OR DISABILITY INSURANCE for participants or spectators. I am fully responsible for obtaining my own insurance coverage and agree that any injury or loss I suffer is my financial responsibility alone.

I UNDERSTAND AND AGREE THAT I AM SOLELY RESPONSIBLE FOR ALL MEDICAL COSTS RESULTING FROM PARTICIPATION.

3. MANDATORY SAFETY GEAR

I agree to wear a helmet and all necessary protective gear at all times while participating in Motorized Activities, including but not limited to gloves, boots, long sleeves/pants, and goggles or eye protection. I understand that failure to comply with safety gear requirements may result in immediate removal from the property without refund.

4. RELEASE OF LIABILITY

I hereby fully and forever release, waive, and discharge the Released Parties from any and all liability, claims, demands, or causes of action arising out of or related to my participation in Motorized Activities or presence on the property, including those caused by the negligence of the Released Parties.

This includes but is not limited to injuries resulting from the condition of trails, jumps, track layout, visibility issues, mechanical failures, or weather-related terrain changes.

5. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or expense (including attorney’s fees) that may arise from my participation in Motorized Activities or my presence on the premises. This includes but is not limited to claims brought by others due to my actions, negligence, or failure to follow rules.

6. ASSUMPTION OF RESPONSIBILITY FOR HAZARDS

I acknowledge and agree that it is my responsibility to inspect all trails, jumps, and the race track before riding. If I observe any dangerous condition, I will notify staff and refrain from participating until the issue is resolved.

By choosing to ride, I voluntarily accept all risks, including hidden or unpredictable hazards due to terrain, weather, erosion, maintenance, or other riders.

7. PARTICIPANT CONDUCT & INDOOR FACILITY RESTRICTION

While riding or present on Stoke Run property, I agree to:

  • Operate my vehicle within the limits of my skill and equipment
  • Maintain full control of my vehicle at all times
  • Refrain from reckless or unsafe conduct that may endanger others
  • NOT use ramps in the indoor facility for Motorized Activities

I understand that violation of these rules may result in removal from the premises and possible permanent ban.

8. SPECTATOR RISK NOTICE

I understand that spectators are also exposed to risk during Motorized Activities due to vehicle collisions, flying debris, or equipment failure. I agree that if I am spectating or standing near active areas, I do so voluntarily and assume full responsibility for any resulting injury.

9. PHOTO AND VIDEO RELEASE

I grant the Released Parties full and unrestricted rights to capture, use, and publish images, video, or audio recordings of me taken during participation. These materials may be used in promotions, advertisements, or documentation across all media platforms.

I waive any claim for compensation and release the Released Parties from all liability related to the use of my likeness.

10. RULES AND REGULATIONS

I agree to comply with all posted rules and instructions given by park staff. This includes respecting age restrictions, safety gear policies, designated riding zones, and all facility boundaries. I understand that failure to follow rules may result in expulsion from the premises without refund.

11. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the State of Ohio. I agree that any legal disputes shall be brought exclusively in the state or federal courts located within Ohio.

12. SEVERABILITY

If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

13. NOTICE TO PARENT OR LEGAL GUARDIAN OF MINOR PARTICIPANT

READ CAREFULLY: BY SIGNING THIS WAIVER, YOU ARE ALLOWING YOUR CHILD TO ENGAGE IN MOTORSPORTS ACTIVITIES THAT CARRY RISK OF SERIOUS INJURY OR DEATH.
Even if the Released Parties use reasonable care, these risks cannot be eliminated. You are waiving your and your child’s right to sue the Released Parties. You have the right to refuse to allow participation, and the Released Parties have the right to refuse access if you do not consent.
By signing below, I certify that I have read, fully understand, and voluntarily agree to the terms of this STOKE RUN LLC Powersports Vehicles, Motocross, and E-Bike Waiver, Release, and Assumption of Risk Agreement. If the participant is under the age of 18, I certify that I am the participant’s parent or legal guardian and have the authority to sign on their behalf.
