SANDY VALLEY RANCH
RELEASE AND INDEMNITY AGREEMENT

PERSONAL INFORMATION.

My name is listed below (I am at times referred to herein as “Participant”). It is my desire to participate in one or more activities on or about the premises at the Sandy Valley Ranch located in Sandy Valley, Nevada (collectively, the “Ranch Activities”), which may include the following:

  • Horse-Drawn Carriage
  • Eating & Drinking
  • Goat Dressing
  • Horseback Riding
  • Bucking Barrel
  • Axe Throwing
  • Team Penning and Roping
  • Trail Riding
  • Interaction with Various Animals
  • Campfires
  • Bull Riding
  • Target and Skeet Shooting
  • Overnight Camping and Short-Term Rentals
  • Archery
  • Horseshoes

I understand that the execution of this Release and Indemnity Agreement (the “Release”) is a condition precedent to permission to participate in such activities. I also understand that I am not expected to participate in any particular activity. I accept full responsibility for assessing the risks of each activity in comparison to my personal skill and experience.

THIS RELEASE IS A LEGAL DOCUMENT. The parties to this Release are, on the one hand, me, on behalf of myself, my heirs, my executors, my administrators, my personal representatives and all others who may claim by or through me at any time including any representative(s) of my Estate and, on the other hand, Sandy Valley Ranch, LLC, a Nevada limited liability company (“SVR”), on behalf of itself and any owner, member, manager, employee, agent, representative, contractor, shareholder, officer, director, subsidiary, affiliate, parent company, successor or assignee of SVR (collectively with SVR, the “SVR Parties”). 

VOLUNTARY CHOICE. I acknowledge that Ranch Activities can be dangerous, and there are inherent hazards and risks involved in my participation in the Ranch Activities. I further acknowledge that I can be seriously injured, maimed, paralyzed, or even killed as a result of my participation and that there various pests, rodents, and insects (including without limitation scorpions, spiders, bees, and snakes) that inhabit Southern Nevada and may cause injury while engaging in the Ranch Activities. I desire to participate, and I have come to participate of my own free will and not due to any inducement or duress whatsoever. I understand that part of the required consideration for being allowed to participate is my execution of all the provisions of this Agreement.

NATURE OF SPORT AND ASSUMPTION OF ALL ASSOCIATED RISKS. I understand that Ranch Activities are dangerous, calculated risk activities which can, and sometimes do, result in serious, permanent bodily injury or death to its participants or spectators. I understand that I can be injured or killed, even if I do everything as I was instructed to do. I am accepting these and all other accompanying risks in order to be allowed to participate of my own free will and with full understanding of the possible consequences and potential dangers.

HELMET. I understand that safety helmets are available and that I have been encouraged to wear such a helmet while engaging in the Ranch Activities involving horses or bulls. I will assume the responsibility of notifying SVR staff if I want to wear a safety helmet when participating in such activities.

COVENANT THAT THE EVENTS COVERED BY THIS AGREEMENT ARE NOT ULTRA HAZARDOUS NOR DO THEY INVOLVE A PUBLIC SERVICE. I hereby acknowledge and affirm that, while inherently dangerous and risky, the Ranch Activities are not ultra hazardous activities for which one can be held strictly liable, nor are they activities that serve the public good or are in the public's interest. Rather, the Ranch Activities are recreational activities in which I am voluntarily participating for my own enjoyment.

NOTICE OF OPPORTUNITY TO CONSULT LEGAL COUNSEL. I understand that I am in no way obligated to sign this Agreement and, further, that I am free to seek the advice of independent legal counsel at my own expense prior to signing this Agreement and that any advice, suggestions, or statements made by any of the Released Parties are not binding upon them unless they are set forth in this Agreement.

CONSENT TO USE OF VIDEOGRAPHY AND PHOTOGRAPHS IN ADVERTISING FOR SANDY VALLEY RANCH. I have been informed that video and pictures may be taken during the Ranch Activities by employees of the Sandy Valley Ranch, or other Sandy Valley Ranch customers, that may be used in advertisements. I hereby consent to Sandy Valley Ranch’s use of any video and photographs taken during my patronage at the Sandy Valley Ranch in which I appear for the purposes of advertising its business.

FORUM. The laws of the state of Nevada shall govern the interpretation and effect of this Release without giving effect to any choice or conflict of law provision or rule (whether of the State of Nevada or any other jurisdiction). The parties agree that any legal suit, action, or proceeding arising out of this Release shall be instituted in the courts of the State of Nevada located in Clark County, Nevada, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding. Should any party hereto retain counsel for the purpose of enforcing any provision hereof, then the prevailing party shall be entitled to be reimbursed by the losing party for all costs and expenses incurred thereby, including, but not limited to, reasonable attorneys’ fees and costs for the services rendered to such prevailing party at the trial level and for such fees and costs incurred in any appeal therefrom.

CONSENT OF PARENT/GUARDIAN: If Participant is under the age of 18, a parent or guardian must sign this Agreement. By signing below, Parent/Guardian hereby agrees to each term and condition hereof, on behalf of themselves and Participant, agrees to assume full responsibility for Participant while engaged in Ranch Activities (including the decision to wear a helmet), and agrees to defend, hold harmless and indemnify Released Parties with respect to any injury suffered by or caused by Participant.

RELEASE AND WAIVER OF ALL CLAIMS. For valuable consideration including, but not limited to, the opportunity to participate in the Ranch Activities, I for myself, my heirs, representatives, assigns, successors, administrators and anyone else claiming by or through me hereby expressly release, discharge, indemnify, defend, and hold harmless the SVR Parties and any arena operators or owners, officials, bull owners, caretakers, bull-riding instructors, stable crews, any persons in any restricted areas, sponsors, advertisers, owners, and lessees of the premises used to conduct the Ranch Activities (collectively, the “Released Parties”) from all claims, causes of action, liabilities, amounts paid in settlement, and demands for property damage, personal injury or death arising out of, or resulting from, the Ranch Activities or any other activity at Sandy Valley Ranch (including without limitation any slipping or tripping incidents) or any videography or photography of the same, whether caused by the active or passive negligence of any of the Released Parties, me, or otherwise. I hereby expressly agree to the terms and conditions of this Section, including without limitation the release and indemnification of the Released Parties for their own negligence in connection with the Ranch Activities or any videography or photography of the same.

I have carefully read this entire Agreement, without any time constraints being placed upon me, and fully understand and agree to be bound by its contents. I am aware that by signing this contract I am giving up important legal rights and it is my intention to do so freely and without coercion or duress of any type.
