TDR Puppy Buyer Agreement

 

This agreement is made, and hereby entered into by and between Bret McGowan (hereafter referred to as “Seller”) and a buyer to be specified later in this document. This document is for the purpose of setting forth the terms and conditions of the purchase by the buyer of a dog from Texas Doodle Ranch. All puppies sold by Texas Doodle Ranch are sold without breeding rights.

The Seller warrants that the above-described puppy is in good health and free of communicable diseases at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian within 72 hours of receipt of puppy.

Payment: Buyer agrees to pay via cash or personal check on or before "pickup day".

GENERAL DISCLAIMER

No breeder can state that any given puppy will be completely free of a genetic defect. Texas Doodle Ranch screens the background of all prospective fathers and mothers used in the breeding program to reduce the odds of whelping a genetically inferior or defective puppy. Seller provides FREE 30 day health insurance that is included in your packet. Go to www.trupanion.com or call 855-266-2156 and use breeder code BR1BF5316. Failure to activate the free trupanion health insurance or another insurance of your choice on the day of transfer of ownership will void this guarantee.

I Agree

If, as a result of the examination, the Veterinarian determines that the puppy is not in good health, then the Buyer may switch for another puppy of the same price, if there are any available. Or the buyer can return puppy for a full refund. Before the puppy is returned the seller needs a vet check and an x ray no more than 3 days before returning the puppy. Seller needs to make sure puppy is not being returned because the buyer injured or abused the dog. All actions taken to return the puppy shall be with the best interest of the puppy in mind, including temperature at the time of shipment, nonstop flights etc.

The Buyer is completely satisfied and waives any and all claims regarding the puppy’s conformation and outward appearance. 

The buyer agrees that all transport costs to and from the Sellers premises will be at the cost and sole responsibility of the buyer.

The buyer agrees to maintain preventative health care of the puppy include, but not limited to: inoculations, internal as well as external parasites, heart-worms, and preventative medication. The seller is not responsible for any vet bills.

The buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (i.e.not allowing puppy to jump from heights taller than itself at the shoulder, no forced exercises such as running until at least 18 months of age). 

Ownership of the puppy shall be transferred to the Buyer for the sale price of $2500to be paid in full. Only after the full amount is paid may the puppy be removed from the Seller’s premises. 

If the puppy is being sold with a limited registration, the adult dog may not be bred for any reason. 

Buyer further agrees that seller makes no claims or statements regarding future size, shape, height, weight, genetic conformation, coat, color, or temperament. This is to be considered acts of God and buyer agrees to hold harmless seller in regards to the future status of the dog past the 72 hour vet check.


The Buyer agrees that he/she is not acting as or on the part of an agent in the purchase of this puppy and that the buyer will not sell this puppy to any agent, pet store or guard dog business.

The Buyer agrees that the puppy will not be left alone in a backyard or kennel only. The Buyer agrees that the puppy will reside at the home of Buyer and have access to a fenced yard and not be chained or tied out. The puppy is sold with the understanding that it was to go to select home, socialized properly and become a member of the family. 

If any part of the Agreement is breeched, the Seller is released from any further obligations hereunder. The venue for any dispute arising from this agreement shall be Grayson County, TX.
