The Clubhouse - Indoor Party and Play LLC Liability Waiver

This Liability Waiver and Release of Claims ("Waiver") is executed by the undersigned (the "Participant" or "Parent/Guardian") in favor of The Clubhouse -Indoor Party and Play, LLC, its owners, operators, employees, agents, contractors, and all affiliated entities ("Company").

 

1. Assumption of Risk

I, the undersigned, hereby acknowledge that the activities offered by The Clubhouse -Indoor Party and Play, LLC ("the Activities")—including but not limited to the use of inflatable bounce houses, slides, rock climbing wall, trampolines, basketball games, and other play equipment—are inherently dangerous and involve the risk of serious injury, including but not limited to broken bones, sprains, bruises, and in extreme cases, death. I voluntarily assume all risks associated with participation in the Activities, whether known or unknown, and agree to hold the Company harmless from any injury, loss, or damage arising from my, or my child's, participation.

 

2. Release of Liability

I, the undersigned, hereby release and forever discharge the Company, its officers, directors, employees, agents, contractors, and affiliates from any and all claims, demands, causes of action, or liability, whether known or unknown, arising from participation in the Activities, including but not limited to any injury, damage, or loss of property, personal injury, or death caused by negligence, breach of contract, or otherwise.

 

3. Indemnification

I agree to indemnify and hold harmless the Company from any and all claims, demands, actions, or suits, including legal fees, arising from my or my child’s participation in the Activities, including any claims brought by any third party.

 

4. Medical Treatment and Emergency Contact

In the event of injury or emergency, I consent to medical treatment and emergency services as necessary and agree to bear all costs associated with such treatment. I confirm that I have provided accurate emergency contact information and agree to notify the Company immediately of any changes to this information.

 

5. Supervision of Children

I, the undersigned, acknowledge that I am responsible for the supervision of any child in my care while using the play equipment and facilities at The Clubhouse Indoor Party and Play. I agree to ensure that the child follows all posted rules and guidelines for the safe use of the equipment and that I will take appropriate action to prevent any unsafe behavior.

 

6. Compliance with Rules and Regulations

I agree to abide by all safety rules and instructions posted at the facility and provided by staff. I understand that failure to follow these rules may result in being asked to leave the premises without a refund.

 

7. Waiver of Right to Sue

By signing this Waiver, I acknowledge that I am waiving any right to sue or hold the Company liable for any injury, damage, or loss that may occur during or after participation in the Activities, except for any claims arising from gross negligence or willful misconduct by the Company.


8. Photo and Social Media Release

I grant permission for The Clubhouse  to use photographs or video recordings taken during participation for promotional, marketing, or social media purposes without compensation, unless I notify  in writing prior to participation.


9 Security Camera Notice

For safety and security of all guest, The Clubhouse Indoor Party and Play is monitored by video surveillance. By entering the premises, participants and their parents/guardians acknowledge and consent to being recorded by security cameras while on the property. Video recordings may be used for staff training, safety, security, and incident documentation purposes.


10. Duration of Waiver

This Waiver is valid for the duration of the event or visit for which it is signed, and applies to all activities associated with that visit. If the Participant returns for subsequent visits or events at The Clubhouse Indoor Party and Play, this Waiver will apply to each such visit or event for a maximum of 5 years unless revoked by the Company in writing or unless a new waiver is signed at the time of the new visit.

 

11. Severability

If any provision of this Waiver is found to be invalid or unenforceable by a court of competent jurisdiction, the remainder of this Waiver shall remain in full force and effect.

 

12. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of Mississippi. Any dispute arising from this Waiver shall be subject to the jurisdiction of the courts located in Lee County, Mississippi.

 

13. Acknowledgment of Understanding

I have read this entire document, understand its contents, and sign it voluntarily. I am aware that by signing this Waiver, I am giving up certain legal rights, including the right to sue the Company for any injuries or damages related to my or my child’s participation in the Activities.
