Digital Day-Pass Waiver — For Online Booking / E-Signature Flow

WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK

2. Acknowledgment of Inherent Risks

I understand that participation in strength training, cardiovascular exercise, and use of fitness equipment carries inherent risks, including but not limited to: muscle strain, sprain, or tear; joint injury; injury from free weights, plates, cables, or machines; falls; equipment malfunction; and cardiovascular events, including in rare cases serious injury or death. I understand these risks exist even when equipment is properly maintained and instructions are followed.

I understand that during certain hours The Forge operates on a secure, unstaffed, 24/7 access basis, and that I may be training without another person present or without facility staff on-site to provide immediate assistance in the event of an injury or medical emergency.

3. Assumption of Risk

Having read and understood the risks described above, I voluntarily choose to participate and knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of The Forge, its owners, or its staff, and I assume full responsibility for my participation.

4. Release of Liability — Ordinary Negligence Only

In consideration of being permitted to use The Forge's facility and equipment, I release, waive, and discharge The Second Mountain Project, LLC, The Forge, and their owners, employees, and agents ("Released Parties") from any and all liability for personal injury, death, or property damage that results from the ordinary negligence of the Released Parties.

This release applies ONLY to claims of ordinary negligence. It does NOT release, and shall not be interpreted to release, any claim arising from reckless conduct, gross negligence, or intentional acts by the Released Parties. Nothing in this document limits liability for conduct that Wisconsin law does not permit to be waived.

5. Physical Condition

I represent that I am physically fit and have no medical condition that would prevent my safe participation, or that I have consulted a physician and been cleared to participate, or that I am voluntarily choosing to participate without such clearance and assume all associated risk.

I understand that certain medical conditions, medications, or previous injuries may increase the risks associated with exercise, and I accept responsibility for determining whether participation is appropriate for me.

6. Facility Rules & Independent Use

Guests are expected to exercise independently. Access to the facility does not include personal instruction or supervision unless separately arranged.

I understand that using unfamiliar equipment or performing exercises outside of my experience may increase my risk of injury, and I agree to use only equipment that I understand or to seek instruction before use.

I agree to discontinue use of any equipment that appears damaged or unsafe and to promptly report it to The Forge.

I agree to follow all posted facility rules, to use equipment only as intended, to not participate while under the influence of alcohol or drugs, and to leave the facility and contact emergency services (911) if I experience a medical emergency.

7. Personal Property

The Forge is not responsible for lost, stolen, or damaged personal property.

8. Emergency Medical Care Authorization

In the event of an injury or medical emergency during my use of the facility, I authorize The Forge staff, emergency personnel, or property management to contact emergency services and my emergency contact listed above, and I consent to receiving emergency first aid or medical treatment as needed pending arrival of emergency personnel.

9. Adults-Only Guest Access

Independent guest access to The Forge is limited to adults age 18 and older at all hours. I confirm that I am at least 18 years old. Minors are not permitted, even with a parent or guardian.

10. Access Credential Responsibility

I understand that my access credentials — including any keypad code, mobile app access, key fob, or temporary access code — are issued solely to me, may not be shared with any other person, and that permitting unauthorized entry may result in termination of my access.

11. Opportunity to Review and Negotiate

I acknowledge that I was given the opportunity to read this entire document, to ask questions about its terms, and to discuss or decline these terms before signing, and that I am signing voluntarily.

If you have questions about any part of this agreement before signing, we encourage you to ask. Because The Forge is independently owned, you may contact the owner directly at 920-519-1111 before using the facility. We want you to understand what you are signing and to make an informed decision about your participation.

12. Security & Premises Monitoring Notice

The Forge uses video camera monitoring throughout the facility for the security and safety of guests and the protection of equipment and property. This monitoring is a condition of access to the facility, is separate from the marketing authorization below, and does not require separate consent. Footage may be reviewed in the event of an incident, injury, or suspected misuse of the facility, and may be retained and shared as necessary for security, insurance, or legal purposes.

13. Photo / Video Release — Separate, Optional Authorization for Marketing

Marketing permission is optional. Select Yes or No in the separate question below. No permission is required to use the facility.

14. Severability & Governing Law

If any provision of this document is found unenforceable, the remaining provisions shall remain in full force and effect. This document is governed by the laws of the State of Wisconsin.

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
